At present, the epidemic situation abroad continues to spread, Guangxi is located in the southern Xinjiang of the motherland, and the situation of border control and epidemic prevention and control is grim and complicated. However, there are still some lawless elements who have the mentality of luck and, with the purpose of illegally seeking benefits, take risks recklessly, and engage in illegal and criminal activities such as smuggling, drug trafficking, and smuggling, which seriously hinder the management of the state (border) border. On December 12, the Ningming County People's Court in Guangxi announced three typical cases of border-related crimes during the epidemic prevention and control period.
Case 1 Huang Moudeng and 19 other people organized and transported others to illegally cross the national border
From January 13 to March 21, 2020, defendant Huang Moudeng and 19 others organized and transported others to illegally cross the national border in order to obtain benefits and violate national laws and regulations on entry-exit administration. Among them, defendant Huang Moudeng organized others to smuggle across the border 91 people, Ou Mouze, Yang Mougang, and Cao Moutao transported others to smuggle across the national border, Fang Mouzhuang and Luo Moutao transported others to smuggle across the national border 10 people, Yang Moudang, Nong Mouming, and Su Mouqun transported others to smuggle across the border 24 people, Su Mouyi transported others to smuggle across the border 12 people, Lu Mousheng and Huang Mougan transported others to smuggle across the border 7 people, Feng Moucai and Nong Moufu transported others to smuggle across the border 16 people, Jiang Mouxun transported others to smuggle across the border 7 people, Ma Moucai, Fu Moubo transported 8 people who smuggled others across the border, Ou Mouguang transported 14 people who smuggled others across the border, and Li Moudi transported 5 people who smuggled others across the border.
The Ningming County People's Court ruled in accordance with law that defendant Huang Moudeng was sentenced to 12 years' imprisonment and fined 100,000 yuan and deprived of political rights for two years for the crime of organizing others to illegally cross the border; defendant Nong Mouming was sentenced to five years' imprisonment and fined 50,000 yuan for the crimes committed by transporting others across the border; the remaining 17 defendants were sentenced to fixed-term imprisonment ranging from three years and six months to one year and three months, and fined between 30,000 and 10,000 yuan, depending on the crimes committed.
Case 2 The crime of Deng Mouji and 10 others transporting others to smuggle across the border
From April 7 to April 9, 2020, Deng Mouji arranged and contacted Qin Mou, Qiu Mouqing and others to transport Illegal Vietnamese entering Vietnam to Vietnam or to Guangdong by bus. It was found that defendant Deng Mouji was involved in transporting 92 people, Qin was involved in transporting 34 people, Qiu Mouqing was involved in transporting 27 people, Luo Mouchao was involved in transporting 18 people, Li Mou was involved in transporting 15 people, Pan Moule was involved in transporting 13 people, Mu Mouhua was involved in transporting 6 people, and Nong Mouming and Lu Mouquan were involved in transporting 5 people.
Based on the facts, nature, circumstances, and degree of social harm of Deng Mouji and others, the Ningming County People's Court ruled in accordance with law: Defendant Deng Mouji was sentenced to eight years' imprisonment and fined 50,000 yuan for the crime of transporting others across the border illegally; defendant Qin X was sentenced to four years' imprisonment and fined 40,000 yuan for the crime of transporting others across the border; the remaining 8 defendants were sentenced to fixed-term imprisonment ranging from ten months to two years and six months, and fined between 10,000 yuan and 20,000 yuan; confiscated the mobile phone seized in the case and handed over to the state treasury.
Case 3 The crime of Shen Moufu and 14 other people transporting others to smuggle across the national border
From February 2020 to February 2021, Shen Moufu and 14 other defendants transported a total of 9 batches of illegally entered foreign personnel through the route from Ningming, Shangsi and other places to Nanning City to Shantou City, Guangdong Province, involving 89 illegal foreign arrivals.
After trial, the Ningming County People's Court held that Shen Moufu and 14 other defendants illegally transported others across the border, and their acts have all constituted the crime of illegally transporting others across the border.
Based on the facts, circumstances, and expressions of remorse of each defendant, the Ningming County People's Court convicted defendant Shen Moufu and 14 other defendants of the crime of transporting others across the border illegally, and sentenced defendant Shen to four years and six months in prison and a fine of 40,000 yuan; sentenced defendant Liang Fumin to four years' imprisonment and a fine of 40,000 yuan; and the remaining defendants sentenced them to fixed-term imprisonment ranging from eight months to two years and six months, and fined them ranging from 5,000 yuan to 30,000 yuan Confiscated 21,000 yuan of the 9 vehicles seized by the defendant and the illegal gains of the defendant Liang Moumin, and continued to recover 7,000 yuan of the illegal gains of the defendant Liang Moumin.
