Since the beginning of this year, the Tuoxian County Court has focused on the theme of "fairness and efficiency", taking the improvement of the level of judicial credibility construction as a key task, adhering to the concept of active justice, and demonstrating the strength, speed and temperature of enforcement in a single enforcement case, and building the "last line of defense" for the construction of creditworthiness.
I. Increase the "force" of enforcement to help establish judicial credibility
In the field of government-related cases, measures such as "pre-limits", "pre-dishonesty", and "pre-fines" are adopted against party and government organs that refuse to perform effective judgments after coordination, forcing them to perform their obligations. Punishments for untrustworthy conduct of entities in key areas such as those involving enterprises, people's livelihoods, and finance are to be applied: on the one hand, on the basis of the requirements for restricting spending and untrustworthy persons, strictly screen the scientificity and basis for punishment of judgment defaulters' untrustworthy conduct, and on the other hand, all entities that meet the requirements of restricting consumption and punishment for untrustworthiness are to be subject to measures, and judgment defaulters who evade enforcement and lack a sense of creditworthiness are never allowed to be included in the list of untrustworthy persons. At the same time as employing restrictions on spending and the inclusion of untrustworthy persons, increase the force of investigating people and finding things, and lawfully employ compulsory measures such as custodial summonses, detention, and fines against judgment defaulters, to increase the rate of application of compulsory measures. Since the beginning of this year, 116 people have been included in the list of judgment defaulters, 324 people have been restricted from high spending, 43 people have been summoned for custodial summons, and 9 people have been detained.
II. Accelerate the "speed" of enforcement to help judicial fairness and justice
The Executive Bureau of the County Court has taken multiple measures to shorten the time for handling cases. On the one hand, the case is divided in strict accordance with the standard of diversion of complicated and simple cases to ensure efficient and high-quality implementation of cases. On the other hand, the Executive Directorate has introduced a node system for the case-handling process, and the complicated and simple cases are immediately entered into the node system after being transferred to the undertaker, and each enforcement case is handled and circulated within a strict node time limit from inquiry and freezing, offline investigation and control, and on-site investigation. Through a refined system of diversion of complicated and simple cases and node systems for case-handling processes, ensure the efficient conclusion of enforcement cases, fair and transparent enforcement procedures, and protect the public's right to know.
III. Transmit the "temperature" of enforcement to assist in the restoration of untrustworthy credit
Implement the concept of good faith and civilized enforcement, and safeguard the lawful rights and interests of entities with untrustworthy conduct. The Tuoxian County People's Court uses the "court + N" enforcement linkage mechanism to introduce the CPPCC, the community and other forces to carry out multiple linkage mediation, shorten the chain of contradictions, reduce the antagonism between untrustworthy persons and applicants, and realize the punishment and restoration of the credit of untrustworthy entities. Promote the formation of a working mechanism for the support and participation of multiple departments of "CPPCC + court + community", to provide safeguards for improving grassroots social governance and establishing enforcement linkage mechanisms.
IV. Strengthen publicity on enforcement to create a positive credit environment
On the basis of relying on traditional media publicity, give full play to the promotion and guidance of new media for the implementation of publicity. The Tuo County People's Court is to use its own public accounts and local public accounts as media to publicize enforcement actions, typical cases, and relevant legal knowledge, periodically publishing a list of untrustworthy persons, issuing notices urging the performance of obligations, and other such means to carry out publicity on the popularization of the law and warning education on creditworthiness, to increase the public's understanding of the seriousness of the consequences of inclusion in untrustworthiness, and to guide untrustworthy entities to perform their legal obligations as soon as possible.
