Road Traffic Safety Law of the People's Republic of China

Article 100 Where a motor vehicle assembled or a motor vehicle that has reached the scrapping standard is driven on the road, the traffic management department of the public security organ shall confiscate it and force it to be scrapped.

Drivers who drive the motor vehicles listed in the preceding paragraph on the road shall be fined not less than 200 yuan but not more than 2,000 yuan, and the driver's license of the motor vehicle shall be revoked.

Whoever sells a motor vehicle that has reached the scrapping standard shall confiscate the illegal gains and impose a fine of the same amount as the amount of the sale, and the motor vehicle shall be disposed of in accordance with the provisions of the first paragraph of this Article.

Regulations on the Application and Use of Motor Vehicle Driver's Licenses

Article 13 In any of the following circumstances, an application for a motor vehicle driver's license shall not be made:

(1) There are organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, tremor paralysis, mental illness, dementia, and neurological diseases that affect limb activity, or other diseases that hinder safe driving;

(2) Where there have been acts of drug consumption or injection within three years, or measures to lift compulsory isolation for drug rehabilitation are less than three years, or long-term addiction to dependent psychotropic substances has not been rehabilitated;

(3) Fleeing after causing a traffic accident constitutes a crime;

(4) Where a major traffic accident occurs after drinking alcohol or driving a motor vehicle while drunk, constituting a crime;

(5) Driving a motor vehicle while drunk or driving a motor vehicle after drinking alcohol and having a motor vehicle driver's license revoked in accordance with law for less than five years;

(6) Driving a motor vehicle while operating a motor vehicle while drunk has had its motor vehicle driver's license revoked for less than 10 years in accordance with law;

(7) Where a motor vehicle driver's license has been revoked for less than two years due to other circumstances in accordance with law;

(8) Where the driver's license has been revoked for less than three years in accordance with law;

(9) Other circumstances provided for by laws or administrative regulations.

A person who drives a motor vehicle without obtaining a motor vehicle driver's license and commits any of the acts in items 5 to 7 of paragraph 1 shall not apply for a motor vehicle driver's license within the prescribed time limit.
