On December 4, the Hainan Provincial No. 1 Intermediate People's Court publicly pronounced a verdict in the case of Zhang Jiahui, former vice president of the Hainan Provincial High People's Court, for accepting bribes, administrative miscarriage of justice, and fraud: the defendant Zhang Jiahui was sentenced to 18 years' imprisonment and fined 4 million yuan.
Zhang Jiahui was born in January 1965 in Wanzhou District, Chongqing. On May 31, 2019, Zhang Jiahui, then vice president of the Hainan Provincial High Court, was detained by the Hainan Provincial Supervision Commission on suspicion of serious violations of his duties; on November 30, 2019, he was criminally detained on suspicion of accepting bribes, and arrested on December 8 of the same year.
On June 17, 2020, the Hainan Provincial No. 1 Intermediate People's Court in Zhang Jiahui's case was heard in public. The first-instance trial found that since 2006, Zhang Jiahui took advantage of her position as president of the First Civil Trial Division of the Hainan Provincial High People's Court, a member of the adjudication committee, a member of the party leading group, and a vice president to seek benefits for the trustees of the case by greeting relevant judges, and illegally accepted a total of 43.75 million yuan in property from Zhang Fu and 37 other people, either directly or through her husband Liu Yuansheng and nephew Liu Lei (all handled separately). These funds were used for Zhang Jiahui's family expenses and the development of the company's projects that Liu Yuansheng actually controlled.
The first-instance judgment disclosed the list and details of the bribe-givers in detail, which was made public for the first time. The judgment discloses that after Zhang Jiahui arrived at the case, he truthfully confessed some of the bribery facts that the Provincial Supervision Commission had mastered, and also took the initiative to confess most of the other bribery facts that the Provincial Supervision Commission did not have. In the process of handling the case, Zhang Jiahui actively returned more than 32.75 million yuan of stolen funds and expressed his willingness to continue to return the remaining illegal gains. Zhang Jiahui and his defender had no objection to the facts and charges of bribery charged by Zhang Jiahui in court, and expressed their admission of guilt and acceptance of punishment.
1. Received 6.15 million yuan from Zhang Fu.

From 2017 to 2018, Zhang Fu, through Zhang Jiahui's nephew Liu Lei, asked Zhang Jiahui to provide assistance to his law firm in the contract dispute case of Hainan Sixth Construction Engineering Co., Ltd., the dispute over the equity transfer contract of Evergrande Hainan Company, the zhu wangui private loan dispute, the chen Jianhong equity transfer dispute, and the chen xuemei equity transfer dispute. Zhang Jiahui took advantage of his position to greet the relevant judges Liu Yangui, Qu Yongsheng, Wu Suqiong, Zhang Zhao, and Xu Zhengwei, and asked for care of the relevant trustee. Liu Lei accepted 5.95 million yuan in benefits from Zhang Fu himself or through lawyers Chen Zongze and Zhang Li on behalf of him 10 times.
In addition, in 2017, Zhang Fu also asked Zhang Jiahui through Huang Weiguo to assist in a contract dispute case of the Haikou Xiuying Branch of the Industrial and Commercial Bank of China represented by his law firm. Zhang Jiahui greeted Guo Longbin, the judge in charge of the case, and asked to speed up the trial of the case and conclude the case as soon as possible. Later, Zhang Fu put 200,000 yuan in cash into a paper bag and asked Huang Weiguo to take zhang Jiahui's office to hand it over to her.
2. Accepted 3 million yuan from Liao Zhetao.
Liao Zhetao is a lawyer at a law firm in Hainan.
In March 2019, Liao Zhetao, through Ding Mou, who was then the director of the Editorial Center of the Hainan Branch of a newspaper, asked Zhang Jiahui to take care of the dispute over the equity transfer contract between Chen Chunsheng and Wang Chunhua and others. The case was lost in the first instance, and the claims of Chen Chunsheng and Wang Chunhua were rejected. The case was appealed to the Hainan Provincial High Court. Zhang Jiahui greeted Guo Longbin, the undertaker judge. Tu Xianya is the director of Hainan Fangyuan Law Firm.
