Announcement on the selection of people's assessors in Jinshan District

In order to implement judicial democracy, promote judicial fairness, and ensure the people's orderly participation in the judiciary, on the basis of the provisions of the "People's Assessors Law of the People's Republic of China", the "Measures for the Selection of People's Assessors", and the "Shanghai Municipal Implementation Measures for the Selection of People's Assessors", the following announcement is hereby made on the selection of people's assessors in Jinshan District:

One

Elective seats

A total of 350 people's assessors were selected in Jinshan District this time, of which 280 were selected through random selection; A quota of 70 people's assessors is to be selected through individual applications and organizational recommendations.

Two

Qualifications for election

1

(1) The requirements for serving as a people's assessor:

1. Support the Constitution of the People's Republic of China;

2. Be at least 28 years old;

3. Law-abiding, good conduct, fairness and decency;

4. Have the physical condition to perform their duties normally;

Serving as people's assessors shall generally have a high school education or higher.

(2) The following persons cannot serve as people's assessors:

1. Constituent members of the Standing Committee of the People's Congress, and staff of the Supervision Commission, the People's Courts, the People's Procuratorates, the Public Security Organs, the State Security Organs, and the Judicial-Administrative Organs;

2. Lawyers, notaries, arbitrators, and grassroots legal service workers;

3. Other persons who are not suitable to serve as people's assessors due to their duties.

(3) In any of the following circumstances, they must not serve as people's assessors:

1. Those who have received criminal punishment;

2. Those who have been dismissed from public office;

3. The lawyer's or notary's practice certificate has been revoked;

4. Being included in the list of judgment defaulters;

5. Those who have been removed from the position of people's assessor because they have been disciplined;

6. Other serious violations of law or discipline that might impact judicial credibility.

Three

Manner of election

The selection is conducted through a combination of random selection, individual application and organizational recommendation.

The Jinshan District Bureau of Justice, in conjunction with the Jinshan District People's Court and the Jinshan Public Security Bureau, is to randomly select from the list of permanent residents in the district who meet the requirements for the selection of people's assessors.

Where individuals apply to serve as people's assessors, they should submit proof of identity (proof of residence for the floating population is required), proof of academic qualifications, and other written materials, and complete the "People's Assessor Candidate Registration Form".

Where organizations recommend people to serve as people's assessors, the recommended person's unit, basic-level mass autonomous organizations or people's organizations for the place of household registration or habitual residence, after obtaining their consent, submit written materials such as the recommender's resume, proof of identity (proof of residence for the floating population is required), proof of academic qualifications, and fill out the "Jinshan District People's Assessor Candidate Registration Form".

Eligibility

The Jinshan District Bureau of Justice, in conjunction with the Jinshan District People's Court and the Jinshan Public Security Bureau, is to conduct a qualification review in accordance with the provisions of articles 5, 6, 7, and 13 of the "People's Assessors Law of the People's Republic of China".

Appointment announcement

The Jinshan District Bureau of Justice, in conjunction with the Jinshan District People's Court and the Jinshan Public Security Bureau, is to announce to the public the list of people's assessors to be appointed, and the publicity period is five working days.

The candidates for people's assessors to be determined after public announcement are to be appointed by the president of the Jinshan District People's Court at the request of the Standing Committee of the Jinshan District People's Congress.

Six

Oath of office

After people's assessors are appointed by the Standing Committee of the people's congress, they shall publicly take the oath of office. The people's assessors take the oath as follows: I am a people's assessor of the People's Republic of China, and I swear: to be loyal to the country, to the people, to the Constitution and laws, to participate in trial activities in accordance with the law, to faithfully perform trial duties, to be honest and honest, to make impartial judgments, and to safeguard social fairness and justice!

Treatment subsidy

During the period when people's assessors participate in trial activities, their units must not deduct or indirectly deduct their salaries, bonuses, or other benefits.

The people's courts are to give subsidies in accordance with relevant provisions on the basis of actual working days for each people's assessor participating in the trial of a case.

The people's courts are to give subsidies in accordance with relevant provisions for people's assessors' expenses such as transportation and meals incurred as a result of participating in trial activities.
