Recently, the WeiXian People's Court of Hebei Province publicly pronounced a judgment in accordance with the law on a criminal incidental civil public interest lawsuit against precious and endangered wild animals initiated by the Zhuolu County People's Procuratorate.

In Order to prevent sparrows and other birds from pecking at the grain he planted, defendant Tian X set up a sticky net around its contracted land in Baozhuang Village in August 2020, causing 91 birds to be glued to death. According to the appraisal of Zhangjiakou Dinghan Forest Grassland Resources Appraisal Center, the birds that were stuck to death included 1 longitudinal-bellied owl, also known as the little owl, which was included in the "List of Wild Animals under National Key Protection" and was a national second-level protected animal with an accounting value of 15,000 yuan; sparrows belonged to the protected animals in the "List of Beneficial Terrestrial Wild Animals Protected by the State or with Important Economic and Scientific Research Value", with a benchmark value of 300 yuan / piece, and an accounting value of 27,000 yuan for 90 birds. Defendant Tian X's behavior of endangering precious and endangered wild animals caused the loss of national wildlife resources, the imbalance of the biological chain, the destruction of biodiversity and regional ecological balance, and to a certain extent damaged the ecological resources and environment, resulting in damage to the social public interest.

After trial, the court held that defendant Tian X violated wildlife protection laws and regulations and endangered precious wild animals under key national protection, and his conduct constituted the crime of endangering precious and endangered wild animals. In the end, the court convicted defendant Tian X of the crime of endangering precious and endangered wild animals, sentenced him to three months' detention, and fined him 2,000 yuan; the tools of the crime were handled by the Zhuolu County Public Security Bureau of the seizure organ according to law. In the civil public interest litigation part, the court ruled that defendant Tian X was obligated to engage in wildlife protection publicity work in the area of Baozhuang Village from April 1, 2021 to March 31, 2024. Specifically, it is necessary to print a copy of the wildlife protection publicity materials for each villager in Baozhuang Village; during the hunting ban, hang banners on the protection of wild animals in the center of Baozhuang Village; during the hunting ban period, go to the farmland at least once a week to conduct inspections, and if any damage to wildlife resources is found, it is necessary to discourage or report to the relevant departments in a timely manner.
