Recently, Sichuan Zigong sanitation worker Ma Congxian clashed with the personnel of Hongyun Backstop Company because of stealing loquats, and Ma Congxian and the company personnel beat each other and were identified as slightly injured. On June 16, the Zigong Gaoxin Public Security Sub-Bureau sentenced Ma Congxian to four days of administrative detention, Shi Mou, a member of the Hongyun Reverse Device Company, for five days, fined 200 yuan, and Shi Moumao 400 yuan. In this regard, Ma Congxian's family expressed dissatisfaction, saying that the punishment was too severe.
Ma Congxian's family believes that according to Liang Moufen, another sanitation worker involved in picking loquats with Ma Congxian that day, Ma Congxian's loquats only "look like half a catty or more". With such a small amount, his behavior did not constitute theft, and the public security organs only punished and detained Shi for 5 days, which is obviously abnormally light.
On June 18, the police said that even if the number is small, as long as it is determined to constitute a theft violation based on facts and evidence, it should be punished in accordance with relevant laws and regulations.

On the afternoon of April 21, when sanitation workers Ma Congxian and Liang Moufen were cleaning the garbage in the section of the Hongyun Company on the Buchuan Second Branch Road in Zigong Bancang Industrial Park, they noticed a few branches of loquat trees with full fruits sticking out of the company's fence. Ma first described his actions as "helping companies clear branches on the wall."

Ma Congxian was treated in the hospital for 16 days, during which the relevant person in charge of the enterprise paid a total of more than 15,000 yuan for the treatment, and after being discharged, the police organized mediation between the two parties.
After the hospital's evaluation, Ma Congxian's injuries were minor. Subsequently, the police organized the third mediation, Ma Congxian asked the company to pay its treatment fees, nutrition fees, nursing fees, lost work expenses, mental damage fees, etc., a total of more than 50,000 yuan, after police mediation, the company said that the reason was to pay 35,000 yuan, and the two parties could not reach an agreement.
On June 6, after the relevant incident appeared in the newspapers, the police organized mediation for the fourth time, and this time Ma Congxian saw public opinion, and immediately increased the amount of compensation to 60,000 yuan, the company did not agree to compensation, and the mediation failed again.
According to people familiar with the matter, throughout the handling of the case, the police have been trying to promote reconciliation between the two parties and actively seek reasonable compensation for Ma Congxian, however, Ma Congxian's party has increased the amount of compensation several times, resulting in the final failure of mediation.
On June 16, after the mediation failed, the police of the Zigong High-tech Zone made an administrative punishment decision against the parties: Shi, who beat others, was detained for five days and fined 200 yuan, Shi Moumao was fined 400 yuan, and Ma Congxian was sentenced to four days of administrative detention for suspected theft.
Ma Congxian's party always believed that if he just picked a few loquats, the market value was less than 20 yuan, and he would be characterized as theft, which was too unreasonable, and said that he would apply for administrative reconsideration.
The author believes that the beginning of the incident itself was caused by Ma Congxian stealing other people's loquats, and many people think that the amount involved is too small and should not be characterized as theft, however, Ma Cong first stood on the fence to pick people's loquats located in the wall, the act itself is theft, and after the identification of only minor injuries and the enterprise agreed to compensation, it is even more suspected of fraud.