From 2016 to 2018, Tu Xianya asked Zhang Jiahui to help his representative Shanghai Youfu Landscape Company execute a different proposal and Shen Dewen, a shareholder of Youfu Company, in the lawsuit. Zhang Jiahui greeted Wang Zhongxue, head of the undertaking department, and asked for support for Youfu Company and shareholder Shen Dewen. Subsequently, Zhang Jiahui twice accepted 300,000 yuan and 200,000 yuan in cash from Tu Xianya at a hotel on Haikou Binhai Avenue.
In 2018, Zhang Jiahui also helped Tu Xianya's hainan coconut gardening company apply for the revocation of arbitral award, the enforcement case of Ping An Bank's Haikou branch, and the hainan Hongye Evergrande Trading Company cooperative development contract dispute case. Zhang Jiahui greeted Zhao Yinghua, head of the business department, Cao Xuhai, and Qian Zhiyong, the undertaker judges. Zhang Jiahui received 50,000, 200,000 and 300,000 Tu Xianya three times at the Yuntian Cafe in Haikou Shuiyuntian Community.
Tu Xianya's cases represented by his law firm were cared for by Zhang Jiahui, and during the Spring Festival every year from 2013 to 2019, he also went to Zhang Jiahui's home to give Zhang 200,000 yuan, a total of 1.4 million yuan seven times.

Cao Liming is the president of Suzhou Gold Mantis Architectural Decoration Co., Ltd.
In May 2017, Cao Liming asked Zhang Jiahui and Liu Yuansheng to help with the company's decoration contract dispute case, and gave Liu Yuansheng 3 million yuan in the parking lot of Yuntian Cafe in Shuiyuntian Community, Haikou City. After receiving the money, Liu informed Zhang Jiahui that Zhang took advantage of his position to call Li Qing, president of the Sanya Intermediate Court, who was in charge of the second-instance trial of the case, and Chen Heng, vice president, to ask for support for the demands of the Gold Mantis Company. However, it did not succeed, and the second instance rejected the appeal of Gold Mantis Company, upheld the original judgment, and Gold Mantis Company paid liquidated damages of 6.05 million yuan.
At the beginning of 2018, the case was retried in the Hainan Provincial High Court, and Cao Liming again asked Zhang Jiahui and Liu Yuansheng for help. Zhang Jiahui greeted Zou Hanjiang, head of the appeal review division of the case, and asked for support for the case to enter the retrial procedure. Zhang Jiahui also expressed his opinion in favor of Gold Mantis at the review committee. The Sanya Intermediate People's Court was later ordered to retry, and the result of the trial was to terminate the enforcement of the original judgment. In the second half of 2018, Liu Yuansheng received 2 million yuan from Cao Liming in the parking lot of Yuntian Cafe in Shuiyuntian Community.
20. Received 5 million yuan from Qiu Dailun.
Qiu Dailun is a shareholder, chairman and legal representative of Shenzhen A-B Fund Management Company.
In 2018, Shenzhen Jiayi C New Century Investment Center applied to the Haikou Intermediate Court for the auction of the second phase of ledong's "Beautiful Longmu Bay" project. Because it involved many creditors and many home buyers, it was easy to cause social group incidents, and Zhang Jiahui, who served as the leader of the special working group on risk prevention and control and judicial response of the project, asked to suspend the execution of the case. In order to promote the project land auction procedure, Qiu Dailun asked Zhang Jiahui to take care of him through Liu Yuansheng, and in the first half of 2019, together with Wu Guizhong, head of the Hainan Company, he went to liu Yuansheng's office in Shuiyuntian Community, Haikou City, and gave him 5 million yuan. After that, Zhang Jiahui agreed to Qiu Dailun's conditional auction solution at the relevant meeting and reported it to the hainan higher people's court for decision-making. Later, the Haikou Intermediate Court resumed the implementation of the auction procedure.
21. Accepted 3 million yuan from Cao Chengwei.
Chengwei Cao is an Executive Director of Haikou University of Economics.
