【Qin Inspection Style】Li Shuai: From a "rookie" who is ignorant and green to a "backbone" who is independent

My name is Li Shuai, a typical post-90s girl, who is currently the assistant procurator of the Second Procuratorate of the Haigang District People's Procuratorate. My career as a prosecutor began with the convening of the Nineteenth National Congress of the Communist Party of China. In 2017, I stepped into the door of the dream procuratorate through the four-level joint examination and officially started my career as a prosecutor. Over the past four years, I have witnessed the profound changes that have taken place in the procuratorate's reform wave of reform, such as the reform of the judicial responsibility system, the reform of the state supervision system, and the reform of the internal organs for the integration of arrest and prosecution; the procuratorate has also witnessed the growth and transformation of me from an ignorant "rookie" to a "backbone" who is independent after undergoing training in many posts such as the Political Department and the Criminal Inspection Department. As a witness and participant in judicial reform, my personal destiny has long been integrated with the development of the procuratorate. In a sense, my personal experience is also a microcosm of the growth of grassroots young prosecutors in this era.

Determination -- Last night the west wind withered the green trees, went up to the tall building alone, and looked at the end of the world

Everything in life has a trace to follow. Today, as I look back on the path I've traveled, I ask myself: When did I start to aspire to be a prosecutor? This probably dates back to my student days. I remember that at that time, I saw from the screen that the procurator was dressed in a straight procuratorial uniform, solemnly standing on the prosecutor's bench to make a generous statement to safeguard the interests of the country and the people. I was envious, and my heart was filled with reverence for the prosecutor. Since then, it has become a dream in my heart to become a prosecutor of the republic, to defend morality in a navy blue uniform and with a righteous voice. To this end, when I filled in the college entrance examination, I did not hesitate to choose the law major of Southwest University of Political Science and Law as the first choice and was successfully admitted. After four years of systematic education as an undergraduate and two years as a graduate student, I have a solid theoretical foundation and the love in my heart is more firm.

Unfortunately, when I graduated in 2017, it coincided with the beginning of judicial reform and the transfer of the "two antis", a change that touched the hearts of thousands of legal people. After the personnel system was just implemented, there was a continuous decline; the stripping of the power to investigate job-related crimes also meant a weakening of the procuratorial force, and some people even said that "the procuratorate that loses anti-corruption and anti-malfeasance is like a Venus with a broken arm." At this time, some seniors in the procuratorial system resigned and jumped jobs, and there were elders in my family who advised me to go to the party and government departments when I had the opportunity, which may be more conducive to future development. But my heart has never wavered, and I feel that judicial reform, no matter how cruel it is for young people, but if you work hard enough and be good, you can stand out in any difficult environment. Now it seems that I was right at the time.

"In the Name of the People" came out almost at the same time, once again pushing the well-known title of "prosecutor" to a climax. Hou Liangping, who is just and upright, Secretary Dakang, who is diligent in government for the people, and Lu Yi, who is serious about righteousness, these characters live vividly by my side, and I seem to have a kind of fierce wave in my heart, and perhaps, then the procuratorate will really enter my life. After graduating from graduate school, I successfully entered the Harbor District People's Procuratorate, and my dream of many years finally came true, and I really became a procuratorial police officer of the republic. When I first put on that heroic prosecutor's uniform, my face was filled with excitement and excitement, and my heart was full of pride and pride.

Pursuit - the belt gradually widened and finally did not regret, for the Yi people haggard

From a college student who just came out of the ivory tower to a police officer in the procuratorate, it was a qualitative leap for me. This means that I want to completely get rid of the youth, impetuosity and bookish style on campus, and I must be down-to-earth and diligent. Changing the role, doing every job at hand, and making the career a career is a matter of course. It is said that the dripping water is a river, and in my opinion, this water droplet is the tempering of practice, that is, every solid job every day.

At the beginning of my admission, I was assigned to work in the Political Department, and my daily work was monotonous and repetitive, not like the cadres and policemen engaged in procuratorial work, who could wrestle with criminal suspects in the case-handling area, who could be witty and eloquent in the prosecution seat, punish evil and promote good, there was no thrilling and passionate, more often it was cumbersome and boring, but I always firmly believed: It is not simple to do simple things well, and it is not ordinary to do ordinary things well. Case-handling departments enforce the law impartially, do not follow private feelings, and strive to safeguard fairness and justice, which is a struggle; comprehensive departments, performing their duties in a down-to-earth manner, being rigorous and conscientious, and doing a good job in service and guarantees, is not a struggle. Political work, personnel, party building, propaganda, research... In the face of these complicated and trivial comprehensive work, I dare not slack off a little. In the various theme activities in full swing, in the reports reflecting the situation of the hospital, in the orderly management of the procuratorial team... It's all poured into my hard work. The two years in the Political Department have also allowed me to mature my mind and cultivate a sense of the overall situation as quickly as possible, and the point I feel most deeply is that whether it is leading decision-making or ordinary cadres handling specific affairs, we must focus on the overall situation of the work of the party and the state and proceed from the overall situation of procuratorial work. At the same time, I also personally felt what is pragmatic, rigorous and efficient, information work "every day short and fast", the molding of a material often has to go through repeated deliberation and pondering, it is this kind of excellence that makes me really weather the wind and rain, see the world, long talent, but also for my future business work laid a solid foundation.

