Recently, the basic level court of Hongshilin District of Jilin Province applied the expedited procedures in accordance with the law to conclude a case of illegal hunting of wild pheasants, and sentenced defendant Zou X to a fine of 10,000 yuan.
After trial, the court found that the defendant Zou X, in order to eat wild game, drove an off-road vehicle to the Maoshan Forest Shiye Area of the Hongshi Forestry Bureau on November 8, 2020, using an electronic trapping tool "electromedia" to imitate the sound of a pheasant, and when he attracted a pheasant to a close place, he used a slingshot to shoot the pheasant, and after hunting it, it was put into a woven bag and stored in the trunk of the off-road vehicle he was driving, and was seized by the public security organs during inspection on the way back.
After the defendant was caught by the public security organs, he truthfully confessed to the crime of hunting a pheasant in the same way in October 2020, and the pheasant that was hunted has been taken home to eat.
After the incident, the steel balls, slingshots, electronic trapping tools "electronic media" and remote control, hunting nets, and baby chickens held by defendant Zou X were seized by the public security organs in accordance with the law, and the pheasants he hunted had died, and the wildlife was identified by the Wildlife Conservation Association of the Hongshi Forestry Bureau as a pheasant of the national "three haves" wild protection animal. The Wildlife Conservation Association of the Redstone Forestry Bureau has treated pheasant carcasses harmlessly.
After trial, the court held that defendant Zou X violated hunting regulations by using prohibited tools and methods to hunt during the hunting ban period and in the forbidden hunting area, destroying wildlife resources, and the circumstances were serious, and his behavior had constituted the crime of illegal hunting. The facts of the public prosecution's charge of illegal hunting are clear, the evidence is credible and sufficient, the charges are established, and the sentencing recommendation is appropriate and should be adopted. The court rendered the above judgment in accordance with the law.
