The Cyberspace Administration of China solicits opinions: No pop-up window is allowed to push news information outside the scope of the "white list"

The "Draft Opinions" pointed out that the pop-up window push of news information should be strictly based on the latest version of the "List of Internet News Information Source Units" issued by the State Internet Information Office, and must not be reprinted beyond the scope, and the original meaning and content of the title must not be distorted or tampered with, so as to ensure that the news source can be traced and the news information is true, objective and comprehensive.

Provisions on the administration of Internet pop-up window information push services

(Draft for Solicitation of Comments)

Article 1: These Provisions are formulated on the basis of the "Cybersecurity Law of the People's Republic of China," the "Law of the People's Republic of China on the Protection of Minors," the "Advertising Law of the People's Republic of China," the "Measures for the Administration of Internet Information Services," the "Provisions on the Administration of Internet News Information Services," the "Provisions on the Ecological Governance of Online Information Content," and other laws and regulations, so as to standardize Internet pop-up window information push services, preserve national security and the public interest, protect the lawful rights and interests of citizens, legal persons, and other organizations, and promote the healthy and orderly development of the industry.

Article 2: Where operating systems, terminal equipment, application software, websites, and other such services are provided within the territory of the People's Republic of China, these Provisions shall be observed when carrying out Internet pop-up window information push services.

"Internet pop-up window information push service" as used in these Provisions refers to information push services provided to Internet users in the form of pop-up message window pages through operating systems, terminal devices, application software, websites, etc.

"Internet pop-up window information push service providers" as used in these Provisions refers to the owners or operators of operating systems, terminal devices, application software, websites, and so forth that provide Internet pop-up information push services.

Article 3: Internet pop-up information push services shall comply with laws and regulations, adhere to the correct political direction, public opinion orientation, and value orientation, carry forward the core socialist values, push high-quality pop-up information content that is upward and benevolent, and develop a positive and healthy network culture.

Article 4: Internet pop-up window information push service providers shall implement entity responsibilities for information content security management, establishing and completing management systems such as for information content review, ecological governance, network security, data security, personal information protection, and protection of minors.

Article 5: Internet pop-up window information push services shall strictly comply with the following requirements:

(1) Spread positive energy, carry forward the advanced socialist culture; actively push upward and benevolent content, and use the mainstream ideological values and moral culture of society to nourish people's hearts and nourish society.

(2) Illegal and negative information clearly defined in the "Provisions on the Ecological Governance of Online Information Content" must not be pushed, especially content that violates public order and good customs, such as malicious speculation and entertainment gossip, gossip and privacy, extravagance and ostentation of wealth, and ugly appearances; it must not be linked to a topic to focus on pushing relevant old news, maliciously stirring up.

(3) Where news information must not be pushed through pop-up windows without obtaining an Internet news information service license; where pop-up window push information involves other Internet information services, and it is necessary to obtain the review and consent of the relevant competent departments or obtain relevant permits in accordance with law, it shall be reviewed and approved by the relevant competent departments or relevant permits obtained.

(4) Pop-up window push of news information shall be carried out in strict accordance with the latest edition of the "List of Units That Source Internet News Information Manuscripts" issued by the State Internet Information Office, and must not be reproduced beyond the scope, and must not distort or tamper with the original meaning and content of the headline, ensuring that the news source can be traced and that the news information is true, objective, and comprehensive.

(5) Enhance the diversity of pop-up push information, scientifically set the proportion of news information and content in vertical fields, and reflect the mainstream values of positive health and upward mobility; must not pile up to push and hype up sensitive events in social hotspots, render vicious cases, disasters, etc., and trigger social panic.

(6) Equipped with manual forces appropriate to the scale of services, improve the management specifications for pop-up window information push content, improve information screening, editing, pushing and other work processes, and ensure that pop-up information push must undergo manual review.

(7) Protect the rights and interests of users, clearly inform users of the specific methods, content frequency, cancellation channels, etc. of pop-up information push services in the form of service agreements and other methods; fully consider user experience, scientifically plan the push frequency, and must not maliciously push ordinary users and member users with different frequencies; must not interfere with or affect users to close pop-up windows in any form; ensure that each pop-up window information clearly displays the identity of the pop-up information push service provider.

(8) Algorithm models that induce users to indulge, consume excessively, or otherwise violate laws and regulations or violate ethics and morality must not be set up; personalized pop-up windows must not be abused, using algorithms to block information, over-recommending, and so forth; algorithms must not be abused to profile minor users, and information that may affect their physical and mental health must not be pushed to minor users.

(9) Pop-up window push advertising information must be reviewed for content compliance and must not violate relevant national laws and regulations; it shall be identifiable, conspicuously marked with "advertisement" and clearly indicating the user; ensure that pop-up window advertising is closed with one click.

(10) Third-party links, QR codes, and other information maliciously drained and jumped must not be presented in the form of pop-up information push; users must not be induced to click through pop-up information push services, and traffic fraud or traffic hijacking must not be carried out.

Article 6: Internet pop-up information push service providers shall consciously accept social oversight, set up convenient entrances for complaints and reports, and promptly handle public complaints and reports on pop-up information push services.

Article 7: Internet industry organizations are encouraged and guided to establish and complete industry guidelines for Internet pop-up window information push services, urging Internet pop-up information push service providers to provide services in accordance with laws and regulations, and accept social oversight.

Article 8: The network information departments, together with the competent telecommunications departments, market supervision departments, and other relevant departments, are to establish and complete working mechanisms such as for collaborative supervision and management, and supervise and guide Internet pop-up information push service providers in providing services in accordance with laws and regulations.

Article 9: Where Internet pop-up window information push service providers violate these Provisions, the relevant departments such as those in charge of network information, telecommunications, and market supervision are to employ measures such as warnings, fines, suspension of pop-up window functions, and suspension of services within the scope of their duties in accordance with relevant laws and regulations.

Article 10: These Provisions take effect in January 2022.
