The Beijing Court Trial Information Network recently published the first-instance civil judgment of the dispute between Beijing ByteDance Network Technology Co., Ltd. and Beijing iQIYI Technology Co., Ltd. for infringement of the right to disseminate the information network of works, and the Beijing Internet Court ordered iQIYI to compensate ByteDance for economic losses of 50,000 yuan and notary fees of 1,000 yuan for lawyers' fees of 10,000 yuan.

According to the Tianyancha App, ByteDance has the exclusive information network dissemination right of the TV series "Little Soldier Zhang Ga" (starring Xie Mengwei and others), and later found that the iQIYI website provided all the episodes of the TV series involved in the case without authorization, and claimed 300,000 yuan for this.

iQIYI argued that ByteDance could not prove that it had obtained a complete and valid authorization from the copyright owner of the work in question. The video involved in the case was uploaded by the user, and iQIYI sued that it was only an information storage space service provider, and had fulfilled its reasonable obligations and should not bear any legal responsibility.

The Beijing Internet Court found that iQIYI did not disclose the user information of the account "Sweet Sauce Duck Video" involved in this case, so it could not confirm that the infringing content was uploaded by the user, and could not rule out the possibility that it provided the video content as a platform operator, and did not apply to the "notice-delete" rule. iQIYI constitutes an infringement of the right of information network dissemination enjoyed by the works involved in the ByteDance case and shall bear legal responsibility, and the above judgment was made in the first instance not long ago.