At the beginning of 2017, Haikou University of Economics and Tang Jie had an equity transfer dispute, which was sued by the latter. Cao Chengwei knew Liu Yuansheng through his lawyer Xiao Ling, asked Zhang Jiahui to support and care for the case, and gave Liu Yuansheng 3 million yuan in the parking lot of Yuntian Cafe in Shuiyuntian Community. Before the second-instance judgment was issued, Zhang Jiahui greeted Wu Suqiong, a member of the collegial panel and the head of the undertaking department, and asked for a reduction in the liability of Haikou School of Economics for breach of contract. Zhang also expressed his opinions in favor of haikou Economics Institute at the hainan higher court review committee.
The result of the judgment in this case was that the amount of liquidated damages of Haikou University of Economics was adjusted and reduced, and it compensated Tang Jie with about 10 million yuan.
22. Accepted 2 million yuan from Wang Bing.
Wang Bing, who has a good relationship with Zhang Jiahui and Liu Yuansheng, will play mahjong and eat together from time to time.
In 2017, Wang Bing asked Zhang Jiahui to help reject the bankruptcy application of Hainan Weiya Industrial Company. Between 2016 and 2017, VIA applied for bankruptcy to the Haikou Intermediate Court due to debt problems, but the Haikou Intermediate Court ruled that it did not support it, and the case was appealed to the Hainan High Court. Friend Ye Xiaodong found Wang Bing, saying that Weiya Company owed him money and applied for bankruptcy to avoid debts, hoping that Wang Bing would communicate with the Hainan leaders and reject Weiya Company's bankruptcy application.

Zhang Jiahui approached Judge Wu Suqiong and asked him to support Hainan Yuexin Group. The second instance rejected the appeal and upheld the original judgment. In 2017, Hu Jianxin asked Li Moumou to help, and through Liu Yuansheng asked Zhang Jiahui to help Hainan Tongsheng Company in a private lending dispute case. Zhang Jiahui greeted Guo Chaoyang, the leader of the court undertaking the case, and asked for his attention. In the second half of 2017, Liu Yuansheng accepted 200,000 yuan from Hu Jianxin, a representative of Li Mou, at the Yuntian Café.
25. Accepted 1 million yuan from Yan Weicai.
Yan Weicai, the eldest son of Yan Qilin, the legal representative of Hainan Yijing Real Estate Development Company.
In the first half of 2013, due to Yijing Company's application to transfer a piece of land and above-ground attachments to its name, Yan Weicai asked Zhang Jiahui for help through Liu Yuansheng. Zhang Jiahui called Zhang Yongfu, head of the enforcement department of the court in the case, asking him to supervise and speed up the progress of enforcement and seize the transfer. After the case was executed and transferred, in the second half of 2013, Liu Yuansheng accepted 1 million yuan from Yan Weicai in his own office in Haikou Shuiyuntian Community.
26. Accepted 1 million yuan from Zhang Donglin.
Zhang Donglin, a shareholder of Hainan Daya Real Estate Company, has known Liu Yuansheng and Zhang Jiahui for many years.
In 2015, Zhang Donglin sought help from Liu Yuansheng and Zhang Jiahui because the land of Daya Company was repossessed by the government for a fee and the compensation standard was too low. Liu Yuansheng suggested an administrative lawsuit and recommended Gan Li, the legal counsel of his own company, Hainan Dinas, to represent the case. Zhang Jiahui greeted Gan Wenping, president of the Xiuying Court, who undertook the case, and took care of Daya Company. The first-instance judgment changed the amount of land compensation for Daya Company from more than 230.54 million yuan to more than 428.16 million yuan. In the Spring Festival of 2018, Zhang Donglin gave Liu Yuansheng 1 million yuan at a hotel in Haikou City.
27. Accepted 1 million yuan from Lin Mingwei.
Lin Mingwei is the original shareholder of Sanya Dingcheng Investment Company.
