After investigation, the owner Han (male, 39 years old, employee of the factory) purchased the car in October 2023, and installed the modified 60-volt lithium battery on the car without authorization because of the short mileage. In accordance with the "Fire Protection Law of the People's Republic of China", the Minhang Public Security Bureau has detained Han for 15 days and imposed a fine of 500 yuan. For the enterprises and other personnel involved in the illegal modification of the car, the District Market Bureau and other departments are tracing the source investigation.
On April 11, an electric bicycle parked in the middle of two buildings in a small area of Changning District smoked and caught fire, and after investigation, the cause of the fire was the failure of the over-standard lithium battery (60V) monomer to ignite the surrounding combustibles. The owner of the car involved was administratively detained by the public security organ for 11 days in accordance with the law for negligently causing the fire.

According to the preliminary investigation, on the evening of April 15, the Qingpu District police arrested 8 suspects of illegally assembling and modifying electric bicycles, and seized 950 sets of various batteries and 4 modified electric bicycles at the scene.
After investigation, from the end of 2021 to the present, the criminal suspects Su and Sun have leased shops along Huazhi Road and Yinggang Road respectively for the sales and maintenance of electric bicycles of a certain brand. In the process of selling electric bicycles, the suspect illegally modified the 48V battery that meets the national standard to 60V and 72V in series. Usually a set of modified 60V lead-acid batteries are sold at about 500 yuan, and the vehicle is sold at more than 3,000 yuan after modification. In order to ensure that the electric bicycles sold to customers can be successfully registered and licensed, Su, Sun and others will illegally modify the battery after completing the license, and at the same time break the speed limit of the vehicle in violation of regulations and raise it to 45 km/h.
Chen and others leased two warehouses in Huaxin Town and Xiayang Street for storage and sales of batteries, and still sold a large number of batteries to Su and Sun when they knew that Su and Sun bought batteries for modifying electric bicycles. As of the time of the case, the total amount involved was more than 300 yuan, and 950 sets of various batteries were seized at the scene.
On April 8, in the joint crackdown on illegal modification of electric bicycle sales dens in Jinshan District, law enforcement officers found that the store had converted the 48V battery shown in the electric bicycle qualification certificate into a 60V battery. After investigation, it was confirmed that the store sold 12 illegally modified electric bicycles, with a sales amount of more than 50,000 yuan and a profit of more than 1,500 yuan, and the suspect has been controlled by the police.
Illegal modification of e-bikes refers to the replacement of parts and components of e-bikes, which violates the regulations on the manufacture and use of e-bikes. According to relevant regulations, the parts and components of electric bicycles must meet national standards and pass relevant tests to ensure the safety and reliability of the vehicle.
What qualifies as "illegal modifications"?
1. Modify or modify the motor to make the engine exceed the rated power set by the original car;
2. Alter or remove speed limiting devices and pedal riding equipment;
3. Dismantle the speed prompt sound device;
4. Install a battery, or replace a battery that does not meet the rated voltage set by the original car;
5. Install umbrella stands and canopies;
6. Spraying, installing, and using special vehicle or similar sign patterns, alarms, and sign lamps without authorization.
Article 9 of the Measures for the Administration of Non-Motorized Vehicles in Shanghai stipulates that units and individuals are prohibited from engaging in the following acts: (1) assembling non-motorized vehicles, (2) installing power devices, canopies, seats, and high-decibel audio on non-motorized vehicles, (3) replacing non-motorized vehicle power devices or changing the size of exhaust devices, (4) removing or altering non-motorized vehicle silencing, speed limiting, and exhaust gas treatment devices, and (5) other additions and modifications that affect the safety of non-motorized vehicles. Whether it is a consumer or a seller, it is strictly forbidden to assemble, install, modify electric bicycles or sell and use modified electric bicycles, otherwise they will bear legal responsibility.
