Identification and management of inheritors

Article 1: These Measures are formulated in accordance with the "Law of the People's Republic of China on Intangible Cultural Heritage" and the "Regulations on the Protection of Intangible Cultural Heritage of Yunnan Province", with reference to the "Measures for the Identification and Management of Representative Inheritors of Intangible Cultural Heritage at the National Level" and other relevant laws and regulations, in order to inherit and carry forward the excellent traditional Chinese culture, effectively protect and inherit intangible cultural heritage, and encourage and support representative inheritors of intangible cultural heritage at the provincial level to carry out inheritance activities.

Article 2: "Representative inheritors of intangible cultural heritage at the provincial level" as used in these Measures refers to inheritors who have been identified by the competent departments for culture and tourism at the provincial level, undertake the responsibility for the inheritance of representative items of intangible cultural heritage at the provincial level or above, are representative in a specific field, and have a relatively large influence in a certain area.

Article 3: The identification and management of representative inheritors of intangible cultural heritage at the provincial level shall be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, persist in taking the people as the center, carry forward the core socialist values, protect and inherit intangible cultural heritage, and promote the creative transformation and innovative development of China's outstanding traditional culture.

Article 4: The identification and management of representative inheritors of intangible cultural heritage at the provincial level shall be based on improving the inheritance system of intangible cultural heritage, enhancing the viability of intangible cultural heritage, respecting the subject status and rights of inheritors, and paying attention to the sense of identity of communities and groups.

Article 5: Representative inheritors of intangible cultural heritage at the provincial level shall temper their character of loyalty, persistence, and simplicity, enhance their sense of mission and responsibility, increase their ability to inherit and practice, abide by the Constitution and laws and regulations when carrying out activities such as inheritance and dissemination, abide by social morality, adhere to a correct view of history, the state, the nation, and culture, cast a solid sense of the Chinese national community, and must not use intangible cultural heritage in ways such as distortion or derogation.

Article 6: Provincial-level departments in charge of culture and tourism generally carry out a number of provincial-level intangible cultural heritage representative inheritors every three to five years.

Article 7: The identification of representative inheritors of intangible cultural heritage at the provincial level shall adhere to the principles of openness, fairness and impartiality, and strictly perform procedures such as declaration, review, review, publicity, approval, and publication.

Article 8: Chinese citizens who meet the following requirements may apply for or be recommended as representative inheritors of intangible cultural heritage at the provincial level:

(1) Patriotic and dedicated, discipline-abiding and law-abiding, virtuous and artistic;

(2) Residents of this province or residents of the province who have long resided or worked in areas where representative items of intangible cultural heritage at the provincial level or above are circulating, and have been identified as representative inheritors at the state (city) level of the project;

(3) Engage in the practice of inheriting the intangible cultural heritage for a long time, master the knowledge and core skills of the representative projects of the intangible cultural heritage at or above the provincial level that they have inherited, have recognized representativeness in the field in which the project is located, and have a greater influence in a certain region;

(4) Play an important role in the inheritance of this intangible cultural heritage, actively carry out inheritance activities, and cultivate successor talents.

Persons engaged in the collection, collation and research of intangible cultural heritage materials must not be identified as representative inheritors of intangible cultural heritage at the provincial level.

Article 9: Where citizens submit an application for representative inheritors of intangible cultural heritage at the provincial level, they shall truthfully submit the following materials to the competent department for culture and tourism at the location of the representative project of intangible cultural heritage at the provincial level:

(1) Basic information such as the applicant's name, ethnicity, time of employment, and time of being identified as a representative inheritor of intangible cultural heritage at the state (city) level;

(2) The applicant's lineage or teacher lineage, learning and practical experience;

(3) The knowledge of intangible cultural heritage and the core skills, achievements and relevant supporting materials possessed by the applicant;

(4) Circumstances such as the applicant's teaching of apprenticeships and art transmission, participation in social welfare activities;

(5) The applicant's possession of relevant physical objects and materials for the project;

(6) A statement that the applicant voluntarily engages in intangible cultural heritage inheritance activities and performs the relevant obligations of representative inheritors;

(7) Other materials that are helpful in illustrating the representativeness and influence of the applicant.

Where the project protection unit is a provincial unit, it may, through its competent unit, recommend representative inheritors of provincial intangible cultural heritage to the provincial-level department of culture and tourism, and the recommended materials shall include the contents of the preceding paragraph.

Article 10: After the competent department for culture and tourism of the applicant's locality receives the application materials or recommended materials, it shall organize experts to conduct a review and report them step by step.

After receiving the above-mentioned materials, the competent departments for culture and tourism at the state (city) level shall organize a review, put forward recommended candidates and audit opinions, and submit them to the provincial-level competent department of culture and tourism together with the declaration materials and audit opinions.

Article 11: The provincial-level competent departments for culture and tourism are to conduct a review of the application materials or recommendation materials received. Those who meet the requirements shall enter the review procedure; if they do not meet the requirements, return the materials and explain the reasons.

