Announcement No. 47 of 2024 of the General Administration of Customs (Announcement on the Phytosanitary Requirements for Imported German Fresh Apples)

In accordance with the relevant laws and regulations of the mainland and the regulations of the General Administration of Customs of the People's Republic of China and the Federal Ministry of Food and Agriculture of the Federal Republic of Germany on the phytosanitary requirements for the export of German fresh apples to China, from now on, the import of German fresh apples that meet the following relevant requirements is allowed.

1. Basis for inspection and quarantine

(1) "Biosecurity Law of the People's Republic of China";

(2) the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country and its implementing regulations;

(3) The Food Safety Law of the People's Republic of China and its implementing regulations;

(4) Measures for the Supervision and Administration of Inspection and Quarantine of Imported Fruits;

(5) "Working Arrangement between the General Administration of Customs of the People's Republic of China and the Federal Ministry of Food and Agriculture of the Federal Republic of Germany on the Phytosanitary Requirements for the Export of German Fresh Apples to China".

2. The name of the commodity that is allowed to enter the country

鲜食苹果(以下简称苹果)学名Malus domestica,英文名Apple。

3. Permitted origins

Apple region in Germany.

4. Approved orchards, packing plants and cold treatment facilities

Orchards, packaging plants and cold treatment facilities for apples exported to China shall be reviewed and filed with the German Plant Protection Organization (hereinafter referred to as the German side) and approved by the General Administration of Customs of the People's Republic of China (hereinafter referred to as the Chinese side) for registration, including the name, address and registration number, so as to accurately trace the source of the export goods in case of non-compliance with the relevant regulations. Before the export season each year, the German side shall provide the Chinese side with an updated list of registered orchards, packing plants and cold treatment facilities, which will be published on the website of the General Administration of Customs after being reviewed and approved by the Chinese side.

6. Pre-export management

(1) Orchard management.

1. Good Agricultural Practice (GAP) and Integrated Pest Management (IPM) should be implemented in orchards exported to China, including management measures that are compatible with the plantation's phytosanitary conditions.

2. Under the supervision of the German side, orchards exported to China should take effective comprehensive pest control measures to avoid or control quarantine pests of concern to the Chinese side and maintain good hygiene status of the orchards.

3. The monitoring and control of pests in orchards exported to China should be implemented under the supervision and guidance of professional and technical personnel. Technical personnel shall be trained by the German side or an authorized body.

4. For codling moths, orchards exported to China should take necessary measures to prevent the spread of codling moths in accordance with the codling moth control plan formulated by the German side, and maintain a low epidemic level in apple planting areas. During the apple production season, pheromone traps should be set up and visual monitoring should be carried out to monitor and predict the occurrence of codling moths and adjust control measures in time. Monitoring surveys should begin at full flowering and continue until the end of the apple's packaging. Orchards should record data on trap control, visual inspection, and insecticide application timing, concentration, and frequency. For orchards with an area of less than 8 hectares, the density of traps is set at 1 per hectare, and the number of traps in each orchard is not less than 3. For orchards with an area of more than 8 hectares, 1 trap should be added for every 2 hectares added. Replace the trap according to the instructions for use, and check and record the trap trapping situation every week. Based on the monitoring data, the extension department makes control recommendations and implements them accordingly in the registered orchards. The German side should provide the Chinese side with a monitoring report two years before the start of trade. Apples exported to China must not carry codling moths, and if codling moths are detected, the fruit from the orchard shall not be exported.

5. For pear fire blight, apples exported to China should come from the non-epidemic production point (PFPS) of pear fire blight. Pest-free production sites should be established and maintained in accordance with the requirements of the International Standard for Phytosanitary Measures No. 10 (ISPM 10) and approved by the German side. At the request of the Chinese side, the German side needs to provide relevant information on the maintenance of non-epidemic production sites for evaluation and confirmation. Germany or its authorized institutions should carry out pear fire blight monitoring in apple orchards exported to China at least 3 times a year, that is, after the germination of new shoots, 30~40 days after flowering and before harvest. After the outbreak of pear fire blight, a buffer zone with a width of 1,000 meters should be established around the non-epidemic production sites, and the qualification of relevant orchards and buffer zone orchards to be exported to China this season should be suspended. In addition, growers work with agricultural consultants to develop and implement sanitary plans and apply phytosanitary measures (pruning, close control, clean-up). The German side needs to provide monitoring data at the request of the Chinese side.

