Before the start date of the fishing, I bought the "Hairy Crab of Yangcheng Lake"?! The merchant argued that the crabs they sold were produced in Yangcheng Lake, and the hairy crabs in Yangcheng Lake were "Hairy Crabs in Yangcheng Lake". What are the facts?
Mr. Lu said that on September 19, he bought more than 20,000 yuan of "Yangcheng Lake Hairy Crab" at a company in the urban area because of the need to visit relatives and friends during the Mid-Autumn Festival. Unexpectedly, after eating it, relatives and friends responded that the quality of crabs was not as good as the hairy crabs of Yangcheng Lake that had been purchased in the past.
Mr. Lu learned through official channels that the catch of hairy crabs in Yangcheng Lake this year was on September 21. After comparison, the crab buckle worn by the "Yangcheng Lake Hairy Crab" purchased by him is also inconsistent with the anti-counterfeiting crab buckle issued by the official. Mr. Lu suspected that the Hairy Crab of Yangcheng Lake sold by the merchant was a counterfeit, so he complained and reported to the Liangxi District Market Supervision and Administration Bureau.
After understanding the situation, the law enforcement personnel of the Liangxi District Market Supervision Bureau rushed to the company involved to investigate. After investigation, the company is actually a member of the Yangcheng Lake Crab Industry Association (hereinafter referred to as "Ba association") in Bacheng Town, Kunshan City, and the hairy crabs sold are purchased from the crab farmers in Bacheng Town. When investigated, the head of the company argued that Bacheng Town belonged to the waters of Yangcheng Lake, and the hairy crabs it purchased from crab farmers were also hairy crabs in Yangcheng Lake, and there was no problem in selling them as "Hairy Crabs in Yangcheng Lake".
Is the merchant's defense valid? To this end, the law enforcement personnel of the Liangxi District Market Supervision Bureau have repeatedly rushed to Suzhou to carry out investigations.
"Yangcheng Lake hairy crab" is approved by the Ministry of Agriculture and Rural Affairs of agricultural products geographical indication, Suzhou Yangcheng Lake Hairy Crab Industry Association (hereinafter referred to as the Suzhou Association) as the registration certificate holder, in order to ensure the quality of "Yangcheng Lake hairy crab", the Suzhou Association has formulated a relatively strict membership conditions and Yangcheng Lake hairy crab production, quality and safety technical specifications and other quality control system.
According to the relevant regulations, the sales of hairy crabs in two situations can be in the name of "Yangcheng Lake hairy crabs":
● Units that become members of the Association of the Soviet Union in accordance with the relevant requirements of the Soviet Union association and strictly implement the control system of related products, and sell hairy crabs produced within the protected area of Yangcheng Lake;
● Hairy crab farmers in the protected area of Yangcheng Lake produce and sell themselves in accordance with relevant regulations.
Law enforcement officials learned that because the hairy crab production area of Yangcheng Lake belongs to different administrative regions, there are other industry associations in the Yangcheng Lake Basin, including the Ba Association. The Association clearly stipulates that its member units can only sell in the name of "Bacheng" hairy crabs, and cannot be sold in the name of "Yangcheng Lake hairy crabs".
In view of the fact that the parties, as members of the Pakistan Association, engaged in the sale of hairy crabs in the name of "Hairy Crabs in Yangcheng Lake", which was easy to mislead consumers and suspected of unfair competition, the Liangxi District Market Supervision and Administration Bureau filed a case against them. The case is currently under further investigation.
The consumer protection commissions of Wuxi, Suzhou, Changzhou and other five places around Taihu Lake issued investigation reports and related consumption reminders:
Nearly 50% of the samples are short of two pounds, and the model price routine is still playing
The survey results show that the more prominent problems are mainly concentrated in four major aspects: the model price confuses the public; the lack of two pounds; the appointment time is long; the after-sales claim process is cumbersome, and it is difficult for consumers to protect their rights.
On October 29 this year, the Consumer Protection Commission of Jiangsu Province issued the "Specifications for the E-commerce Sales and Service of Hairy Crabs" (hereinafter referred to as the "Specifications"), which specifically regulates the weight of hairy crabs and the labeling of crab coupons for online shopping.
Weight labeling: The Specification requires that the weight of commercial crabs should be the net weight of a single product of hairy crabs (excluding the weight of commodity labels, strapping ropes and prepackaged materials), and the error of a single crab should not exceed 7% of the net weight. If the consumer finds that the weight (including water loss rate) of a single hairy crab is more than 7% after delivery, the online operator shall refund the single commodity crab in full.
From the overall sample of this survey, 196 of the 414 hairy crab samples have a water loss rate greater than 7%, and nearly 50% of the hairy crab samples are short of two pounds; from the perspective of the distribution of various platforms, the average water loss rate of hairy crabs sold by Suning self-operated, Taoxianda, Jingdong, Daily Excellent Fresh, Hema Fresh, Tmall, SF Preferred, and Pinduoduo is greater than that stipulated in the Code.
Crab card (coupon) labeling: The "Specification" requires that the use methods and rules of crab cards must include the validity period of crab cards (not less than 2 years of crab season), brand name and price, product specifications and models (how many males and females are packed and how many weights are single) and the place of origin.
However, the survey found that there are still some platform merchants who mix the model with the price, for example: some crab card models are 1288 types, and the original price displayed on the platform is 1288 yuan, but the actual price is less than 400 yuan.
Reminder: Online crab cards need to pay attention to the labeling information
When purchasing, you should pay attention to whether the real name and contact information of the enterprise are marked in the crab card (coupon), whether the number and size of hairy crabs contained are clearly indicated, and make an appointment to redeem as soon as possible.
When purchasing fresh hairy crabs and other fresh crabs online, you should choose to sign in person, check the freshness of hairy crabs in time when signing, such as dead crabs, etc., you can directly refuse to accept them; in case of lack of weight, shoddy and other situations, take photos in time to leave a certificate, and negotiate with merchants and platforms for compensation.
