The original judgment ascertained that since 2015, defendant Zhao Jian and others have gradually formed a relatively stable criminal organization with defendant Zhao Jian as the organization and leader, defendants Zhao Rui, Chen Biao, Huang Chao, and Zhu Xueliang as backbone members, and defendants Liu Pengfei, Cheng Longxian, Zha Lincai, and Liu Xin as general participants, and have certain organizational discipline, strong cohesion, and repeatedly employ violence, threats, intimidation, nuisance, and other means to systematically carry out illegal and criminal activities, obtain certain economic benefits, and have certain economic strength. In Bailianpo Town, Huaiyuan County, Hu Yan Village and the surrounding areas, they have dominated one side, done evil deeds, bullied and maimed the masses, seriously undermined the order of economic and social life, and have serious social harm.

Among them, defendant Zhao Jian organized and led a mafia-type organization, using violence, threats, and other means to systematically carry out illegal and criminal activities, dominate one side, do evil for non-evil, maim the masses, and seriously undermine the order of economic and social life; for the purpose of making profits, open casinos, and the circumstances are serious; Beating others at will, repeatedly demanding illegal debts from others through threats, intimidation, verbal abuse and nuisance "soft violence" means, or deliberately destroying other people's property with weapons, with heinous circumstances; Gathering multiple armed people to fight; Extortion of public or private property in huge amounts; Using violence or coercion to buy and sell goods; The illegal detention of others has constituted the crime of organizing and leading a mafia-type organization, the crime of opening a casino, the crime of picking quarrels and provoking trouble, the crime of extortion, the crime of gathering crowds to fight, the crime of forced trading, and the crime of illegal detention.

The remaining defendants were convicted of the crimes of participating in mafia-type organizations, opening casinos, picking quarrels and provoking trouble, extortion, forced trading, illegal detention, and gathering crowds to fight. After trial, the court of first instance sentenced Zhao Jian, Zhao Rui and 22 other defendants to fixed-term imprisonment ranging from 20 to 6 months, and fined or confiscated property.

After the first-instance judgment, Zhao Jian and other defendants expressed dissatisfaction and appealed to the Bengbu Intermediate People's Court. In response to the appellant's grounds for appeal, the court of second instance conducted a comprehensive analysis and judgment based on the facts and evidence ascertained, and held that the facts found in the original judgment were clear, the law was applied correctly, the sentence was appropriate, and the trial procedures were lawful. None of the appellant's grounds of appeal could be established, and the appeal was dismissed and the original judgment was upheld.
