In view of the problems of professional mismatch, compulsory internship, and fee-based internship, 1 "strictly prohibited" and 27 "not allowed" are proposed, and the handling provisions are clarified in a targeted manner.

The revised "Provisions" include 8 chapters and 50 articles, such as general provisions, internship organization, internship management, internship assessment, safety duties, safeguard measures, supervision and handling, and supplementary provisions, compared with the original "Provisions", the revised "Provisions" further clarifies the responsibilities, rights and obligations of all parties involved in the internship, and standardizes the basic requirements of the process of each link of the internship. Among them, in view of the problems of professional mismatch in the content of the internship, compulsory internship, fee-based internship, simple duplication of labor, participation of intermediary agencies, illegal arrangement of overtime and night shifts, the "red line" is further delineated, 1 "strictly prohibited" and 27 "must not" are proposed, and the handling provisions are clarified in a targeted manner to effectively protect the legitimate rights and interests of intern students. For the first time, the Model Text of the Internship Agreement was issued, which clarified that the agreement must be signed by the vocational school, the internship unit and the student before the internship can be carried out.

First, in view of the problem that the content of the internship is not correct, it is stipulated that simple repetitive labor and high-intensity labor unrelated to the major shall not be arranged, and it is clear that the content of the internship "shall basically cover the typical work tasks of the corresponding positions (groups) of the major, and in principle shall not arrange internships across major categories", "students shall not be arranged to engage in simple repetitive labor", "students shall not be arranged to engage in physical labor of level III. intensity or above or other harmful physical and mental health internships" and "It is strictly forbidden to organize internships for profit-making purposes".

Second, in response to the problem of compulsory internship, further protect the right of students and parents to know, and clarify that all students participating in the post internship organized by the unified organization should obtain the informed consent signed by the student, student guardian or parent, and if the student and their legal guardian or parent clearly do not agree with the school internship arrangement, they can choose the qualified post internship unit. Vocational schools must not be forced to arrange for students to intern in designated units, and must not seize students' student id cards, resident identity cards, or other documents.

Third, in view of the problem of intermediary agencies participating in student internships, intermediary agencies intervene in internships to earn "head fees", which is an important source of compulsory internships and paid internships, and the social reaction is relatively strong. The Provisions make it clear that tripartite agreements on internships must be signed by vocational schools, internship units and students, and reiterate that student internships may not be organized, arranged and managed through intermediary agencies or paid agents. Where these Provisions are violated to engage in student internship intermediary activities or paid agents, where laws and regulations provide for legal liability, the relevant departments shall pursue responsibility in accordance with laws and regulations; where a crime is constituted, criminal responsibility shall be pursued in accordance with law.

Fourth, in view of the problem of overtime and attendance of students' internships, on the basis of the original regulations in principle, "arranging students to work overtime and night shifts", the internship units should comply with the provisions of the state on working hours and rest and leave, and ensure that students enjoy the rights of rest and leave, obtain labor health and safety protection, and accept technical skills guidance during the post internship period, and make it clear that "the attendance system of the internship unit shall not be simply applied, and the students shall not be assessed by simply applying the staff standards."

Fifth, in view of the problem of students' internship remuneration and costs, it is stipulated that the internship unit should give students appropriate internship remuneration, in principle, not less than 80% of the salary standard of the same position in the unit or the minimum wage standard, the payment period shall not exceed 1 month, shall not be paid instead of currency with goods or vouchers or forwarded by a third party, and shall not be charged to students for internship deposits, training fees, internship remuneration commissions, management fees, internship material fees, employment service fees or other forms of internship fees. Students may not be required to provide guarantees or collect student property in other names.

In the next step, the Ministry of Education will work with relevant departments to further smooth the channels for policy consultation and situation reflection, and carry out special investigations and key spot checks in combination with education supervision, public security management, safety production inspection, occupational health supervision and inspection, labor security supervision, and industrial and commercial law enforcement. Relevant departments in all localities should, in accordance with the principles of "the management industry must manage safety, the management of business must manage safety, and the management of production and operation must manage safety" and "who is in charge and who is responsible", regularly organize self-examination, strengthen daily supervision, especially strengthen the safety management of internships, improve the emergency response system and mechanism, and seriously deal with and jointly punish vocational schools, internship units, and relevant responsible persons who violate these Regulations in accordance with laws and regulations. During the winter vacation, all local vocational colleges and universities should conscientiously implement the "Regulations", combined with the requirements of local epidemic prevention and control, and organize internship management during the winter vacation.
