Zheng Moulu was originally a police officer of the special police detachment of the Wuhai City Public Security Bureau in Inner Mongolia, who had been addicted to online gambling for a long time, and had a conflict with his wife Wang Moumou, who proposed a divorce. Recently, a second-instance criminal ruling published by the China Judgment Documents Network disclosed the above-mentioned "attempted wife killing" case. In July 2018, the Haibowan District Court of Wuhai City, Inner Mongolia rendered a first-instance judgment on the case, and Zheng Moulu appealed. In September 2019, the Intermediate People's Court of Wuhai City, Inner Mongolia, revoked the first-instance judgment and remanded the case for retrial.

In January 2020, after being designated by the Inner Mongolia Higher People's Court for jurisdiction, the case was accepted by the Inner Mongolia Alxa Left Banner Court. In December 2020, the Alxa Left Banner Court held that Zheng Moulu had committed intentional homicide and gun snatching, and was punished for several crimes at the same time, and decided to execute a fixed-term imprisonment of 10 years. Zheng Moulu was not satisfied and appealed. In March 2021, the Alxa League Intermediate Court rejected the appeal in the second instance and upheld the original judgment.

The Paper (www.thepaper.cn) noted that when the court tried the case, it found that before the incident, Zheng Moulu repeatedly used his mobile phone to search and browse relevant information such as "driving a cliff", "how to open the golf sunroof", "does the husband kill his wife to compensate the woman", and drove down the observation deck to cause a car accident at the time of the crime, and did not take braking measures.

After killing his wife unsuccessfully, Zheng Moulu tried to cover up his crime. According to Wang Moumou's recollection, she once said to the police, "Let Zheng Moulu not come near me, he will kill me", but Zheng Moulu took her hand and said, "Wife, are you stupid, how to talk nonsense." When she was sent to the hospital for treatment, Zheng Moulu knelt down and shouted "Save my wife" as soon as she entered the hospital.

Deliberately causing a car accident with the intention of killing his wife

The above ruling shows that Zheng Moulu was born in 1989, university culture, and was a police officer in the special police detachment of the Wuhai City Public Security Bureau in Inner Mongolia before the incident.

On November 10, 2017, Zheng Moulu drove a white golf sedan to carry his wife Wang Moumou to the parking lot halfway up the mountainside of the Gander Mountain Scenic Area in Haibo Bay District, Wuhai City, and Zheng Moulu deliberately drove the vehicle down the hillside from the parking lot, and the vehicle hit the obstacle and stopped, and the airbag in the car popped out. Zheng Moulu saw that Wang X's body was not in serious trouble, so he dragged Wang X out of the car and took the form of pinching his neck and hitting his head with stones many times, causing Wang X to fall unconscious after multiple injuries to his head, hands and body.

After Wang Moumou was unconscious, Zheng Moulu lied that he had a car accident and called Zhang Moumou, a police officer of the special police detachment of the Wuhai City Public Security Bureau, who was on duty, for help. After that, the special police Zhang xx, Tian xx, Ba xx arrived at the scene, just when Wang xx woke up and called for help, Zheng xx lu saw the situation and openly snatched the 92-type pistol worn by the special police officer Zhang xx, snatched the 97-2 type riot gun worn by the special police officer Tian xx, the swat police Zhang xxx verbal warning was invalid after the gun was fired to warn, and the special police ba xxx subdued Zheng xx.

The next day, Zheng Moulu was detained by the police on suspicion of intentional homicide, gun snatching and theft.

After identification, there were more than 20 sutured wounds on Wang's head and face, with a cumulative length of 470px, and the degree of injury belonged to the second degree of minor injuries; Wang's injury was caused by the external force of trauma.

The ruling disclosed that Zheng Moulu had been addicted to online gambling for a long time, and after marriage, the two often quarreled over this matter and other family trivial matters, and his wife Wang Mou proposed divorce to him.

Wang's account is that she and Zheng registered their marriage in October 2016. Before that, Zheng Moulu owed her a lot of money. On the evening of November 9, 2017, she and Zheng Moulu filed for divorce, asking Zheng Moulu to pay off the money owed to her. Zheng promised to give her the house, saying it was owed to her and her daughter. The next day, Zheng Moulu said that he would go to the notary office to notarize the house to her, and said that he had borrowed money from the lending company and wanted to repay her 100,000 yuan. After that, they left together in the car, ready to do the notarization of the property, and then the case occurred.

Wang Recalled that while waiting for the traffic light, Zheng Moulu suddenly asked her "Do you regret marrying me", and she said "Do you still have to ask this". After that, Zheng Moulu suddenly said "don't live" and then drove down the bottom of the hillside. Due to the airbag popping out, she was not in serious trouble, ready to open the car door to run, and was beaten by Zheng Moulu. She has been begging for forgiveness, but Zheng Moulu said, "I can only live today if you die, you must die today."

Wang Moumou said that she had said to the police, "Let Zheng Moulu not come near me, he will kill me", but Zheng Moulu took her hand and said, "Wife, are you stupid, how nonsense?" When she was sent to the hospital for rescue, Zheng Moulu knelt down and shouted "Save my wife" as soon as she entered the hospital.

The claim of unintentional homicide was not accepted by the court

Zheng Moulu appealed against the above judgment. The Paper noted that when Zheng Moulu and his defender appealed, they pointed out that Zheng Moulu subjectively did not have the intention to kill people, and objectively did not carry out the act of depriving the victim of his life, and his behavior should be guilty of intentional injury. Zheng Moulu took the initiative to stop the criminal act in the process of harming the victim, which is the suspension of the crime. Zheng Moulu took the initiative to report the crime after committing a crime, truthfully confessed the fact that he beat the victim, and had the circumstances of surrendering voluntarily. In addition, Zheng Moulu", "the purpose of touching the gun is to kill himself", did not take the act of taking advantage of people without preparation or blatantly snatching the gun, which is not harmful to others and society, which constitutes the crime of snatching guns and is a criminal suspension. After the incident, truthfully confessing the fact that he touched the gun shall be deemed to have surrendered voluntarily.

In this regard, the second instance trial of the Alxa League Intermediate Court held that after investigation, Zheng Moulu had been addicted to online gambling for a long time, and the husband and wife often quarreled over family trivial matters, and the relationship between the two was not harmonious. Before the incident, Zheng Moulu searched through the mobile phone web page for "husband killed his wife after committing suicide, need to compensate the woman", "husband killed his wife to compensate the woman", "driving off a cliff", "golf GTI skylight how to open" and other content, combined with the process of the case, it is enough to prove that Zheng Moulu had the subjective intention of premeditated to kill Wang X, objectively carried out the act of illegally depriving the victim of life, met the constituent elements of intentional homicide, and should be convicted and punished as intentional homicide. The court did not accept the defense opinion that "the purpose of touching the gun was to kill oneself, and the act of not taking advantage of the person or blatantly snatching the gun" was not adopted.

The Alxa League Intermediate People's Court held that Zheng Moulu, due to a family dispute, intended to illegally deprive the victim of his life, deliberately created the illusion of a car accident, and used methods such as neck pinching and stone to hit the victim's head to intentionally kill the victim, causing the victim minor injuries, and his act constituted the crime of intentional homicide. In order to prevent the crime from being exposed, Zheng Moulu openly snatched the gun of the special police and endangered public safety, and his behavior has constituted the crime of snatching a gun. In March 2021, the Alxa League Intermediate Court rejected the appeal and upheld the original judgment.
