The Regulations were amended and adopted by the Fifth Meeting of the Standing Committee of the 18th Chengdu Municipal People's Congress on December 29, 2023, and approved by the 11th Meeting of the Standing Committee of the 14th Sichuan Provincial People's Congress on April 3, 2024, and will come into force on June 1, 2024.

Focus on people's livelihood concerns and initiate amendments in a timely manner

The city first legislated on the management of non-motor vehicles in 2006 and made a revision in 2014. Since the implementation of the "Regulations", it has played a positive role in regulating the production, sales, registration and passage of non-motor vehicles, and ensuring the safety and smooth flow of road traffic. In recent years, with the rapid development of the economy and society and the adjustment of national policies, many changes have taken place in the main problems in the field of non-motor vehicle management: the rapid development of emerging formats such as express delivery, logistics, takeaway and Internet rental bicycles, the lack of clarity in the industry authorities, the lack of standardization of the main responsibilities of enterprises, and the existence of management shortcomings;

Strengthen vehicle registration and guide and standardize travel

In order to further clarify the scope of application of the regulations and related concepts, the regulations clarify the definition of non-motor vehicles in accordance with the relevant provisions of the Road Traffic Safety Law, and clarify and improve the definitions of electric bicycles and motorized wheelchairs for the disabled in accordance with the latest national standards. Among them, electric bicycles, motorized wheelchairs for the disabled and human-powered tricycles should be registered by the public security organs, and non-motorized vehicle number plates and driving licenses should be obtained before driving on the road; Motorized wheelchairs for persons with disabilities are only driven by persons with disabilities with lower limbs, and a certificate of disability of lower limbs shall be submitted in accordance with law when registering.

The regulations specify that for newly purchased non-motor vehicles that should be registered, the driver may temporarily pass through the vehicle within 15 days after the purchase of the vehicle with the purchase voucher and handle the vehicle registration in a timely manner. In order to implement the requirements of the "one helmet and one belt" safety protection action, the regulations also clarify that the driver and the carrying personnel of electric bicycles shall wear safety helmets, and the carrying personnel shall ride in the forward direction of the seat.

Control the source governance and promote the whole chain of supervision

Driving the non-motorized vehicles on the road not only affects the normal traffic order, but also brings many hidden dangers to road traffic safety. The regulations specify that the batteries, chargers and other products of non-motor vehicles and electric bicycles produced and sold in the city shall comply with the relevant national standards; At the same time, it is also stipulated that electric bicycle manufacturers shall not sell incomplete electric bicycles without key components such as batteries and chargers, so as to prevent the occurrence of illegal acts of installing and modifying non-motor vehicles from the source.

It is clarified that non-motor vehicle operators shall implement the purchase inspection and acceptance system, establish a purchase ledger and a sales ledger, publicize information such as product qualification certificates in a conspicuous position in the sales venue, sell electric bicycles and other types of vehicles separately, and shall not sell electric bicycles that are inconsistent with the information of the compulsory product certification certificate and the physical object or equipped with key components such as batteries and chargers that are inconsistent with the information of the product qualification certificate. It is clarified that if the maintenance operator undertakes the maintenance business of electric bicycles, it shall repair and replace the parts in accordance with the technical parameters and safety requirements specified in the product certificate and compulsory product certification certificate, and keep the specifications and models and technical parameters consistent with the original parts.

Standardize parking and charging

Promote the concept of public safety

The regulations specify that non-motorized vehicles parked in public places shall be parked in non-motorized vehicle parking lots in an orderly manner. If there is no parking lot for non-motor vehicles, it shall be parked in the designated area. If there is no demarcated area, non-motor vehicle parking shall not occupy blind roads and green spaces, shall not obstruct the passage of other vehicles and pedestrians, and shall not affect the city environment.

The parking and charging of electric bicycles shall meet the safety requirements of electricity and ensure fire safety, and shall not be parked or charged in the public foyer, shared walkways, stairwells, evacuation passages, safety exits and other areas of the building, or in the indoor areas of densely populated places, and shall not use the elevator car to carry electric bicycles and their batteries, shall not encircle or block fire hydrants or occupy fire spacing, and shall not violate the requirements for safe electricity use to connect wires and sockets for charging.

Strengthen the management of new business formats

Consolidate the responsibility of enterprise safety production

In order to promote the standardized and orderly development of Internet rental bicycles in our city, the regulations clarify that the city implements total regulation and control of Internet rental bicycles, clarifies the responsibilities of the municipal transportation department, the municipal public security organ, and the municipal urban management department, and stipulates that Internet rental bicycle operating enterprises shall follow the requirements of the total amount regulation and dynamic adjustment mechanism, orderly release and recycling vehicles, and strengthen daily scheduling and parking management.

In order to strengthen the responsibility of enterprises for production safety and the obligation of traffic safety management, urge express delivery and takeaway delivery personnel to standardize their driving, and protect the legitimate rights and interests of employees, the regulations specify that relevant enterprises that use non-motor vehicles to engage in express delivery, logistics, take-out and other distribution activities shall implement the main responsibility for production safety, establish and improve the internal traffic safety management system, establish and improve the management ledger of non-motor vehicle drivers and non-motor vehicles, and do a good job in daily safety inspections such as non-motor vehicle maintenance and maintenance; The training and assessment of laws and regulations shall urge drivers to use electric bicycles and batteries, chargers and other products that meet national standards, standardize driving, parking and safe charging and replacement, and equip electric bicycle drivers with safety helmets, and purchase third-party liability insurance, personal accident insurance and other insurance for drivers and passengers as needed;
