In November 2017, Kelly, a Texas veteran, broke into a church with a rifle and strafed, killing 26 people, the youngest of whom was only 18 months old. The latest verdict was issued, and the US Air Force had to compensate the families of the victims for not uploading Kelly's domestic violence history to the federal database, resulting in his successful purchase of guns through background checks.

According to CBS, Kelly served in the Air Force from 2010 to 2014, and records show he served as a logistician at Holloman Air Force Base in New Mexico. He was sentenced to 12 months in prison in 2012 after beating his wife and even beating his adopted son to intracranial hemorrhage, before being demoted and expelled from the military.

Federal law prohibits expulsionees from buying guns, and Texas and federal laws prohibit people with a history of domestic violence from owning guns, but the Air Force military did not upload his domestic violence records to the database of the National Crime Information Center, an oversight that allowed Kelly to easily buy two guns for crimes through background checks on guns.

On the day of the november 2017 crime, Kelly, wearing a bulletproof vest, took a rifle and strafed the First Baptist Church in Sutherland Springs, killing 26 people and seriously injuring 20 others.

A U.S. federal judge ruled on the 8th that the Air Force must pay $230 million in compensation to a total of 80 family members of the dead and injured in 2017. Texas Magistrate Rodriguez said in July that the Air Force must be 60 percent responsible for the attack.