At the beginning of 2020, with the adjustment of the internal organization of the arrest and prosecution integration, I came to the Second Procuratorial Department, which is mainly responsible for economic crimes and job-related crimes. Located in the main urban area, our hospital is a grass-roots hospital with a large case volume, and a "busy" word cannot fully cover the intensity and status of our work. The working hours are not reading the case file in the office, assisting the procurator in making case review reports or various legal documents, or going to the detention center for trial or appearing in court, and often working overtime on weekends to handle cases, binding files, etc., and the time of each day is full. "One point of hard work, one point of harvest", with a sense of curiosity, hard work and love, I quickly adapted to this work mode. From assisting the undertaker in reading the papers, assembling the papers, accompanying the arraignment, to having the ability to be independent, I have gradually grown in this process. Since I started my career in criminal prosecution, I have been involved in more than 300 criminal cases, ranging from cases of corruption and malfeasance by state agents to dangerous driving cases of drunk driving. I have lamented the decay of public officials, the impulsiveness of ordinary citizens, the disappointment of criminal suspects who have been repeatedly imprisoned and have not changed their ways; the ecstasy of criminal suspects who have regained their lives because of our decision not to prosecute, and the indifferent and desperate faces of defendants when they are brought to trial. These experiences have made me deeply aware of the devastating and subversive changes that punishment can bring to individuals and families, understand the complexity of real life and the diversity of human nature, and make me more and more cautious. At the same time, I also have a deeper understanding of the profession of procurators, gradually fading impetuousness and vanity, precipitating responsibility and faith, and realizing that procurators are not only a profession, but also shoulder the sacred mission of fair administration of justice.

The multitude looked for him a thousand times, and looked back, but the man was in the middle of the light

Procurator General Zhang Jun said: Procuratorial organs are extremely political professional organs, as well as political organs with strong professional nature. In recent years, we have heard more and more words called "politics". I often wonder, what is "talking about politics"? As a young prosecutor, when I mention "politics" in the past, I think of learning activities, meetings, stacks of documents, and the grand words in the documents. It seems that politics is far away from us, especially for our front-line case-handling personnel, and it feels like "politics" and "law" are two things that are completely incompatible. It may even be felt that speaking politics in the process of handling cases means a departure from the law to some extent. Or, they will feel that as long as the notes are copied enough, and all the knowledge points required to be memorized have been mastered, they can write beautiful experiences, and they can talk about it at the party branch meeting, they can be regarded as "stressing politics". Later, with the growth of case-handling experience, coupled with the opportunity of educating and rectifying the political and legal contingent, I slowly realized that for our case-handling personnel, "stressing politics" does not lie in how many notes are written, but the results should still be reflected in the effectiveness of case handling. In the process of handling cases, we must not enforce the law mechanically, but we must fully consider the natural reason, the national law, and the human feelings, and use our understanding of the law and the legal skills we have mastered to seek an optimal solution that is conducive to a harmonious society. Just like the legitimate defense clause activated in the Kunshan anti-homicide case, just like the Zhang Yuhuan intentional homicide case was changed to acquittal, just like the maintenance of the reputation and honor rights of heroes and martyrs in the spicy pen ball case... There are many such cases, and if we can consider various factors in all aspects when handling cases, can think a little more and do more from the perspective of the parties, and can do our best to achieve the "justice" that we agree with in our hearts, it may have a huge impact on the direction of the case, and then affect the life of others.

With the increase of case-handling experience and the growth of life experience, although I have not yet fully understood it, I have gradually begun to understand the true meaning of the Fa. Berman said: "The law must be believed, otherwise it will be useless." The faith of legal people is good law and good governance. Pursue good law, but be aware of the lag and content limitations of the law, and then make up for it with good governance. The so-called good governance is to organically combine the law of reason, take human nature as the test valve of the spirit of the rule of law, pursue substantive justice under a strict procedural framework, and pursue the precision and sense of proportion of justice matching. In layman's terms, it is to handle cases with feelings, while accurately and rationally applying the law, pay attention to social warmth and sophistication, accommodate people's simple moral feelings, combine reality, and output fairness and justice. Only in this way can we enhance the credibility of the judiciary and make people convinced.

Joining the procuratorial team, I am not only a practitioner of the procuratorial cause, but also a permanent learner of the procuratorial "academy", learning in practice and growing in the course of learning. If I compare my procuratorial career to the school system of procuratorial "academy", I have just graduated from elementary school. Looking back at the four years of growing up with the procuratorate, what has changed is the post, and what has not changed is the original intention of the procuratorate. As recent prosecutors, we still have a long way to go. May you and I always maintain this original intention, in the time zone arranged by the times for us, through the progress to achieve the big feelings of our little people.
