A man in Feixi stabbed a female neighbor with a knife, causing her to die on the spot, and was tried on charges of intentional homicide

On January 13, the Hefei Municipal Intermediate People's Court publicly tried a case of intentional homicide, in which Zhang Moushen, a villager in Mingchuan Village, Feixi County, stabbed villagers in the same village with a folding knife, causing him to die on the spot, and was charged with intentional homicide and appeared in court for trial.

Serial stabbing of the female neighbor killed her

On the morning of January 13, 53-year-old Zhang Moushen, wearing protective clothing, stood in the defendant's seat.

The prosecution court alleged that the defendant Zhang Moushen (male) and the victim Zhou Mou (female) were villagers of the same villager group in Mingchuan Township, Feixi County. On August 3, 2021, defendant Zhang X Shen believed that the mulberry branches stacked by the victim Zhou XX obstructed his passage, and entrusted his brother Zhang XX to relay to the victim Zhou XX to remove the mulberry branches, and Zhou XX agreed. At about 7:00 a.m. the next morning, defendant Zhang Moushen was dissatisfied that the victim Zhou XX had not completely removed the mulberry branches, and clashed with Zhou XX, who was returning the mulberry branches.

During this period, defendant Zhang X Shen stabbed the victim Zhou X with a folding knife he carried with him, and Zhou X dodged and fell to the ground, after which, Zhang X Shen stabbed Zhou X in the chest, neck, head and face with a knife for several consecutive stabs until Zhou X stopped struggling. Zhang Moushen found that his right hand was scratched by a folding knife, and in order to vent his anger, he stabbed Zhou Mou in the neck several times, causing his death.

After identification, Zhou Moumou was stabbed in the neck and chest by a sharp object, causing large blood vessel damage to the neck and chest, resulting in a large amount of blood loss and death. Defendant Zhang Moushen suffers from a psychotic disorder to be classified, but the occurrence of the crime has nothing to do with his illness, and the victim is not the object of his delusion, so the appraiser's ability to identify and control the case is not significantly weakened, and he has full criminal responsibility.

Charged with intentional homicide, the verdict was not pronounced in court

The prosecution believes that the defendant Zhang Moushen could not handle the dispute correctly because of trivial matters, and he stabbed others in a key part with a knife continuously, causing the death of one person, and his behavior violated the criminal law, the facts of the crime were clear, the evidence was indeed sufficient, and he should be investigated for criminal responsibility for intentional homicide.

In the face of the accusations, Zhang Moushen admitted the fact that he killed Zhou Xxx, and his confession was that he had known Zhou XX before and had a neighborhood relationship with him, but there had been a conflict between the two sides due to trivial matters.

Several relatives of Zhang Moushen testified that Zhang Moushen was usually introverted, had a bad temper, was prone to anger, did not believe the words of others, and although he played a trick at home, he did not have a physical conflict with outsiders.

In court, Zhang Moushen's defense lawyer pointed out that Zhang Moushen graduated from junior high school and was educated, but his language logic was confused and his paranoia was serious. It is not excluded that Zhang Moushen was in the onset of paranoid schizophrenia at the time of the crime, resulting in the death of the victim, and should be characterized as an opinion on mitigating punishment such as limiting the capacity for criminal responsibility, and mentioned that the lack of fork evidence may have a sudden crime of defensive factors.

However, this opinion was refuted by the prosecutor in court, and the prosecutor argued that through Zhang Moushen's logical confusion and serious paranoia of victimization, he was in the onset of paranoid schizophrenia at the time of the crime, and there was no evidence to support it. The only person concerning the situation with regard to the fork is the confession of defendant Zhang Moushen, and in his confession, the fork did not cause bodily harm to him, there was no threat to the right to life and health, and it did not meet the defensive factors for a sudden crime.

The victim's relatives gave up the civil lawsuit and demanded that the court severely punish the defendant in accordance with law.

The verdict was not pronounced in court.
