Announcement on Inspection and Quarantine Requirements for Wild Aquatic Products Imported into Cambodia

In accordance with the relevant laws and regulations of the mainland and the regulations of the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Forestry and Fisheries of the Kingdom of Cambodia on the inspection and quarantine and veterinary hygiene requirements of wild aquatic products exported from Cambodia to China, from now on, the import of Cambodian wild aquatic products that meet the following relevant requirements is allowed:

1. Basis for inspection and quarantine

(1) Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country, Regulations for the Implementation of the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country, Law of the People's Republic of China on Import and Export Commodity Inspection, Regulations for the Implementation of the Law of the People's Republic of China on Import and Export Commodity Inspection, Food Safety Law of the People's Republic of China and Regulations for the Implementation of the Food Safety Law of the People's Republic of China.

(2) Measures of the People's Republic of China on the Administration of Import and Export Food Safety and the Regulations of the People's Republic of China on the Registration and Administration of Overseas Producers of Imported Food.

(3) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Forestry and Fisheries of the Kingdom of Cambodia on the Inspection and Quarantine and Veterinary Hygiene Requirements for Wild Aquatic Products Exported from Cambodia to China.

2. Scope of imported products

Permitted export of aquatic products to China refers to wild aquatic animal products and their products for human consumption, algae and other marine plant products and their products, excluding species, live aquatic animals and aquatic animal and plant propagation materials listed in the appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the List of Wild Animals under National Key Protection.

Third, the requirements of production enterprises

Manufacturers of wild aquatic products exported to China (including processing enterprises, fishing vessels, transport vessels, processing vessels, and independent cold storage) should be officially approved and effectively supervised by Cambodia. The sanitary conditions of production enterprises shall meet the requirements of relevant veterinary health and public health regulations in China and Cambodia.

According to the Food Safety Law of the People's Republic of China and the Regulations for the Implementation of the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country, manufacturers exporting wild aquatic products to China shall be recommended for registration by the Ministry of Agriculture, Forestry and Fisheries of the Kingdom of Cambodia (hereinafter referred to as "Cambodia") to the General Administration of Customs of the People's Republic of China (hereinafter referred to as "China"). If it is not registered, it shall not be exported to China.

4. Requirements for imported products

(a) Fishing lawfully in Cambodia's national or international waters.

(2) Neither raw materials nor products are in the area covered by the following issues:

1. Aquatic animal diseases related to products of this Protocol listed in the List of Quarantine Diseases Imported from the People's Republic of China and required by the World Organisation for Animal Health (WOAH) occur in Cambodia, causing wild aquatic products exported to China to be infected or likely to be infected.

2. Any major food safety incident in Cambodia has affected or may affect wild aquatic products exported to China.

3. Wild aquatic products that Cambodia has exported or intends to export to China seriously violates the laws and regulations of China and Cambodia and the provisions of this Protocol.

4. Major public health incidents occur in production enterprises, such as employees infected with major infectious diseases such as new coronary pneumonia, which have contaminated or may contaminate wild aquatic products exported to China and their packaging and transportation tools.

(3) Failing to directly or indirectly use drugs or additives prohibited by both parties, and using drugs or additives restricted or permitted by both parties in accordance with regulations; After inspection by the competent authorities, no pathogenic microorganisms, toxic and harmful substances and foreign substances listed in the laws and regulations of China and Cambodia were found.

(4) All wild aquatic products exported to China have been quarantined and inspected by the competent authorities and are hygienic, safe and suitable for human consumption, and no pathological indications of infectious and parasitic diseases have been found, and no aquatic animal diseases listed in the List of Quarantine Diseases Imported into China and notified by the World Organisation for Animal Health (WOAH) have been found.

(5) The whole process of fishing, processing, packaging, storage, transportation, transit and export shall meet the relevant health requirements and traceability requirements of both sides. At the same time, it meets the relevant safety and health requirements of the cold chain.

(6) During the epidemic of new crown pneumonia, enterprises should carry out epidemic prevention and control in accordance with the latest guidelines on new crown pneumonia and food safety issued by the Food and Agriculture Organization of the United Nations (FAO) and other international organizations, regularly carry out relevant epidemic disease testing for employees, formulate necessary aquatic product safety prevention and control measures, and ensure the effective implementation of various prevention and control measures in the whole process of raw materials, processing, packaging, storage, transportation, etc., to prevent export products and packaging from being contaminated by the new crown virus.

5. Certificate requirements

Each container of wild aquatic products exported by Cambodia to China shall be accompanied by at least one original veterinary (hygiene) certificate certifying that the batch of products complies with the veterinary and public health laws and regulations of China and Cambodia and the relevant provisions of this Protocol. The Cambodian side shall completely fill in the information of the production enterprises involved in the whole process from fishing, processing, packaging, storage, transportation, transit and export on the veterinary (health) certificate, including the names and registration numbers of processing plants, fishing vessels, transport vessels, processing ships and independent cold storage, etc., and shall not omit the information of the production enterprises involved in any of the above links.

The certificate should be printed in at least Chinese and English (English is required when completing the certificate). The format and content of the certificate must be approved by both parties in advance. The Cambodian side shall promptly provide the sample certificate, the seal of the official issuing authority and the handwriting of the signatory official to the Chinese side for the record. If there are changes in the content and format of the sample certificate, the seal of the official issuing authority and the handwriting of the signing officer, the Cambodian side shall file it with the Chinese side at least one month before the effective date.

6. Packaging and Labeling Requirements

Wild aquatic products exported to China should have outer packaging and separate inner packaging. The inner and outer packaging should be a new material that meets international health standards to meet the requirements of preventing pollution by external factors.

The inner and outer packaging should be affixed with Chinese and English or Chinese and Cambodian labels, including: trade name and scientific name, specification, production date, shelf life, batch number, storage conditions, production method (wild fishing), name and number of production enterprise, production area and production enterprise address (specific to the state/province/city), destination (marked as the People's Republic of China).

For wild aquatic products exported to China in pre-packaged form, the pre-packaged Chinese labels should meet the labeling requirements for pre-packaged foods imported from China.

7. Other requirements

China Customs implements import inspection and quarantine of wild aquatic products exported to China.

Non-conforming products will be returned, destroyed or otherwise disposed of in accordance with Chinese laws and regulations. For production enterprises with serious problems or repeated unqualified problems, China may take measures such as strengthening inspection and quarantine or suspending imports.
