According to the website of the Ministry of Industry and Information Technology, in order to protect the safety of radio frequencies in important industries of the national economy, recently, the Ministry of Industry and Information Technology, together with the Ministry of Public Security, the Ministry of Justice, the State Administration of Market Supervision and Administration and other departments, jointly launched a law enforcement action to crack down on the illegal production, sale and use of unmanned aerial vehicle radio countermeasures and other equipment.
As of now, the relevant local radio regulatory agencies have ordered Taobao, JD.com, Pinduoduo, Suning Tesco and other online shopping platforms to clean up and remove more than 8,600 pieces of radio transmission equipment such as unmanned aerial vehicle radio countermeasure equipment and signal jammers and shielders that have not been approved by model; all localities have transferred suspected criminal cases to public security organs and given administrative punishments. More than 110 cases of illegal setting up and use of related equipment were investigated and dealt with by means of ordering corrections.
According to the Criminal Law of the People's Republic of China, the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases Of Disrupting the Management Order of Radio Communications, and the Regulations of the People's Republic of China on Radio Administration, if radio frequencies are used without permission or radio stations (stations) are set up or used without authorization, or radio transmission equipment is used to interfere with the normal conduct of radio business, the radio regulatory authority shall make administrative penalties depending on the circumstances of the violation and the harmful consequences Where violations of the administration of public security are constituted, the public security departments shall give administrative penalties to public security in accordance with law; where a crime is constituted, criminal responsibility shall be pursued in accordance with law.
Relevant organizations and individuals shall enhance their awareness of the lawful use of radio frequencies, and deepen their understanding of the harmfulness and legal consequences of illegal use of radio transmission equipment and other such conduct. In the follow-up, the national radio regulatory agency will further strengthen radio monitoring and interference investigation and handling in combination with the requirements for radio safety guarantee work for major events such as the Beijing 2022 Winter Olympics, and effectively maintain the order of air waves.
