In order to conscientiously implement the spirit of the important instructions of Procurator General Zhang Jun to "carry out the compliance reform of the enterprises involved in the case, the higher goal is to actively create a law-based business environment and promote the standardized development of enterprises" by handling each case well, to ensure that the procuratorial organs can actively perform their duties in enterprise-related cases, provide a legal compliance rectification platform for enterprises, and form the business philosophy of "safe production is more important than Taishan", on April 15, 2022, the People's Procuratorate of Yakeshi City, Inner Mongolia Autonomous Region, held a public hearing on a case involving enterprise compliance review. The meeting invited a total of nine representatives to the hearing, including deputies to the Yakeshi Municipal People's Congress, members of the Chinese People's Political Consultative Conference, people's supervisors, and members of the third-party supervision and evaluation team, and Li Malian, chief of the coal mine safety supervision and management section of the Hulunbuir Emergency Management Bureau, was specially invited to participate as the representative of the hearing, and Wulan, head of the second procuratorial department of the Hulunbuir City People's Procuratorate, gave on-site guidance.
Carrying out enterprise compliance reform is conducive to giving play to procuratorial functions, increasing the protection of the non-public ownership economy, and dialectically implementing judicial policies such as "less arrest, cautious prosecution and prudent detention" for enterprises and personnel involved in the case under the optimization of the business environment based on the rule of law.
At this hearing, the procurator in charge explained the purpose and significance of the enterprise compliance review to the hearing representatives and the personnel involved in the case, explained the specific procedures and measures for the compliance rectification of the enterprise involved in the case, and conveyed the assessment opinions of the third-party supervision and evaluation team on the case. Wu Lan, head of the Second Procuratorial Department of the Hulunbuir Municipal People's Procuratorate, issued case guidance on the overall process of enterprise compliance, the determination of the facts of the whole case and the results of the case handling, and the representatives of the enterprises involved in the case and the criminal suspects also truthfully expressed their attitude of admitting guilt and repentance. Finally, the hearing officer reviewed the overall situation of the case, highly recognized the procuratorial organs' enterprise compliance review work, and believed that the two levels of the Hulunbuir City procuratorial organs simultaneously promoted the enterprise compliance reform, actively innovated and performed their duties, optimized the local legal business environment with new ideas and new measures, and unanimously agreed with the procuratorial organs' opinions on the proposed handling of the case.
As the first enterprise compliance review case in Hulunbuir City, the Yakeshi Municipal People's Procuratorate innovated its working methods, gave full play to the advantages of procuratorial integration, and promoted the smooth progress of enterprise compliance review through public hearings.
On the one hand, relying on the coordination and guidance of the higher-level people's procuratorate, Qin Hu, chief procurator of the Hulunbuir Municipal People's Procuratorate, reviewed the enterprise compliance case file materials during the investigation of the Yakeshi Municipal People's Procuratorate and put forward targeted guidance. The corresponding departments of the procuratorates at higher levels guide the whole case and actively ask the procuratorates of the autonomous regions for instructions and reports, and the coordinated efforts of the procuratorates at the two levels are conducive to the innovation of the system and mechanism of the grass-roots procuratorates, and the new field of getting rid of the "waiting to rely on" thinking, providing a solid backing for the grass-roots procuratorates to innovate their work methods.
On the other hand, strengthening horizontal convergence and collaboration, inviting representatives of various industries to express their opinions, while reflecting the transparency of case review and promoting the openness of procuratorial affairs, has effectively enhanced the credibility and influence of procuratorial organs.
After this hearing, the Yakeshi Municipal People's Procuratorate submitted the facts, evidence, and comments of the whole case to the procuratorial committee for discussion and study and made a decision on handling. In the next step, the Yakeshi Municipal People's Procuratorate will continue to implement the people-centered judicial concept, with the service of "six stability" and "six guarantees" as the driving force, will promote the further deepening of the compliance review of enterprises, promote the healthy development of market entities, create a good business environment based on the rule of law, and contribute greater procuratorial strength to the construction of the rule of law in Yakeshi City.
