Finding the "Way" to Counter Telecom Fraud
From small street advertisements, to mobile phones inexplicably receiving all kinds of "sales" calls, to various network "traps" wrapped in "sugar coating", telecommunications network fraud is overwhelming and deeply resentful. The "devil" is growing wildly, forcing the NPC deputies to study the "Tao" of countermeasures more urgently.
At the Fifth Session of the 13th Provincial People's Congress, 12 deputies, including Deputies to the Provincial People's Congress, President of the Yiyang Lawyers Association, and Director of Hunan Tiansheng Law Firm, Xu Jian, jointly put forward the "Proposal on the Introduction of Our Province".
Data show that in the past two years, the public security organs in our province have jointly established more than 40,000 cases of telecommunications network fraud crimes, and telecommunications network fraud crimes have seriously affected the social order, economic stability and threat to the safety of people's property in our province. "People's congress deputies have put forward relevant crackdown suggestions every year, and the government and relevant departments have also taken active measures every year, but instead of effectively curbing telecommunications fraud, it has become more and more intense." During their work and investigations and visits, Xu Jian and other deputies found that the root cause of the high incidence of telecommunications fraud is that there is no special anti-telecommunications network fraud law, which has led to a variety of sentencing ranges, and there have been phenomena of different sentences and inconsistencies in the same case; the joint efforts of various departments to crack down on and control telecommunications network fraud are not strong, and the implementation of the liaison and communication coordination mechanism is not in place and smooth; the self-discipline and supervision of the network, finance, telecommunications, and other industries are lacking, and some even abandon supervision driven by narrow departmental interests. In addition, there are still problems such as lack of focus, lack of pertinence, failure to achieve full coverage, and low awareness of the masses.
Therefore, Xu Jian and other deputies suggested that the three departments of the Public Security And Procuratorial Law conscientiously study the issues of determining the facts of the crime of cracking down on telecommunications network fraud, the application of charges, the standards for sentencing, and the application of fines and penalties in accordance with the requirements of laws and regulations and in light of the actual conditions of law enforcement and justice in our province, and strive to effectively reduce differences in application and form a consensus; formulate guiding documents and issue typical cases on some issues concerning the application of law in the process of law enforcement and case handling, so as to provide reference for the people's courts, people's procuratorates, and public security organs at all levels to unify specific standards for the application of law. In terms of propaganda, we should highlight key groups and key areas, innovate ways, continuously improve the quality and effectiveness of propaganda and education work, and raise the people's awareness of preventing fraud and opposing fraud. People's congresses at all levels perform their statutory supervision duties in cracking down on telecommunications network violations and crimes, and in addition to traditional supervision methods, they must also innovate methods to promote all units to continuously improve the quality and efficiency of law enforcement and judicial and management work.

"Intellectual property rights define property rights for innovative activities, provide transaction specifications for innovative industries, and protect property rights for innovative achievements, it can be said that the degree of marketization, rule of law and internationalization of intellectual property rights is an important guarantee for the high-quality development of the economy of our province and the implementation of the strategic positioning of 'three highs and four new'." Zhong Zhipeng introduced that the current intellectual property protection system and level of our province do not match the current innovation strength of our province, and cannot support the strategic deployment of the development of related industries in our province. "At present, there is only one 2011 Hunan Provincial Patent Regulations in our province, and there are no local regulations in the field of copyright, trademark rights, geographical indications, new plant varieties, trade secrets, anti-unfair competition, anti-monopoly related to intellectual property rights, etc., which are no longer suitable for the current economic development situation."
"The RCEP, which went into effect this year, covers 15 countries in the Asia-Pacific region, has a population of 2.3 billion people, and a quarter of the world's trade volume, and will become the world's largest and most influential free trade agreement." Among them, the intellectual property chapter contains a total of 83 articles and two annexes to the transitional arrangement and technical assistance, which is the largest and longest chapter of the RCEP. In order to "fully dock with the new rules of RCEP economy and trade", it is necessary to comprehensively sort out and reshape the intellectual property protection system and legal system of our province to ensure the "high-level introduction and going out" of the province's economy.
Zhong Zhipeng said that the objective conditions for Hunan to formulate regulations on the protection of intellectual property rights have matured, with a higher-level legal foundation, policy foundation, organizational foundation and legislative practice basis, relevant departments have actively explored to promote legislation, the preliminary work has achieved phased results, and the "Hunan Provincial Intellectual Property Protection Regulations" should be included in the formal legislative review project as soon as possible to promote the implementation of this legislative project as soon as possible.
To this end, Zhong Zhipeng and 10 other deputies suggested improving the construction of mechanisms for intellectual property protection; establishing an intellectual property service, protection and rights protection system in the field of cross-border service trade; strengthening the administrative and judicial protection and coordination of intellectual property rights; and exploring diversified intellectual property dispute resolution mechanisms.
