This case is another major crime involving drug-related and evil forces that the "two chiefs" of the Sichuan Provincial Judicial Procuratorate led after handling the extraordinarily large "family-style" and "crowdfunding" drug trafficking and transportation cases.
On August 27, 2020, the Sichuan Provincial Higher People's Court held a public hearing at the Panzhihua City Intermediate People's Court to hear the original defendant Wang Tao and others for intentional injury, drug trafficking, forcing others to take drugs, and accommodating others to take drugs.
Wang Shujiang, president of the Sichuan Provincial High People's Court and second-level chief justice, served as the presiding judge, and Feng Jian, chief procurator of the Sichuan Provincial People's Procuratorate and second-level chief procurator, appeared in court to perform his duties.
In this case, the criminal group of evil forces with Wang Tao as the leading member has long been selling drugs in Panzhihua City, allowing others to take drugs, and controlling the use of minors An Moujia and An Mouyi as criminal tools, forcing them to take drugs, sell drugs, and wantonly mutilate them, which eventually led to the death of a minor and multiple injuries to the whole body of a minor. The organization sold drugs semi-openly, and for a long time carried out illegal and criminal acts such as beatings and abuses against the minors under its control, and the residents of the community were psychologically panicked, and even did not dare to report them for fear of retaliation, which seriously disrupted the order of local social life. After the first-instance judgment was pronounced, the Panzhihua Municipal People's Procuratorate filed a protest, and Wang Tao and three other defendants appealed.
The Sichuan Provincial People's Procuratorate has set up a case handling team with Chief Procurator Feng Jian as the presiding procurator to investigate and verify the focal issues of the case, such as the grounds for protest and the grounds for appeal. The case-handling team reviewed a large number of materials involved in the case, supplemented and improved multiple sets of evidence; inspected the scene of the crime, reviewed key witnesses and discovered new clues, carried out peripheral visits and investigations, fixed the testimony of key witnesses, and consolidated the evidence base for the second-instance trial of the case to support the protest.
After review, the Sichuan Provincial People's Procuratorate decided to support the counter-prosecution. On August 27, 2020, Feng Jian attended the court of second instance and expressed his opinion in support of the counter-prosecution and the opinion on appearing in court on behalf of the procuratorate.
On November 5, 2020, the Sichuan Provincial High People's Court publicly pronounced a verdict at the Panzhihua City Intermediate People's Court on the case of Wang Tao and four other people involved in a criminal group involved in narcotics and evil forces who intentionally injured and killed minors in accordance with law.
The second-instance judgment fully adopted the procuratorial organs' counter-appeal opinions and Feng Jian's second-instance trial opinions, and changed the sentence to defendant Wang Tao's death sentence to be immediately executed, deprived of political rights for life, and fined 80,000 yuan; sentenced the remaining three defendants to five years' imprisonment to life imprisonment. After the verdict was pronounced, the Supreme People's Court approved Wang Tao's death sentence after the statutory review procedure.
