On April 28, 2024, Xie Baoping's financial and securities team submitted a new batch of claims filed by 603603 Poten Environmental Investors to the Beijing Financial Court. These investors were sent to the dock to demand compensation for losses caused by Poten Environment's previous disclosure of violations of laws and regulations.
Previously, on December 8, 2023, Poten Environment received the Advance Notice of Administrative Punishment and Market Prohibition ([2023] No. 20) issued by the Beijing Supervision Bureau of the China Securities Regulatory Commission. After investigation, the facts of Poten Environment's suspected violations are as follows:
In 2017, Poten Environment inflated its operating income by RMB 347.398 million, accounting for 11.40% of the disclosed operating income in the current period, and inflated its profit by RMB 118.0165 million, accounting for 70.68% of the total disclosed profit in the current period by considering the impact of relevant impairments, and in 2018, it inflated its operating income by RMB 1098.4785 million, accounting for 25.33% of the disclosed operating income in the current period. 1.4473 million yuan, accounting for 223.80% of the total disclosed profit for the current period, in 2019, Poten Environment reduced its operating income by 28.7452 million yuan, accounting for 0.99% of the disclosed operating income for the current period, and took into account the impact of relevant impairments, the false profit was 116.0596 million yuan, accounting for 14.01% of the total disclosed profit for the current period.
In 2020, taking into account the impact of relevant impairment, the inflated profit was RMB49.3916 million, accounting for 11.90% of the total disclosed profit for the current period, and in 2021, taking into account the impact of relevant impairment and investment income adjustment, the fictitious profit was RMB249.4426 million, accounting for 17.37% of the total disclosed profit for the current period. As a result of the above-mentioned matters, there were false records in the annual reports of Poten Environment in 2017, 2018, 2019, 2020 and 2021.
According to the Securities Law and the Several Provisions of the Supreme People's Court on the Trial of Civil Compensation Cases Arising from False Statements in the Securities Market, listed companies shall be liable for civil compensation if their rights and interests are damaged due to illegal information disclosure and misrepresentation, and the injured investors have the right to claim compensation for losses.

Claims can be made if one of the following applies:
1. Buy 603603 Poten Environment between April 28, 2018 and March 30, 2023.
Sell or hold on or after March 31, 2023;
2. Those who bought 603603 Poten Environment between June 19, 2020 and March 30, 2023, and sold or held it after March 31, 2023 (inclusive).