In the second half of 2018, Lin Mingwei, through Tan Moumou, the wife of Huang Moumou, the former director of the Sanya Municipal People's Congress, asked Zhang Jiahui to help him in the second instance of an equity dispute case. Lin arranged for Tan moumou to give Zhang Jiahui 1 million yuan on the side of the road near the Hainan High Court. Zhang Jiahui greeted the judge in charge, Qi Yongjie, and asked for his attention.
28. Received 850,000 yuan from Liang Jiongming.
Liang Jiongming, Director of the Legal Counsel Office of Haikou Port Group, and a fellow alumnus of Liu Yuansheng University, the two have a close relationship.
From 2014 to 2017, Huang Moumou, deputy general manager of Hainan Yuexin Company and Hainan Port Zhonghu Entertainment Mall Company, asked his friend Liang Jiongming to coordinate the relationship between the Hainan Higher People's Court and take care of 4 litigation cases. Liang found Zhang Jiahui through Liu Yuansheng. Zhang took advantage of his position to greet and support the judges who undertook these cases, Wu Suqiong, He Yuefei, and Wang Yunyun. After achieving the purpose of entrustment, Liang Jiongming gave Liu Yuansheng a total of 850,000 yuan in cash of 150,000, 250,000, 100,000 and 350,000 yuan transferred by Huang Moumou four times.
29. Accepted 500,000 yuan from Tan Xianhui.
In early 2014, Tan Xianhui, through Liu Yuansheng, asked Zhang Jiahui to help him participate in a construction contract dispute as a third party. Zhang Jiahui greeted Li Yan, the judge of the first instance, and asked for her attention. In March 2015, Liu Yuansheng received 500,000 yuan from Tan Xianhui in his own office in Shuiyuntian Community. In 2017, the case was appealed to the Hainan Provincial High Court, and Tan continued to ask Zhang Jiahui for help through Liu Yuansheng. Zhang greeted Liu Yangui, the judge of the second instance, and asked for support for Tan Xianhui's litigation request.
After Zhang Jiahui arrived at the case, he took the initiative to confess most of the bribes that the Hainan Provincial Supervision Commission did not know, and returned more than 32.75 million yuan of stolen money
30. Accepted 500,000 yuan from Zou Kaiyu.
In the first half of 2018, Zou Kaiyu met Liu Lei through judge Liu Yangui, and then asked Zhang Jiahui through Liu Lei to help Hainan Lion City Tourism Development Company apply for the change of the subject matter of preservation in the contract dispute case of Hainan Lion City Tourism Development Company, and gave Liu Lei 500,000 yuan. Zhang Jiahui greeted Li Jing, the undertaker, and hoped to take care of the Lion City Company.
31. Accepted 300,000 yuan from Zhai Yuanliang.
In 2016, his friend Yang Moumou asked Zhai Yuanliang to go to the court to unblock the relationship because of the divorce case. Zhai asked Zhang Jiahui for help through Liu Yuansheng to dredge up the relationship and take more care of Yang Moumou when dividing the divorced property. Zhang Jiahui greeted Zhong Wenyuan, the president of the Longhua Court, and took care of him. After the mediation of the case was concluded, at the end of 2016, Zhai Yuanliang gave him 300,000 yuan in cash at the office of Liu Yuansheng in Shuiyuntian Community.
32. Received 200,000 yuan from Yunxia.
Yunxia is the general manager of Hainan Jiajing Real Estate Company.
In 2013, in the second-instance judgment of the construction project contract dispute between Jiajing Company and Shenzhen CSG Company, CSG Company submitted an application for retrial to Hainan Province. In April and May of that year, Yunxia asked Zhang Jiahui in her office through Liu Yuansheng to take care of Jiajing Company and gave Liu 200,000 yuan at the same time. Zhang Jiahui greeted Zou Hanjiang, head of the department that undertook the appeal review case. Later, the Hainan Higher People's Court ruled to reject CSG's application for retrial.
33. Accepted 200,000 yuan from Wang Jianlan.
Wang Jianlan, sister of Wang Yonghong, the actual controller of Hainan Ruyi Island Tourism and Holiday Investment Company.
