"Consumption" and "machinery" products have developed so far, due to the wide variety of products, different sizes of enterprises, and low entry thresholds, resulting in uneven product quality, more violations of laws and regulations, such as the media exposure of a certain enterprise in Zhangzhou, Fujian Province, the production of "Evrine multi-effect special bacteriostatic cream", illegal over-addition of powerful glucocorticoid clobetasol, causing many baby big-headed doll incidents, causing great social impact.

Huang Fuhong, member of the Central Committee of the Chinese People's and Workers' Party, member of the Yangzhou Municipal Committee of the Chinese People's Political Consultative Conference, and chief pharmacist of the Affiliated Hospital of Yangzhou University, pointed out that the current problems of "consumption" and "machinery" products are mainly manifested in the following aspects:

1. The phenomenon of illegal drug addition is serious. Mainly manifested in the illegal addition of glucocorticoids such as dexamethasone, clobetasol, prednisone, antibiotics such as metronidazole, chlortetracycline, erythromycin, chloramphenicol, etc., antifungal drugs such as miconazole, ketoconazole, etc. According to the test results released by the relevant departments, in December 2020, the China Institute of Food and Drug Control screened 41 batches of infant eczema products sold online. The results showed that 4 batches of hormones were detected in 7 batches of "elimination" products, and the detection rate was 57.1%. Somewhere randomly checked 8 kinds of baby eczema cream known as pure Chinese medicine without additives, 6 kinds of glucocorticoids were added, and some claimed to have good effects on acne and skin ringworm would illegally add antibacterial drugs and antifungal drugs.

2, label instructions have many problems. It is mainly manifested in deliberate confusion with drugs, product names similar to or similar to drugs, labeling disease names and therapeutic terms, and labeling the efficacy of specific parts, such as express or implied therapeutic effects on human eyes, feet, nails, armpits, scalp, hair and nasal mucosa. Some are indicated to be able to treat vaginitis, cervicitis, venereal diseases, burns and frostbite.

3. The product qualification rate is low. Mainly manifested in the product is contaminated by microorganisms, a municipality directly under the central government sampling 93 products, the bacterial content limit pass rate is only 68%, some detected Pseudomonas aeruginosa, E. coli and other pathogenic bacteria; in the market random inspection of anti ( inhibition) bacteria wash antibacterial or bactericidal effect re-inspection found that 26.32% of the sample anti ( inhibition) bacterial effect is lower than the specification requirements. Sampling of the anti-bacteriostatic effect of anti-bacterial lotion sold in supermarkets and pharmacies showed that the killing rate of E. coli and Staphylococcus aureus was 81.8%, and the pass rate of candida albicans was only 57.1%.

4. The pricing of "elimination" and "machinery" products is abnormally high, and the phenomenon of product sales with gold is common. In pharmacies within and around medical institutions, doctors designate pharmacies to purchase products with the size of "consumption" and "equipment", and the transfer of benefits is obvious, which wastes a lot of funds and increases the burden on patients.

In its proposal, the Central Committee of the Peasants' and Workers' Party proposes:

1. Revise relevant laws and regulations as soon as possible. The "Disinfection Management Measures" stipulates that the label instructions and publicity content of disinfection products are untrue, express or implied to the therapeutic effect of the disease, etc., and order correction within a time limit and may be fined up to 5,000 yuan. Once some enterprises are found to have problems in product quality or management, fines of several thousand yuan do not need to hurt their bones and bones, and they cannot achieve the purpose of cracking down on illegal activities and deterring crime. It is proposed to confiscate illegal income and impose a fine of multiples to achieve deterrence. Increase the definition of "counterfeit disinfection products" and stipulate corresponding penalties for illegal acts of producing and selling counterfeit disinfection products, so as to improve legal provisions, punish illegal acts, and maintain the market order of disinfection products and the legitimate rights and interests of consumers.

2. Improve relevant laws and regulations. According to the provisions of Article 1(1) of the Circular of the Ministry of Health on Adjusting the Scope of Supervision and Licensing of Disinfection Products (Health Supervision and Supervision [2005] No. 208), products with anti-virus or anti-bacterial functions that are dedicated to human feet, eyes, nails, armpits, scalps, hair, nasal mucosa and other special parts are no longer classified as disinfection products (that is, non-disinfectant products), that is, they no longer belong to the scope of responsibility and management of the health administrative department. However, for the illegal acts of such non-disinfection products marked with the relevant license numbers of disinfection products, there is no corresponding penalty, thus forming a situation in which such products are not supervised. It is recommended to formulate corresponding penalties as soon as possible to change the current situation that such products are not supervised.

3. Increase market sampling and improve testing capabilities. Due to the lack of relevant testing technology at the grass-roots level, it is difficult to find illegal additions, it is recommended to establish relevant mechanisms to improve the rate of grass-roots inspection, while increasing testing items, increasing penalties for operators and enterprises that detect illegal additions of glucocorticoids, antibacterial drugs, antifungal drugs, and increasing the illegal costs of operators and production enterprises.

4. Increase the intensity of network supervision. In the "Internet +" era, the network brings convenience to people's production and life, but also provides convenience for illegal acts, Taobao, Tmall, Jingdong and other large online shopping platforms have also appeared a large number of illegal disinfection products, relying solely on grass-roots health supervision agencies to investigate and deal with complaints and reports, with little effect. It is recommended that the competent health and family planning administrative departments send letters to large online shopping platform companies to assist in handling illegal disinfection products sold on the Internet, and online shopping platforms can monitor disinfection products that exaggerate publicity and impersonate drugs through technical means, and remove products from the shelves, deduct points from online stores, and even close the stores.

5. Include the sale of "consumption" and "machinery" products with gold into commercial bribery, and at the same time improve the pricing mechanism of "consumption" and "machinery" products, and reduce the operational space for gold sales.
