On August 18, 2021, law enforcement officers conducted an on-site inspection of the HeungKong Grand Garden Cosmetics Wholesale Market. On the shelves of the parties' business premises, the undocumented cosmetics "Cocoa Soft Water Light Repair Hair Mask", "Slime Erect Shaping Hair Mud" and "Gao Rou Xiang Fen Hair Mud" were issued on the shelves of the parties' business premises, and the parties could not provide the domestic non-special purpose cosmetics filing certificate, and after investigation, the above cosmetics had not yet obtained the "Domestic Non-Special Purpose Cosmetics Filing Certificate".
The cosmetics operated by the parties have not obtained the filing certificate of domestic non-special-purpose cosmetics, which does not comply with the provisions of Article 17 of the Regulations on the Supervision and Administration of Cosmetics.
According to Article 61, Paragraph 1(1) of the Regulations on the Supervision and Administration of Cosmetics, the penalties imposed on the parties are as follows:
1. Confiscate 3 bottles of "Coix Soft Water Light Repair Hair Mask", 12 bottles of "Shi Fiber Erect Shaping Hair Mud", and 24 bottles of "Gao Rou Xiang Fen Hair Mud";
2. Confiscation of RMB 3,363 for illegal gains;
3. A fine of RMB 10,000.
The total amount of the above fines and forfeitures is 13,363 yuan.
Within 15 days of receiving the penalty decision, the fine and forfeiture shall be paid to the bank that opened the special financial account of Xiamen City.
