Mandatory paternity leave for men is achieved through the improvement of the legal system of paternity leave for men.

In Jin Li's view, the male paternity leave system can enhance women's willingness to have children, ensure the smooth implementation of population policies, and enable stable and orderly economic and social development. In addition, the male paternity leave system can alleviate the dilemma of "birth" and "promotion" faced by women of childbearing age, reduce social discrimination against women's employment, reduce women's reproductive burden, balance the impact of biological gender differences on the labor force, and change the discrimination of some leaders against female employees' career promotions.

So how to achieve paternity leave for men? Jin Li gave three specific suggestions in the proposal: First, to improve the legal rank. Jin Li pointed out in the proposal that one of the main reasons for the poor implementation of paternity leave in China is that the effectiveness level of paternity leave is low. The current paternity leave system is not provided for in national legislation, but is scattered in the Population and Family Planning Regulations of the various provincial administrative units. In practice, employers often unilaterally believe that they only need to comply with the national laws with the highest effect, rather than local regulations. Only by incorporating the paternity leave system into national legislative documents can social groups enhance their awareness of paternity leave and take the initiative to protect their rights.

Second, solve the management gap. Strengthen the punishment of illegal acts of enterprises, and for employers to infringe on the rights of employees with paternity leave, punitive support clauses must be stipulated in laws, administrative regulations and local regulations to form a systematic supporting system and guarantee system. "At a practical level, in the absence of a clear penalty system, local authorities face a situation of inability to deal with enterprises that do not implement paternity leave. In particular, for non-public enterprises and small and medium-sized enterprises, the implementation of the paternity leave system relies more on the law-abiding awareness of business owners than on the mandatory provisions of the law. Jin Lee pointed out in the proposal that the lack of supervision has caused the implementation of the paternity leave system to be poor.

Third, it is also necessary to reduce the burden on enterprises. Jin Li pointed out that at present, in addition to maternity leave, all kinds of marriage and maternity leave in China are borne by enterprises, which has caused a certain burden on enterprises. Considering the actual situation of China's enterprises, the state should standardize the scope of welfare benefits from the formulation of laws, regulations and policies, give certain subsidies for rights protection holidays, and share certain economic pressure for enterprises. Specifically, we will further expand the scope of regulations on the application of maternity insurance, add provisions on the scope of application of male maternity insurance, and promote tax reductions and exemptions for enterprises that fulfill the paternity leave system.