6. For the apple oxeye rot fungus, the orchard exported to China should carry out laboratory culture and identification of the fungus after the fruit is picked, if the apple oxeye rot fungus is found, the apples of the orchard shall not be exported to China. At harvest time, during the sorting and packing process, fruit injuries should be avoided and injured apples should be removed. Fungicides are used before harvest to prevent fruit rot, and stored in controlled atmosphere and ultralow oxygen during storage to reduce bacterial infections. If alternative measures are taken, the German side should inform the Chinese side of the relevant information.

7. For the apple shell color monoseptospora canker fungus, apple star conchospora fruit rot fungus, American and Australian drupe brown rot fungus, apple scab fungus, etc., the orchard exported to China should take control and monitoring, if the above-mentioned pest infestation is found, the fallen leaves, fallen fruits, diseased branches, diseased fruits should be removed, and their wintering places should be eliminated. All orchards should keep prevention and control records, which should include information such as the name of the plant protection product used, the active ingredient, the time and frequency of use. The German side or its authorized bodies will control these measures. All orchards exported to China, if necessary, according to the IPM principle, use the pre-harvest treatment of the fruit approved by the German approved fungicide before picking, and can be re-sprayed in case of rain after spraying.

8. For apple gall mosquitoes, peach white round shield scales, apple cotton aphids, apple grass aphids, apple leaf bees, apple tiger elephants, European apple tiger elephants, etc., orchards exported to China should monitor pests based on IPM technology according to the characteristics of pests. When these pests are found, they are treated with plant protection products approved in Germany. Germany or its authorized bodies should ensure that these pests are treated appropriately. Growers should keep control records, which will be controlled by the German side in due course.

9. Orchards exported to China shall keep records of orchard pest monitoring and control, and provide them to the Chinese side upon request. The record of chemical control of pests should indicate detailed information, including the name of the chemical used in the growing season, the active ingredient, the date of use and the concentration of use.

(2) Management of packaging plants.

1. The packaging, storage and shipment of apples exported to China must be carried out under the quarantine supervision of the German side.

2. Before packing, apples must be sorted, sorted and processed, small or harmful symptoms or deformed fruits are removed, the surface of the fruit and the calyx of the fruit are cleaned with a high-pressure water gun, or other effective measures are taken to ensure that the fruit is free of insects, mites, rotten fruits, deformed fruits, branches, leaves, roots and soil.

3. After the packaging is completed, under the random supervision of the German side, the staff of the packaging plant who have received training in plant pest inspection should inspect the 600 fruits in each batch of apples exported to China, and 20% of the fruits should be dissected and inspected. Packaging factories must have a photographic sorting system to register for export to China, and Apple can use a camera to conduct visual evaluation at the packaging factory.

4. Packaged apples should be stored separately to avoid re-infection by harmful organisms.

(3) Packaging requirements.

1. Each packing box should be marked with the name of the fruit type, origin (province, city or county), country, orchard, packaging plant and cold treatment enterprise or its registration number in English. Each box and pallet must be marked "Exported to the People's Republic of China" or "Exported to the People's Republic of China" in Chinese or English.

2. The packaging materials of apples exported to China should be clean and hygienic, unused, and meet China's plant quarantine and health requirements. If wood packaging is used, it must comply with the requirements of the International Standard for Phytosanitary Measures No. 15 (ISPM 15).

3. The container containing the apples must be inspected at the time of packing to ensure that they are in good hygienic condition. The activity must be recorded by the German side.

(4) Requirements for quarantine treatment.

1. All apples exported to China should be cold-treated for Mediterranean fruit flies. The technical requirements are as follows: 1.11ºC or less for 14 days, or 1.67ºC or less for 16 days, or 2.22ºC or less for 18 days.