In the first half of 2017, Wang Jianlan, through judge Song Changqing, asked Zhang Jiahui to help the second-instance trial of the Hainan Ruyi Island Tourism and Holiday Investment Company project contract dispute case, hoping to reject the other party's appeal and uphold the original judgment. Zhang Jiahui greeted Linda, the judge who undertook the case. After the second-instance trial upheld the original judgment, Song Changqing transferred the 200,000 yuan given by Wang Jianlan to Zhang Jiahui in shuiyuntian community.
34. Received 100,000 yuan from Su Liyang.
Su Liyang, the actual controller of Haikou Huameng Pawn Company, met Liu Yuansheng through Yunxia, general manager of Hainan Jiajing Real Estate Company.
In 2008, Su Liyang was not satisfied with the first-instance judgment of the Huameng pawn and innovation bookstore dispute case, so he approached Liu Yuansheng and asked Zhang Jiahui for help and gave Liu 100,000 yuan in cash. Liu Yuansheng recommended to Su Li Jingyu, a lawyer at Hainan Fengfeng Law Firm, to represent the second-instance trial of the case, but the appeal period had already passed by then. Zhang Jiahui helped Su Liyang write an appeal, greeted Dai Yibin, a member of the collegial panel of the second instance, supported the appeal request, and expressed opinions favorable to the pawn of the China League at the review committee. The second-instance judgment was partially upheld by Huameng Pawn's litigation claims.
35. Accepted 100,000 yuan from Xu Yixin.

In December 2015, Xu Yixin asked Chen Moumou to help, and through Liu Yuansheng asked Zhang Jiahui to provide assistance for the dispute over the sales contract of the commercial housing entrusted by Weiming Company, and rejected the other party's application for retrial. After Zhang Jiahui was entrusted, he greeted Zou Hanjiang, head of the complaint department of the Hainan Higher People's Court, and asked for support for The Famous Company. After rejecting the application for retrial, Xu Yixin gave Liu Yuansheng 100,000 yuan at the Coconut Grove Hotel in the eastern suburbs of Haikou City.
36. Accepted 100,000 yuan from Zhan Hanqin.
Zhan Hanqin, chairman of Hainan Yirun Real Estate Development Co., Ltd., was a member of the Hainan Provincial Committee of the Chinese People's Political Consultative Conference with Liu Yuansheng.
In the first half of 2016, Zhan Hanqin greeted Zhang Jiahui through Qu Jianmin, then director of the Hainan Provincial Department of Justice, hoping to take care of his brother Zhan Moumou's equity transfer dispute with others. In the past, when developing the third phase of the Shuiyuntian Community, he had a disagreement with Zhan Hanqin, and after discussing with Liu Yuansheng, Zhang Jiahui and Liu Yuansheng thought that they could help Zhan. In Zhan X's case, Zhang Jiahui greeted Wu Suqiong, head of the case undertaking department, and Guo Longbin, the judge who undertook the case, to support Zhan X's appeal request or remand the case back for retrial. The case was eventually remanded for retrial. At the end of 2016, Liu Yuansheng accepted 100,000 yuan from Zhan Hanqin in his office.
37. Accepted 100,000 yuan from Zheng Chengfa.
Zheng Chengfa is the former deputy director of the local taxation bureau of Yangpu Economic Development Zone in Hainan Province (now the deputy director of the Taxation Bureau of Yangpu Economic Development Zone of the State Administration of Taxation).
Around 2015, Zheng Chengfa and his ex-wife conducted divorce proceedings due to emotional discord, and after the first-instance and second-instance judgments, the ex-wife was not satisfied, and in 2017, she applied to the court for a retrial. Through Liu Yuansheng, he asked Zhang Jiahui for help. Zhang asked Lin Zhen, a member of the court's department in charge, to greet Zheng Yanjie, the judge who undertook the appeal. After the retrial application was rejected, at the end of 2017, Zheng Chengfa gave Liu Yuansheng 100,000 yuan at the Yuntian Cafe in Haikou Shuiyuntian Community.
