As the saying goes, a gentleman loves money and takes it in the right way, but in order to sell more alcohol and promote the consumption of guests, some KTV operators even ignore the existence of law and morality, extend their claws to minors, and illegally profit from it in the form of "paid escort". Recently, the Zaoyang Court heard three criminal cases, let's take a look at them together.
Case 1
From February to October 2022, Xie Moumou, the operator of a business music bar on Seoul Commercial Street, Zaoyang City, and the store manager Liu Moumou and others, in order to improve the business efficiency of KTV, knew that Gao Moumou (female, then 17 years old), Wang Moumou (female, then 16 years old), Du Moumou (female, then 16 years old), Zhang Moumou (female, then 13 years old) and others were underage women, and still organized them to be paid escorts in the music bar, and charged 150 yuan/hour, from which the commission was 30 yuan/ hours, and organized the management of underage escorts, attendance, etc., in order to obtain illegal benefits.
After trial, the Zaoyang Court held that the defendants Xie XX and Liu XX organized a number of underage women to carry out paid escort activities, and their conduct constituted the crime of organizing minors to carry out activities that violated the administration of public security, and the two defendants were sentenced to one year and one month in prison and one year in prison respectively, and were also fined.
Case 2
Since June 2023, Jin Moumou, together with Yang Moumou and Ge Moumou, has successively leased XXKTV and XYKTV in Hancheng, Zaoyang City to engage in the operation of entertainment venues, according to the division of labor, Jin Moumou and Yang Moumou serve as the person in charge of XXKTV and XYKTV, and Ge Moumou serves as the administrative director of XXKTV and XYKTV, and there are four departments, with Zhou Moumou, Ding Moumou, Wang Moumou and others serving as ministers and deputy ministers respectively, to assist Ding Moumou, Yang Moumou, and Ge Moumou in managing the paid escort minors in various departments.
After the opening of KTV, they successively recruited a number of male minors such as Yan Moumou, Zhi Moumou, Guan Moumou, Gao Moumou, Chen Moumou to provide paid escort services, so as to obtain high returns.
After trial, the Zaoyang People's Court sentenced defendant Jin XX to one year and three months imprisonment and a fine of 7,000 yuan for the crime of organizing minors to carry out activities that violated the administration of public security, sentenced defendant Yang XX to one year and one month imprisonment and a fine of 5,000 yuan, and sentenced defendant Ge XX to one year imprisonment and a fine of 4,000 yuan.
Case 3
On March 12, 2022, Mao, together with Gao and Yang, leased Wang's house to operate a "concert hall in Zaoyang City", and engaged in the operation of entertainment venues without applying for an entertainment business license. According to the division of labor, Mao Moumou served as the manager of the concert center, Gao Moumou served as the person in charge of the marketing department, Guo Moumou served as the person in charge of the recruitment department, and Yang Moumou served as the person in charge of the floor of the concert hall. In order to increase the profitability of the concert center, Mao XX organized Guo XX, Gao XX, Yang XX and others to recruit underage women to the concert hall for paid escorts.
Among them, Guo Moumou is responsible for organizing recruiters to download the resumes of underage female job seekers on 58.com, and recruits them on the grounds of high salary and easy work; then Gao Moumou conducts escort training and attendance management for the recruited underage women; Yang recruits underage women to serve as paid escorts through other means; and Mao Moumou is responsible for the payment of wages to all personnel in the store.
Through the above methods, during the operation of the concert hall, a number of underage women such as Li Moumou (female, then 17 years old), Yang Moumou (female, then 16 years old), Zhu Moumou (female, then 16 years old), Ye Moumou (female, then 13 years old) and other minor women were recruited to serve as paid escorts in the club.
After trial, the Zaoyang People's Court found that the above-mentioned acts of defendants Mao XX, Gao XX, Guo XX, and Yang XX were organizational acts in the sense of the Criminal Law, which impeded social security and order, and constituted the crime of organizing minors to carry out activities that violated the administration of public security, and sentenced them to fixed-term imprisonment ranging from one year to nine months, and all of them were fined.
In the three criminal cases mentioned above, the defendant took advantage of the characteristics of minors, such as their lack of involvement in the world, lack of social experience, and weak ability to protect themselves, to organize minors to engage in paid escorts in entertainment venues to obtain illegal benefits, which is within the scope of activities violating the administration of public security, and may be convicted and punished for the crime of organizing minors to carry out activities that violate the administration of public security.
