The Xinxuan Group founded by anchor Simba has once again fallen into the "fake" storm in the live broadcast room.

Recently, some media reported that on April 18, Simba and its anchor "Egg Egg" sold "YPL sunscreen cool pants" in the network live broadcast room suspected of being fake. After placing an order, some consumers found that the YPL brand officially did not have this product. That night, the product sold more than 6 million.

Today, Xinxuan Group issued the latest response to the incident, saying: In response to the question of "the YPL pants promoted by Xinxuan Live Broadcast Room is not officially authorized", our company has done further verification, which is due to the dispute between the trademark owner before and after the transfer of the trademark and is not a fake.

On April 22, the brand involved in the "YPL Sports Fashion Products" issued a statement for the first time. It said that it was confirmed that "YPL cool pants" were not officially authorized and were not products of the YPL brand. The company said that the packaging of the goods is suspected of plagiarism, and the product distribution company and the production company will be held responsible according to law.

After that, Xinxuan Group issued its first statement, saying that it had begun urgent verification.

In the subsequent results announced, the "fake goods" incident began to point to trademark disputes.

Three companies were involved in the storm: Xinxuan Live Room and YPL Sports Fashion Products, and Harbin Aoshengyuan Trading Co., Ltd.

On April 23, YPL Sports Fashion Products issued a second statement, saying that "the ownership of the YPL trademark of the counterfeit products is our company", and provided the relevant trademark registration certificate and trademark transfer certificate.

In response to the complaint from the brand, Xinxuan Group also issued a second statement in response to the authorization issue. The company said that under further verification, the incident was caused by a dispute between the trademark holders before and after the transfer of the trademark and "did not belong to the fake goods".

The statement gave the Group's preliminary findings that the original holder of the YPL trademark was Australia Health Industry Co., Ltd., and Harbin Aoshengyuan Trading Co., Ltd. was authorized by the above company on January 1, 2021.

According to the statement, the twist and turn of the transfer is that on April 13, 2022, after the original trademark holder applied for the transfer of the trademark to Australia YPL Limited, there was a dispute between the two parties over authorizing a third party to use the trademark before and after the transfer, so the statement "does not belong to the products of YPL" appeared.

After consulting with legal experts, Xin Xuan confirmed that the authorization relationship between the original trademark holder and the authorized party Harbin Aoshengyuan Trading Co., Ltd., and the authorization relationship between Harbin Aoshengyuan Trading Co., Ltd. and Xinxuan, are within the validity period of the law.

However, the above explanation was denied by the "YPL Sports Trend".

The company issued its third statement on the afternoon of April 23, saying that the company had never had business cooperation with Harbin Aoshengyuan Trading Company and did not have any trademark authorization. The company will pursue legal liability for forging official seals.

As of press time, Xinxuan Group has not made a follow-up response to this. The company said in its latest statement that it could offer consumers a full refund of the item.

Previously, Xinxuan Group had announced that at present, Simba and Xinxuan Group have a total of more than 1400 product selection and quality control teams, and set up a quality expert committee and a quality supervision committee to follow up the quality control work. The final outcome of the storm remains to be seen, but the incident undoubtedly destroyed the trust between consumers and anchors, and also sounded the alarm for Xinxuan Group and the live broadcasting industry.
