01 At about 0:00 on February 1, 2022, Nie X, Li X, Zou X, Gu X and four other people were still setting off fireworks and firecrackers in the community knowing that the Alcadia community of Wenchengyuan belonged to the prohibited area, and were found by the patrol police. Notice prohibiting the display of fireworks
In order to reduce environmental pollution, create a good production and living environment, and ensure public safety and the health of the people, in accordance with the relevant provisions of the State Council's "Regulations on the Safety Management of Fireworks and Firecrackers" and the "Measures for the Safety Management of Fireworks and Firecrackers in Xuzhou City", the Pizhou Municipal People's Government has decided to prohibit the display of fireworks and firecrackers in the urban area and other specific areas. The relevant matters are hereby notified as follows:
1. Areas where fireworks and firecrackers are prohibited
The prohibited discharge area is the urban area of Pizhou City (south to Canal Avenue, southeast to The Pizhou urban section of Lianhuo Expressway, east to Longhai Avenue, north to North Huancheng Road, west to Canal Avenue), the completed high-tech zone area, and the core area of the city's scenic spots.
2. Places where fireworks and firecrackers are prohibited
1. State organs, military facilities, nature reserves, cultural relics protection units and within 100 meters of the surrounding area;
2. Stations, wharves and other transportation hubs, as well as railway and highway line safety protection zones;
3. Theaters, stadiums, parks, amusement (entertainment) venues, halls, medical institutions, kindergartens, primary and secondary schools, homes for the elderly, large department stores (fields), markets, commercial centers, bustling streets and other public places where people are concentrated and within 100 meters of the surrounding areas;
4. In the safety protection zone of power transmission and transformation facilities and communication facilities;
5. Within 100 meters of the warehouse and open yard of combustible materials such as grain, cotton, oil, hemp, and daily industrial products;
6. Within the protective range of key fire prevention areas such as mountains, forests and grasslands;
7. Within 100 meters of the place where inflammable and explosive dangerous goods are produced, sold, stored and used;
8. Other dangerous places that are easy to cause fire and explosion, as well as areas with special environmental protection requirements. For venues and areas provided for in the preceding paragraph, their management units shall set up warning signs prohibiting the display of fireworks and firecrackers in conspicuous locations.
3. The time when fireworks and firecrackers are prohibited
From the date of the notice, all hours of the year.
4. In areas and places where the display of fireworks and firecrackers is prohibited, no unit or individual may illegally produce, operate or store fireworks or firecrackers without permission.
V. Prohibition of the division of responsibilities for the management of fireworks and firecrackers
The public security organs are the competent authorities that prohibit the display of fireworks and firecrackers. Emergency management, market supervision, transportation, urban management, environmental protection, disabled persons' federation, education, publicity and other departments in accordance with their respective duties, in accordance with the law to do a good job of fireworks management and education guidance and other related work. Streets and communities assist relevant functional departments to do a good job in implementation.
6. Penalties for setting off fireworks in violation of regulations
Whoever violates the provisions of this Circular shall be ordered to stop the display in accordance with the relevant provisions of the State Council's "Regulations on the Safety Management of Fireworks and Firecrackers" and shall be fined not less than 100 yuan but not more than 500 yuan; if it constitutes a violation of the administration of public security, an administrative punishment for the administration of public security shall be given in accordance with law; where a crime is constituted, criminal responsibility shall be pursued in accordance with law; and those who cause losses shall bear the liability for compensation in accordance with law.
Whoever sets up a stall in violation of this Notice to sell fireworks and firecrackers shall be fined between 50 and 200 yuan in accordance with the "Regulations on the Management of Urban Appearance and Environmental Sanitation of Xuzhou City"; if fireworks and firecrackers destroy environmental sanitation or urban greening and refuse to make corrections, the urban management department shall impose a fine of between 200 and 1,000 yuan.
Where fireworks and firecrackers are illegally operated, stored, or transported in prohibited areas, the departments of public security, emergency management, market supervision, and urban management shall, in accordance with their respective duties, seriously investigate and deal with them in accordance with law.
7. Where violations of the provisions of this Circular are subject to administrative or above penalties, they are to be recorded in the credit record.