2. The cold treatment shall be carried out in accordance with the operating procedures for cold treatment before export (see Annex 1) or the cold treatment operation procedures during transportation (see Annex 2). Cold treatment during transit can be started before departure and completed after the end of the transportation period at the first port of arrival in China or after the port of entry is extended.

(5) Pre-export inspection and quarantine.

1. Within the first two years of the start of trade, the German side shall conduct a sampling inspection of apples exported to China at the rate of 2% of each consignment, with a minimum sampling volume of 1,200 fruits, and at least 60 of them or suspicious fruits found during the inspection shall be dissected. If no phytosanitary problems occur within two years, the sampling ratio can be reduced to 1%, but not less than 600 fruits.

2. If pear fire blight is discovered, the German side should suspend the qualification of the relevant non-epidemic production sites to be exported to China and immediately notify the Chinese side. When the epidemic is eliminated in Germany, non-epidemic production sites can be restored.

3. If other quarantine pests of concern to the Chinese side are found, the goods shall not be exported to China. The German side should find out the causes and take corrective measures. At the same time, records of seizures are kept and provided to the Chinese side upon request.

(6) Plant quarantine certificate requirements.

1.经检疫合格的苹果,由德方为其签发植物检疫证书,并在附加声明中注明:“This consignment complies with the requirements described in the Arrangement on Phytosanitary Requirements for Export of Fresh Apples from Germany to China, and is free from the quarantine pests of concern to China.” (该批货物符合德国鲜食苹果输华植物检疫工作安排要求,不带中方关注的检疫性有害生物。 )

2. For apples that have been cold-treated before export, information such as the temperature, duration and the name or registration number of the treatment facility should be indicated on the phytosanitary certificate. For cold treatment in transit, the phytosanitary certificate should be marked with "Cold treatment in transit", and the treatment temperature, duration, container and seal number should be indicated.

3. Before the start of trade, the German side should provide the Chinese side with a sample of the phytosanitary certificate in order to confirm the filing.

7. Entry quarantine and unqualified treatment

When apples exported to China arrive at China's entry port, China Customs will carry out inspection and quarantine in accordance with the following requirements.

(1) Verification of relevant certificates and logos.

1. Verify whether the imported fruits have obtained the "Quarantine Permit for Imported Animals and Plants".

2. Verify whether the phytosanitary certificate complies with the provisions of Article 6 (6) of this announcement.

3. Check whether the labels on the boxes and pallets comply with the provisions of Article 6 (3) of this announcement.

4. For the goods that are cold-treated before export, check the cold-treatment report and fruit temperature record signed by the German side, and check whether the cold-treated goods are accompanied by the cold-treated goods during transportation, and whether the cold-treatment report and fruit temperature probe correction record are attached.

(2) Entry inspection and quarantine.

1. Apples exported to China should be imported from ports where China allows the import of fruits.

2. In accordance with the relevant laws, administrative regulations, rules and other provisions, the inspection and quarantine of apples exported to China shall be carried out, and those who pass the inspection and quarantine shall be allowed to enter the country.

(3) Disqualification handling.

1. If apples are found to have come from unregistered orchards, packing plants or cold treatment facilities, the shipment will not be allowed to enter the country.

2. If it is determined that no effective cold treatment has been implemented, the goods will be returned, destroyed or landed for cold treatment (if they can still be carried out in this container).

3. If live Mediterranean fruit flies are found, the goods will be returned, destroyed or decontaminated. The Chinese side will immediately notify the German side and suspend the import of relevant orchards and packing plants. The German side should find out the reasons and implement corresponding improvement measures before the relevant orchards and packing plants can resume exports.

4. If codling moth or pear fire blight is found, the goods will be returned or destroyed. The Chinese side will immediately inform the German side, and the German side should cancel the status of the relevant non-epidemic production sites. The German side should find out the cause and implement corresponding improvement measures so that the non-epidemic production sites can be restored.

5. If other quarantine pests of concern to the Chinese side are found, the goods will be returned, destroyed or decontaminated.

6. If it is found that it does not meet the national food safety standards of China, the batch of goods will be returned or destroyed.
