Recently, Sam's Club received a fine issued by the Qingpu District Market Supervision Bureau for the following reasons: The parties sold and purchased a Spanish brand frozen mixed vegetable product in their offline Sam's Club without indicating the production date and shelf life, and some of the products have been sold, which violates the Food Safety Law and imposes a fine of 10,000 yuan.

According to the announcement of the administrative penalty decision, it was found that from October 30, 2021, the parties sold the brand "Members Mark" in their offline stores, and the batch was frozen mixed vegetable products on June 21, 2021. On November 6, 2021, when law enforcement officers conducted an on-site inspection, the production date and shelf life were not found on the packaging of the five above products.

It was found that the above-mentioned products were imported from Spain and purchased by the parties to XXX (China) Investment Co., Ltd., and the food labels of the products were made by Spanish manufacturers and printed on the product packaging. After the incident, the parties concerned took the initiative to remove and destroy the remaining 5 packs of the above-mentioned frozen vegetables without production date and shelf life.

The parties sold "Members Mark" frozen mixed vegetable products that did not indicate the production date and shelf life on the label in the Sam's Club Store (Qingpu Store) of the offline store, which violated the relevant provisions of the Food Safety Law of the People's Republic of China, and the penalties were as follows: 1. Confiscation of illegal gains of 19.7 yuan; 2. Fines of 10,000 yuan.

In addition, after investigation, since September 15, 2021, the parties concerned have sold products with the name of "Meiganbao assorted almonds (containing honey salt baked almonds, honey butter almonds, tiramisu flavored almonds, strawberry flavored almonds 1 packet each) in their offline stores", and the ingredients of "content per 100 grams of protein, fat and carbohydrates" in the food nutrition labels of the above products were marked separately, totaling 108 grams, 113.9 grams, 103.8 grams and 102.2 grams. Both exceed 100 grams, clearly marking errors.

It was found that the above products were imported from Korea and were procured by the parties to the importer, Shenzhen XXX Import & Export Co., Ltd., and the nutrition label was made by the Korean manufacturer and printed on the product packaging. The parties found that the food nutrition label of the above-mentioned products was incorrectly marked, and took the initiative to rectify the content of the above-mentioned food nutrition labels according to the latest test report provided by the manufacturer before the incident.

Although the wrong nutrition label violates the relevant provisions of the Food Safety Law of the People's Republic of China, the parties perform their obligations to inspect the incoming goods and decide not to punish the parties in accordance with the law.
