First, the basic situation of unqualified food

2. Verification and disposal
(1) The investigation and handling of the supervision departments
On August 11, 2020, the law enforcement personnel of the Hainan Provincial Market Supervision and Administration Bureau launched the verification and disposal of unqualified food and took the following measures: first, timely delivery of the inspection report; second, on-site investigation; and third, the record of the parties' questioning. After investigation, the parties produced two batches of unqualified edible blended oil (the first batch of production date: 2021-05-02, 186 bottles, net content: 1.8 liters / bottle; the second batch of production date: 2021-08-02, 36 bottles, net content: 1.8 liters / bottle) a total of 222 bottles, the total value of the product is 4558 yuan. Among them, the parties have sold 20 bottles for supervision and sampling inspection of 6 bottles, with a sales amount of 538 yuan and 538 yuan of illegal gains.
(2) Product control
The 164 bottles of substandard edible blending oil (production date: 2021-05-02) recalled by the parties concerned have been seized. In the company's warehouse, production workshop, etc., 27 bottles of unqualified edible blending oil (production date 2021-08-02) were found to have been seized on the spot. Law enforcement officials require the parties to immediately investigate the reasons for the unqualified products and immediately rectify them.
(3) The circumstances of investigation and handling of illegal conduct
The parties' production and operation of edible blended oil that does not meet the national food safety standards violates the provisions of Article 34, Item 13 of the Food Safety Law of the People's Republic of China.
In accordance with the provisions of the second paragraph of Article 124 of the Food Safety Law of the People's Republic of China, after notification, statement of defense, etc., the Hainan Provincial Market Supervision and Administration Bureau gives the parties the following administrative penalties:
1． Confiscation of 191 bottles of edible blending oil;
2． Confiscation of illegal gains of 538 yuan;
3． Fined 75,000 yuan;
The above fines and forfeitures totaled 75,538 yuan.
(4) Investigation of causes and rectification of enterprises
The parties have investigated the causes of the problem and believe that the reasons for the unqualified products are that they are not familiar with the relevant food safety standards in advance, do not know the harm of ethyl maltol, and have insufficient understanding of the purchase account records. The parties concerned have decided to take corrective measures to stop producing edible blended oil that does not meet national food safety standards.
