1. What taxes are involved in individual rental housing?

When it comes to individual renting a house, many people's first reaction is to pay personal income tax, because it is salary and other income, additional. It is true that personal income tax must be paid, but in fact, there are many taxes involved.

Individual rental real estate mainly involves value-added tax and its surcharge, urban construction tax, real estate tax, land use tax, stamp duty, and personal income tax.

Some taxes are exempt in some cases, in general, your monthly rent is below 150,000, value-added tax and its surcharges, urban construction taxes, etc. are exempt, which is also a big discount. In this way, the average personal rental is rarely more than 150,000.

How did this 150,000 dash come about?

The main basis is the exemption of VAT.

Announcement of the State Administration of Taxation on the Exemption of Small-scale Taxpayers from VAT Collection and Management: Other individuals referred to in Article 9 of the Detailed Rules for the Implementation of the Interim Regulations of the People's Republic of China on Value Added Tax who lease real estate in the form of a one-time rent collection may be apportioned equally during the corresponding lease period, and if the monthly rental income after apportionment does not exceed 150,000 yuan, it is exempt from VAT.

In addition, it should be emphasized here that there is still a difference between personal housing and shop rental. After all, one is a personal behavior, and the other is a business behavior. What's the difference? Compare the following two tables:

2. So how is it calculated?

How much to pay, let's do the math. Let's take the most common ordinary housing below 150,000 to calculate, shops 150,000 to calculate, because there are very few individuals more than 150,000.

(1) Ordinary housing, monthly rent of 6000

(1) VAT = 0,

Real estate lease tax rate 9%

The monthly rent is exchanged for income excluding taxes

6000÷(1+9%)=5504.59

Less than 150,000, free.

(2) Urban construction, education fee surcharge, local education fee surcharge are exempted, these are dependent on the value-added tax, the value-added tax is 0, these are naturally 0.

(3) Property tax

(Based on rental income from the rental of the property, the tax rate is 12%.) From 1 January 2001, the property tax levied at a rate of 4% can be temporarily reduced for residential use in residential housing rented by individuals at market prices. = (Revenue - VAT paid) * 4%/2

=6000*4%/2=120

(4) Land use tax = 0, exempt.

(5) Stamp duty = 0, free.

(6) Individual income tax shall be levied on a case-by-case basis

Income from property lease shall be less than 800 yuan for each income of not more than 4,000 yuan, and for those with more than 4,000 yuan, 20% of the expenses shall be deducted, and the balance shall be the taxable income.

(Income - VAT paid - taxes and fees - repair costs)

=6000-0-120-0

=5880>4000

So, personal income tax

=5880*(1-20%)*10%

=470.4

Total tax paid: 470.4 (individual tax) + 120 (property tax) = 590.4

(2) Shops, monthly rent 50,000, 20 square meters

(1) Value-added tax, urban construction tax, education fee surcharge, and local education surcharge are exempted

(2) Property tax

= (Revenue - VAT paid)*12%/2

=50000*12%/2=3000

(3) Land use tax

Annual tax per square meter of land:

1.5 yuan to 30 yuan in large cities;

1.2 yuan to 24 yuan in medium-sized cities;

0.9 yuan to 18 yuan in small cities;

County seats, organized towns, industrial and mining areas 0.6 yuan to 12 yuan.

Suppose it is a medium-sized city of 24 yuan

= Annual tax per square meter of land * Area / 2

24*20/2=240

(4) Stamp duty

50000*0.001*2=25

(5) Personal income tax

50000-3000-240-25-0=46735>4000

46735*(1-20%)*20%=7477.6

Total tax paid: 7477.6 (individual tax) + 3000 (real estate tax) + 240 (land use tax) + 25 (stamp duty) = 10742.6

From the calculation, it can be seen that personal rental is basically personal tax and real estate tax are inevitable, and most of them are also these two taxes. Shops also involve a small amount of land use tax and stamp duty.
