Start from the subtleties and let the doctor do live broadcast to avoid the benefits and harms

Author: Qiu Shi

"It's so common that not only many of the doctors in our hospital are doing live broadcasting, but so are other hospitals, but few people have considered the boundaries of live broadcasting." As a middle-level manager of a well-known hospital in China, Sun Ting (pseudonym) is worried about more and more peers around her investing in live broadcasting. With the development of Internet medical and social platforms, more and more doctors choose to conduct medical science through live broadcasting, but the risks and hidden dangers are rarely noticed. Questions such as where the boundaries of the doctor's live broadcast are confusing to hospital administrators.

Doctors do live broadcasts with a reasonable and beneficial side. Because live streaming is intuitive, it is very interactive and interesting. The advantages of live communication between doctors and patients are obvious. In recent years, many popular medical short videos have appeared. However, the risks and hidden dangers of doctors doing live broadcasting cannot be ignored, doctors live broadcast while working, and it is easy to reduce the quality of medical treatment and even make mistakes; live broadcasting is also easy to expose patient privacy, and live broadcast teaching people self-diagnosis and treatment may mislead fans, misdiagnosis and mistreatment.

Comparing the two versions of the "Doctor Law" between the new and old, it can be seen that doctors need to take some measure to do live broadcasting. Article 22 of the old "Law on Practicing Physicians" makes it clear that "health education for patients" is the obligation of doctors, and Article 23 of the new "Physician Law" implemented from March 1, 2022 amends this article to "health education and health guidance for patients and the public", the object adds "public", the content adds "health guidance", indicating that the doctor's science popularization publicity has been added to the burden, the traditional science popularization method is inefficient, the impact is small, and it is difficult to meet the needs of medical science popularization in the new era. Improving the efficiency of medical science popularization through new media such as live broadcasts and WeChat public accounts is itself worth advocating.

In addition, the old "Practicing Physician Law" requires doctors to "protect the privacy of patients" and "publicize health care knowledge", while the new "Physician Law" changes these two articles to "protect patients' privacy and personal information according to law" and "publicize and promote health science knowledge suitable for posts". The addition of keywords such as "personal information" and "adapting to the post" has strictly restricted the popularization of science such as doctors' live broadcasts.

For doctors to do live broadcasts to avoid benefits and harms, the key move is to do things in detail. On the one hand, it is necessary to understand the spirit of legislation in the subtleties of existing policies and regulations, and then find a breakthrough in the resolution of disputes and eliminate ambiguous space; on the other hand, it is difficult to cover all aspects of regulations after all, and it is necessary to refine relatively abstract regulations into industry norms, and even the internal management system of medical institutions, and use the thin line of the system to fill loopholes and make the two closely integrated.
