In order to take the mobile phone of a neighbor 8-year-old boy Xiaoyuan (pseudonym), 15-year-old Xiao Nie (pseudonym) lied about buying toys and tricked Xiaoyuan into robbing him with a knife in a remote place, causing him minor injuries. On September 2, the Xiaoshan District Court in Hangzhou sentenced defendant Xiao Nie to three years in prison for robbery.
Xiao Nie is a native of Anhui, dropped out of school in the second year of junior high school, because he was addicted to mobile phone games, and was smashed by his father. After the Spring Festival this year, Xiao Nie's family went to Xiaoshan to work, and his mother found him a job, but within a few days he was expelled for laziness. Xiao Yuan and Xiao Nie live in a building, and Xiao Nie often borrows Xiao Yuan's mobile phone to play games, and the idea of occupying the mobile phone was born. On the evening of April 29, Xiao Nie took two fruit knives and carried them on his body in the rented accommodation, and under the guise of taking money to borrow Xiao Yuan to buy a toy gun, he deceived him into a remote part of a village cultural square, falsely claimed that there was money on the ground, and took advantage of Xiao Yuan's search to throw him down, ride on him, and choke his neck. Xiao Yuan resisted and called for help, and Xiao Nie took out a fruit knife and stabbed him in the neck, snatching the mobile phone and fleeing. The villagers rushed to hear the call for help, found Xiao Yuan with a knife wound on the neck, and then fainted.

After being rescued by the hospital, Xiaoyuan was out of danger, and Xiao Nie was quickly captured. After identification, Xiao yuan constituted a minor injury of the second degree, and the value of the mobile phone was 150 yuan. According to the procurator handling the case, the Criminal Law stipulates that if the crime of robbery is committed, those over the age of 14 must bear criminal responsibility, and Xiao Nie, who was 15 years old when committing the crime, robbed others of their property by violent means and caused injuries to one person, should be investigated for criminal responsibility for the crime of robbery.
