On September 23, a reporter from Dahe Bao learned from Zhang Lei, the lawyer representing the defendants Wang Aiwen and Wang Aiwu, that the Lanzhou Intermediate People's Court will hold a pretrial conference on the morning of September 24 to hear the opinions of the prosecution and defense on procedural issues.
Zhang Lei said that there was a dispute over whether the defendant Wang Aiwu had full capacity for criminal responsibility at the time of the crime, and he may apply again for a new psychiatric evaluation.

Review: The son of the melon farmer stabbed the chengguan to death
On July 18, 2018, in Lanzhou City, Gansu Province, the son of Wang Junhong of Guanong stabbed Lanzhou Chengguan to death, causing widespread concern.
On the same day, Wang Junhong, Wang Aiwen, Wang Aiwu father and son clashed with chengguan law enforcement personnel while setting up a stall selling watermelons, causing chengguan to die and seriously injure two. On July 19, 2018, the father and son were criminally detained; On August 9, 2018, his father, Wang Junhong, was released.
On September 23, Wang Junhong recalled to a reporter from Dahe Daily that the night before the incident, they had a conflict with the chengguan.
That night, Wang Junhong took his sons Wang Aiwen and Wang Aiwu and three fathers and sons to sell melons at the gate of the Shangcheng Community in Zhongguang Yijing bay, Lanzhou, Yantan. "At eight o'clock came a car of chengguan, without saying a word began to grab the scale, the scale just had a good watermelon picked by the guests, we pleaded and said that after letting the residents take this melon away, we did not sell it and left immediately, but the chengguan did not listen or want to grab the scale, the chengguan hugged the scale and one of our people took it away, and the two sides had a physical conflict in the emergency."
According to the cover news report at the time, in the process of grabbing the scale, the weighing pan flew out, and the youngest son Wang Aiwu saw the scene in front of him, was stimulated by the suspected psychotic attack, and punched the chengguan in the head.
Chengguan called the police and used their van to block the melon cart. The police who came out of the police mediated on the spot, and after the mediation was completed, they let them go.

Things got worse the next day. Wang Junhong believes that it was the chengguan who came to "take revenge."
Wang Junhong told the Dahe Daily reporter that on the morning of July 18, they planned to "go home without selling" and give the melon cheaply to another melon seller. In the morning, the chengguan inquired about their whereabouts everywhere, and finally found their parking place in the courtyard of the second village of Tan on the north side.
"There were three chengguan cars carrying more than a dozen chengguan rushing over, one chengguan rushed to the melon cart and directly hit the younger son, and several other chengguan besieged my eldest son and knocked him to the ground, punching and kicking. I knelt down to him and begged for forgiveness, but they ignored me and knocked me to the ground again, and finally I had to climb under the car to avoid. It has become like this, and the city management has not let go, and pulled me out from under the car to continue beating me violently. ”
At this time, he heard a city manager shouting, "I let you father and son disappear from Yantan!"
"The younger son seemed to be stimulated to hear this sentence, extremely indignant, lifted the watermelon knife and rushed to the city management, stabbing three people in succession, of which the seriously injured fell to the ground, and the younger son continued to smash several times with a weighing plate."
According to the case bulletin released by the Lanzhou police on August 29, 2018, at about 11:00 a.m. on July 18, When Li Fuwen, deputy captain of the law enforcement squadron, led 15 members of the team, including Wang Xiangjun and Ding Jiantao, to carry out daily inspection work in Beimiantan Village, they once again found that Wang Junhong's father and son were occupying the road, and in the process of cleaning and rectification, when the law enforcement personnel seized the scale, the three people insulted and obstructed, and Wang Aiwu beat the law enforcement personnel with a hammer.
After the hammer was taken, Wang Aiwu stabbed law enforcement personnel Wang Xiangjun, Ding Jiantao, and Li Fuwen with a knife, causing Ding Jiantao's liver, spleen, arm tendon to rupture, and Li Fuwen's stomach and liver to rupture; After the victim Wang Xiangjun was stabbed and fell to the ground, Wang Aiwen held a wooden board and beat Wang Xiangjun who fell to the ground, and then Wang Aiwu raised the scale to continuously smash Wang Xiangjun, resulting in Wang Xiangjun's death.

In the three years since the crime occurred, three mental condition assessments have been made
"My eldest son and I were beaten to the ground by so many chengguan, and the younger son was greatly stimulated and went insane before he raised a knife and injured people." When the police came, the three of us waited for the police to deal with it, but the chengguan all ran out. Wang Junhong said that the youngest son, Wang Aiwu, had previously served as a soldier and was returned by the army due to mental illness. Later, he took medicine all the time, and during the hospitalization several times, his condition continued to worsen, and he was stimulated to beat people.
Wang Junhong's lover Tian Yongxia showed the reporter of Dahe Daily the disabled person's certificate issued by the Disabled Persons' Federation for defendant Wang Aiwu. The certificate was issued by the Silver Disabled Persons' Federation in 2015 and is a mental disability certificate with a grade of second degree.

Wang Aiwu's defense lawyer Zhang Lei said that after the incident, on July 27, 2018, the Judicial Psychiatric Laboratory of the Second Hospital of Lanzhou University issued a judicial appraisal opinion on the mental condition of defendant Wang Aiwu, and the appraisal result was full criminal responsibility.
Four months later, defendant Wang Aiwu's defense lawyer applied for a re-evaluation of Wang Aiwu's mental condition and capacity for criminal responsibility in accordance with law.
On November 30, 2018, the Psychiatric Laboratory of the Third People's Hospital of Lanzhou City issued a judicial psychiatric appraisal opinion, and the appraisal result was still full criminal responsibility.
On July 1, 2019, the Academy of Forensic Science issued a forensic evaluation opinion, and the result of the appraisal was to limit the capacity for criminal responsibility.
Defense lawyer Zhang Lei argued that chengguan had seriously violated the law, and that Wang Aiwen and Wang Aiwu constituted legitimate defense, and put forward the opinion of not approving the arrest. On August 29, 2019, the Lanzhou Municipal People's Procuratorate filed a public prosecution against Wang Aiwen and Wang Aiwu for suspected intentional homicide, and found Wang Aiwu a "mental patient who had not completely lost the ability to recognize or control his own behavior" at the time of the case.
Regarding the first pre-trial conference of the case, Zhang Lei said that the defendant Wang Aiwu's ability to act at the time of the case was disputed and he may apply again for a new psychiatric evaluation.
In addition, whether Wang Aiwen constitutes intentional homicide is also one of the focal points of controversy, "When Wang Aiwu was assassinated, Wang Aiwen had been subdued by several chengguan forces and fell to the ground, and whether he and Wang Aiwu constituted a joint crime is debatable." If it is found that the two brothers are not accomplices, Wang Aiwen is of course innocent, and if the accomplice is founded, Wang Aiwen may be sentenced to death. ”
Zhang Lei said that there was no civil lawsuit attached to the case, and "the victim did not mention it."
Wang Junhong said that the development of the matter to this point is something he does not want to see, and he hopes to get a fair and just verdict.