Article 12: Provincial-level competent departments for culture and tourism are to organize expert review groups and review committees to conduct preliminary evaluations and deliberations on candidates recommended for identification as representative inheritors of intangible cultural heritage at the provincial level. According to the needs, on-site defense sessions can be arranged. The expert review team puts forward the opinions of the preliminary assessment candidates, and the review committee deliberates on the preliminary assessment candidates and proposes the recommended candidates for the representative inheritors of the provincial intangible cultural heritage.

Article 13: The provincial-level competent departments for culture and tourism shall announce to the public the recommended candidates for representative inheritors of intangible cultural heritage at the provincial level proposed by the review and adjudication committee, and the publicity period is 20 days.

Article 14: Where citizens, legal persons, or other organizations have objections to the recommendation of representative inheritors of intangible cultural heritage at the provincial level, they may submit them to the provincial-level competent departments for culture and tourism in writing during the period of publicity.

Article 15: The provincial-level competent departments for culture and tourism are to examine and approve the list of representative inheritors of provincial-level intangible cultural heritage on the basis of the deliberation opinions of the review committee and the results of the publicity, and publish them.

Article 16: Provincial-level departments in charge of culture and tourism shall establish archives of representative inheritors of intangible cultural heritage at the provincial level, and promptly update relevant information. The content of the archives mainly includes the basic information of the inheritors, participation in learning and training, the development of inheritance activities, and participation in social welfare activities.

Article 17: The competent departments for culture and tourism at all levels shall, on the basis of actual conditions, employ the following measures to support representative inheritors of intangible cultural heritage at the provincial level in carrying out activities such as inheritance and dissemination:

(1) Providing necessary places for inheritance;

(2) Provide necessary funds to fund their activities such as apprenticeship, art transmission, and exchanges;

(3) Guide and support them in carrying out activities such as recording, collating, archiving, researching, publishing, exhibitions, and performances of intangible cultural heritage;

(4) Support their participation in study and training;

(5) Support their participation in social welfare activities;

(6) Other measures to support them in carrying out activities such as inheritance and dissemination.

Where representative inheritors have real difficulties in their daily lives, the local people's government shall appropriately give living allowances, and encourage social organizations and individuals to provide financial support to ensure their basic living needs.

Article 18: Representative inheritors of intangible cultural heritage at the provincial level bear the following obligations:

(1) Carry out inheritance activities and cultivate successor talents;

(2) Properly preserve relevant physical objects and materials;

(3) Cooperate with the competent departments of culture and tourism and other relevant departments in conducting investigations, records and studies of intangible cultural heritage;

(4) Participate in activities such as public interest publicity on intangible cultural heritage;

(5) Accept the guidance, management and assessment of the competent departments of culture and tourism; and submit reports on the inheritance status to the competent departments of culture and tourism of the prefecture (city) where they are located on a regular basis every year;

(6) Other obligations related to the protection and inheritance of intangible cultural heritage.

Article 19: The competent departments for culture and tourism at the prefecture (city) level shall, before April 30 of each year, assess the inheritance of representative inheritors of intangible cultural heritage at the provincial level in the previous year, and form an assessment report to the provincial-level competent department for culture and tourism for the record. Representative inheritors of intangible cultural heritage at the provincial level shall cooperate in making a report on the status of inheritance. The assessment results are the main basis for enjoying the qualifications of representative inheritors of intangible cultural heritage at the provincial level and for granting subsidies for transmission.

Article 20: The provincial-level competent departments for culture and tourism may make declarations in accordance with relevant national and provincial provisions, and upon approval, commend and reward representative inheritors of provincial-level intangible cultural heritage who have made outstanding contributions, and the provincial-level competent departments for culture and tourism shall, in accordance with relevant provisions, work together with relevant departments to commend and reward representative inheritors of provincial-level intangible cultural heritage who have made outstanding contributions.

Article 21: In any of the following circumstances, upon verification by the competent department for culture and tourism of the prefecture (city), report to the competent department of culture and tourism at the provincial level for approval, revoke their qualifications as representative inheritors of intangible cultural heritage at the provincial level, and make a public announcement:

(1) Losing the nationality of the People's Republic of China;

(2) Employing improper means such as fraud to obtain qualifications;

(3) Failing to perform obligations without a legitimate reason, and failing to pass the cumulative assessment twice;

(4) Violating laws and regulations or violating social morality, causing a major negative social impact;

(5) Circumstances where voluntary renunciation or other circumstances shall revoke the qualifications of representative inheritors of intangible cultural heritage at the provincial level.

Article 22: Where a representative inheritor of intangible cultural heritage at the provincial level dies, the competent department for culture and tourism at the prefecture (city) level shall promptly report to the provincial-level competent department for culture and tourism, and at the same time do a good job of improving and managing the inheritors' archives, and promptly organize and carry out publicity reports such as the deeds of the inheritors.

Article 23: The competent departments for culture and tourism of prefectures (cities) may refer to these Measures to formulate measures for the identification and management of representative inheritors of intangible cultural heritage within their respective administrative regions.

Article 24: The provincial-level competent departments for culture and tourism are responsible for the interpretation of these Measures.

Article 25: These Measures shall come into force on the date of their issuance. The measures for the identification and management of representative inheritors of intangible cultural heritage projects in Yunnan Province (for trial implementation) issued by the Department of Culture and Tourism of Yunnan Province on October 20, 2010 shall be abolished at the same time.
