On the 26th, the reporter learned that the Wenling Municipal People's Procuratorate of Zhejiang Province initiated a public prosecution of a case endangering precious and endangered wild animals, which was the first case of endangering precious and endangered wild animals in the city after the Criminal Law Amendment (Eleven) came into effect.
It is reported that Li Mou, 42, is the head of a circus in Anhui. On January 24, 2020, a domesticated lion in the circus suddenly had difficulty breathing and died after ineffective treatment. According to the regulations, Li needed to report to the forestry department, but he did not do so.
The body of the lion Li has always been kept. In July 2020, through the introduction of his friend Ma Mou, Li sold the lion body to Li Moumou and Yin Mou for 16,000 yuan.
After that, the two disposed of the lion's body, leaving 4 lion legs and other lion products to sell to Zheng Mou, who ran a snake meat and dog meat business in a vegetable market in Wenling.
After getting the lion products, Zheng sold 1 lion leg to Sun in the morning, and sent 3 lion legs to Lin's house in the afternoon. When the two sides traded, they were caught by the police on the spot. After that, Yin, Li, Li and Ma were arrested one after another.
After identification, the lion involved in the case belongs to the African lion genus Leopard of the carnivorous cat family and is listed in Appendix II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora. The seized lion body parts belong to the national key protected wildlife products, and the approved value is 30,000 yuan.
After trial, the court held that Zheng's illegal purchase and sale of rare and endangered wildlife products under key national protection was serious; Li's illegal sale of rare and endangered wildlife products under key national protection; Li's and Yin's illegal purchase, transportation, and sale of rare and endangered wildlife products under key national protection; and Ma's helping others illegally purchase and sell precious and endangered wildlife products, all of which constituted the crime of endangering precious and endangered wild animals.
In the end, the five were sentenced to prison terms ranging from 8 months to 5 years and 6 months, and fined between 10,000 yuan and 80,000 yuan. Lin and Sun were handled separately.
According to the procurator of the Wenling Municipal People's Procuratorate, according to the Interpretation of the Supreme People's Court on Several Issues Concerning the Specific Application of Law in the Trial of Criminal Cases involving the Destruction of Wildlife Resources, the "precious and endangered wild animals" stipulated in the Criminal Law include wild animals under national first- and second-level protection listed in the list of wild animals under national key protection, wild animals listed in Appendices I and Appendix II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, and the above-mentioned species domesticated and bred.
According to reports, the above-mentioned species that are domesticated and bred cannot be bought and sold without approval; even if they die, they must be dealt with according to relevant regulations, and cannot be bought and sold privately, let alone eaten. (End)
