The procuratorial organs alleged that defendant Xu Kang, together with others, organized and led a crowd to fight (without success); that he joined hands with many people to beat others at will, causing minor injuries to two people; that he insulted others, and that the circumstances were heinous; that his conduct violated the first paragraph (4) of article 292, the first paragraph of article 293, the first paragraph (1), (2), and the first paragraph of article 25 of the Criminal Law of the People's Republic of China, and that the facts of the crime were clear, the evidence was credible and sufficient, and he should be investigated for criminal responsibility for the crime of gathering a crowd to fight and picking quarrels and provoking trouble, and should be punished for several crimes.

After trial by the court, the Funan County People's Court convicted Xu Kang of the crime of gathering a crowd to fight, picking quarrels and provoking trouble, and punished him for both crimes, and decided to jointly execute the fixed-term imprisonment of three years and four months.
