Measures for the Management of Intellectual Property Development Support Funds in Chongming District

Chapter I: General Provisions

  Article 1 In order to implement the Outline for the Construction of a Strong Intellectual Property City in Shanghai (2021-2035) and the 14th Five-Year Plan for the Protection and Use of Intellectual Property Rights in Shanghai, improve the ability to create, use, protect, manage and serve intellectual property rights, improve the incentive mechanism for innovation, continuously optimize the business environment, and provide strong support for the high-quality construction of a world-class ecological island. These measures are formulated in accordance with the Patent Law of the People's Republic of China, the Trademark Law of the People's Republic of China, the Regulations of Shanghai Municipality on the Protection of Intellectual Property Rights and other laws, regulations and relevant policy requirements, combined with the actual situation of the district.

  Article 2 The intellectual property rights referred to in these Measures include patents, trademarks and geographical indications (geographical indications and geographical indication products registered as collective trademarks and certification marks).

  Article 3 The intellectual property development support fund refers to the financial support funds arranged in the district-level fiscal budget to provide subsidies to the applicants for the support funds to carry out intellectual property related work, and the amount is in RMB.

  Article 4 Applicants for support funds refer to enterprises, professional farmer cooperatives, non-governmental organizations, etc., registered in Chongming, as well as public institutions registered in Chongming. If there are multiple right holders of an intellectual property right right, the applicant for support funds shall be the first right holder.

  Article 5 The district intellectual property department is responsible for the preparation and implementation of the budget for support funds, is responsible for the progress, performance, safety and standardization of capital expenditure, and is also responsible for the acceptance, review and organization of applications for support funds. The district finance department is responsible for the budget management of support funds, and supervises and inspects the use of support funds.

Chapter II Content and Standards of Support Funds

  Article 6 A one-time subsidy of 50,000 yuan will be given to those who have won the gold and silver awards of Chinese patents; A one-time subsidy of 30,000 yuan will be given to those who have won the China Patent Excellence Award; A one-time subsidy of 20,000 yuan will be given to those who have won the Shanghai Intellectual Property Innovation Award.

  Article 7 A one-time subsidy of 800,000 yuan will be given to the applicants for the subsidy of "China Well-known Trademark" recognized by the State Intellectual Property Office.

  Article 8 A one-time subsidy of 50,000 yuan shall be given to applicants for geographical indication subsidy who have been recognized by the State Intellectual Property Office as geographical indication products or approved for registration as certification marks or collective trademarks.

  Article 9 A one-time subsidy of 30,000 yuan will be given to the applicants who are included in the list of key trademark protection in Shanghai.

  Article 10: Raise the level of management and use of intellectual property rights. For those identified as pilot and demonstration units of patent work of enterprises and institutions in Shanghai, a one-time subsidy of 200,000 yuan and 300,000 yuan will be given respectively; For those identified as pilot and demonstration parks for the construction of a strong intellectual property city in Shanghai, a 1:1 matching subsidy will be provided according to the support funds given to the park by the Shanghai Municipal Intellectual Property Office in the current year.

  Article 11: Promote the standardization of intellectual property rights in enterprises. For the pilot and demonstration units of Shanghai enterprises and institutions that implement the national standard of "Requirements for Enterprise Intellectual Property Compliance Management System" (GB/T29490-2023) and the "Innovation Management - Guidelines for Intellectual Property Management" (ISO56005) international standard standardization, and pass the certification of relevant national departments, the certification fee directly related to the certification body shall be subsidized, not exceeding 50% of the standard implementation fee, and the maximum shall not exceed 100,000 yuan.

  Article 12 A one-time subsidy of 50% of the amount of special subsidy at the municipal level shall be given to the intellectual property analysis and evaluation and patent navigation projects identified by the Shanghai Municipal Intellectual Property Office in key industries, with a maximum of 150,000 yuan.

  Article 13 Relevant institutions are encouraged to develop intellectual property insurance and pledge financing products in line with the industrial development of Chongming District, and 50% of the subsidy for applicants to carry out intellectual property insurance and pledge financing business shall be subsidized according to the actual premiums and appraisal fees, with a maximum of 200,000 yuan.

  For enterprises, institutions and relevant social organizations that have obtained commercial bank loans through pledge of patents and trademarks during the policy cycle, if they register with the competent state intellectual property department and obtain the pledge registration certificate, they will be given a one-time interest subsidy of no more than 50% of the actual loan interest after the end of the loan cycle, with a maximum of 50,000 yuan.

  Article 14 Where an enterprise carries out intellectual property litigation and rights protection abroad, the applicant for funding who is judged to have won the lawsuit by the judicial department shall be given a one-time subsidy of 50% of the actual appraisal, notarization and litigation costs, with a maximum of 200,000 yuan.

Chapter III: Management and Supervision

  Article 15: Where applicants for support funds have negative judicial or administrative credit records in the year of application, they are not to be supported. Applicants for support funds who violate regulations or commit fraud in the process of project implementation shall be disqualified from applying for support funds, and the allocated funds shall be withdrawn within a time limit, and no support shall be granted within three years.

  Article 16: Funds for intellectual property rights support must be earmarked. The use of intellectual property support funds is subject to the supervision and performance evaluation of relevant departments to ensure the standardized, safe and effective operation of funding. Where this policy overlaps with relevant policies, it shall be implemented in accordance with the principle of "preferential, high, and non-restrictive".

Chapter IV: Supplementary Provisions

  Article 17 These Measures shall come into force on January 1, 2024 and shall be valid until December 31, 2026, and shall be interpreted by the Shanghai Chongming District Administration for Market Regulation (Intellectual Property Office) in conjunction with the Shanghai Chongming District Finance Bureau.
