On March 20, the Beijing First Intermediate People's Court publicly pronounced a verdict in the case of defendant Li Jialin for fraud and contract fraud, and the court sentenced Li Jialin to life imprisonment for fraud in the first instance; Sentenced Li Jialin to life imprisonment for contract fraud, and decided to carry out life imprisonment, deprive him of political rights for life, and confiscate all personal property. After the price change of a set of real estate on North Fourth Ring East Road in Chaoyang District, which was seized in the case round, it was returned proportionally to the victims Sun X, Hao X, Jiang X and Yan X.
Recently, the Beijing Municipal Higher People's Court upheld the verdict of the court of first instance sentencing Li Jialin to life imprisonment.
Li Jialin, 37, the legal representative of Beijing Sujing Restaurant Management Co., Ltd. and Beijing Jinbi Jialin Jewelry Trading Co., Ltd., was sentenced to 11 years in prison for contract fraud.
At 10:40 a.m., defendant Li Jialin was taken into court by the bailiff. After trial by the court, it was ascertained:
1. From 2011 to 2012, Li Jialin defrauded the victim Sun of 5.5 million yuan on the pretext of jointly investing in the construction of a property located in the Gaobeidian Brigade in Chaoyang District, Beijing, and then selling or operating it, using a forged house ownership certificate and a state-owned land use certificate
2. In June 2012, Li Jialin defrauded the victim Hao of 1 million yuan on the grounds that he needed funds for house renovation and used a forged copy of the house ownership certificate and the state-owned land use certificate as a bait to pay high interest.
3. From November 2010 to December 2012, Li Jialin borrowed RMB 2.6 million from the victim, Jiang Mou, by paying high interest as bait. Under Jiang's repeated reminders, in order to return the arrears, Li Jialin used a forged house ownership certificate to entrust Jiang to repay the loan after selling the property on North Fourth Ring East Road in Chaoyang District under his name, but secretly handled the property for the highest mortgage loan for the house, and defrauded Jiang of a total of 2.6 million yuan.
4. From June 2012 to February 2013, Li Jialin falsely claimed to sell the property on North Fourth Ring East Road in Chaoyang District, Chaoyang District, to the victim Yan, concealed the fact that he had entrusted the above-mentioned property to others to sell and secretly handled the maximum mortgage loan for the house, used a forged house ownership certificate, signed a contract with Yan for the sale and purchase of existing houses, etc., and defrauded Yan of 3.93 million yuan. On February 22, 2013, Li Jialin was arrested and arrested.
According to Li Jialin's confession, this all stemmed from the investment in a piece of land located in Gaobeidian with 30 years of use rights, she and the victim Sun Mou had known each other in 2008, and were ready to start cooperation in 2009" At that time, I already had my own restaurant, and there was also the property of Qianhe Homestead, and Sun Mou was preparing to come to Beijing for the first time to develop..." Li Jialin said that Sun Mou mainly wanted to transfer the family's property to Beijing, so the two of them worked together to do business, whether it was making money or losing money, the two were five-to-five. In the land investment of Gaobeidian, the two agreed to invest 5.5 million yuan each to develop the land, but Sun did not intervene in the specific management of the land. Li Jialin said that she did not know that there were a series of problems with the real estate certificate and land certificate of the land since then, and Sun Mou was defrauded by Li Jia in the indictment for exactly 5.5 million yuan.
Li Jialin claimed to renovate the restaurant located on the ground, and the victim Hao invested 1 million yuan, which is also the amount of money that Hao was defrauded of since then, as for defrauding the victim Jiang of 2.6 million yuan, Li Jialin said that Jiang's friend owed her own money, and she used this method to get back the money owed.
It is also understood that in terms of accusing him of contract fraud, Li Jialin said that Yan knew that his house still had tenants, and there was a mortgage loan in the house, and Yan also collected 90,000 yuan in rent, and there was a loan demand between both sides at that time. She herself admitted to collecting 3.7 million yuan from Yan, but did not give Yan a real estate certificate, during which she was still entrusting the victim Jiang to sell the property. In Li Jialin's view, the house sale was not successful because of various small accidents, when the house was bought and sold, the house was signed 3 times online, the first time was because Li Jialin had used the name Wang Rui's relationship could not be signed online, the second time was a problem with the amount of the online signature, and the third time was because the intermediary company mistyped its own gender. "If it were not for these accidents, the house would have been transferred long ago, and once the house is successfully bought and sold, the house can be repaid at any time."
As for the whereabouts of the house money that defrauded Yan, Li Jialin said that it was used in the operation of a certain construction site in her company, and now the money has not been returned to the victim, Li Jialin said that she has other claims that can be recovered through litigation and used to repay. The judge asked Li Jialin if she had any existing property to return, but Li Jialin still took out the property of Qianhe Homestead, which had deceived the two victims in the case, and said that her house had appreciated and could be auctioned to pay off the debt.
After trial, the First Intermediate People's Court held that defendant Li Jialin fabricated facts, concealed the truth, and defrauded the victim of his property for the purpose of illegal possession, and his conduct constituted the crime of fraud. Li Jialin also defrauded the victims of their property in the process of signing and performing the contract for the purpose of illegal possession, and his conduct has constituted the crime of contract fraud. The crimes of fraud and contract fraud committed by defendant Li Jialin are particularly huge in amount and the circumstances are particularly serious, and they should be punished according to law and punished for several crimes at the same time. Li Jialin was sentenced to fixed-term imprisonment for an intentional crime, and if, within five years after the completion of the criminal punishment, he again intentionally committed a crime that should be sentenced to fixed-term imprisonment or above, and is a repeat offender and shall be given a heavier punishment in accordance with law. The fine that Li Jialin had been sentenced to for the crime had not been paid and should be punished together with the punishment imposed for the crime.
Accordingly, the First Intermediate People's Court rendered the above-mentioned first-instance judgment. After the verdict, the defendant Li Jialin said in court that he wanted to appeal.
