Borax belongs to the list of non-edible substances that may be illegally added in food (the first batch) listed in the toxic and harmful non-edible substances, which itself has a wide range of uses, such as detergents, cosmetics, insecticides, but its toxicity is high, too much borax is harmful to the human body, so it is prohibited to be added to food.

Defendant Chen X stored borax
The public security organs, together with the market supervision department, inspected the shops of Chen xxx and Wu xx, seized and seized 0.1 kg of white crystals, 5 kg of rice milk, 1 kg of pot side slices and 6 pot side pastes, and arrested the defendants Chen xx and Wu xx at the scene. After testing, the seized white crystals, rice milk, pot edge slices, and pot edge paste all contained borax components.

On February 24, 2021, the Meilie court held a public hearing to hear the case of defendants Chen xxx and Wu xx' production and sale of toxic and harmful food, and the public interest litigation prosecutor Meilie Procuratorate filed an attached civil public interest lawsuit against the two defendants.
After trial, the Meilie court held that the defendants Chen xxx and Wu xx deliberately mixed and sold borax, a toxic and harmful non-food raw material, into the pot side paste food they produced, and their acts constituted the crime of producing and selling toxic and harmful food. Defendants Chen xxx and Wu xx's behavior of producing and selling toxic or harmful food seriously infringed on the right to health of an unspecified group of people and harmed the public interest, and they should bear the responsibility of apologizing and paying compensation for their infringement.
The court finally ruled that defendants Chen xxx and Wu xx were sentenced to six months' imprisonment and fined 5,000 yuan for the crime of producing and selling poisonous and harmful food, and prohibited defendants Chen xxx and Wu xx from engaging in food production, sales and related occupations for three years from the date of completion of the criminal punishment or the date of parole.
At the same time, Chen X and Wu X, as defendants in the attached civil public interest lawsuit, paid compensation of 44,000 yuan and ordered them to apologize to the public in the public media at or above the municipal level.
