After Ms. Zhao arrived at the store, the "health expert" gave her pulse, prescribed medicines and promoted a certain health product, claiming to be able to cure all diseases. Ms. Zhao spent 13,000 yuan to buy several bottles of health care products, but after taking them, it did not have a publicity effect.

The public security organs' investigation found that between February 2020 and July 2020, defendant Wang And others used methods such as giving gifts to attract victims to the store, and by posing as health experts or doctors, fabricated products with therapeutic effects, and defrauded victims of money. After analyzing the composition of the health care products involved in the case, it was found that its ingredients were sucrose, honey, plant extracts and water, which did not have a therapeutic effect. Defendant Wang and others participated in defrauding the victim Zhao and 23 other victims ranging from more than 6,000 yuan to more than 160,000 yuan.

After trial, the Haidian court held that the defendant Wang X and 5 others ganged up to fabricate facts and defraud others of money for the purpose of illegal possession, of which the defendant Wang X committed a huge amount of crimes, and the other 4 defendants committed a relatively large amount of crimes, and their acts have constituted the crime of fraud and should be punished according to law. Among them, Wang, as the legal representative and actual manager of the company, knew that the health care products involved in the case did not have the effect of treating the disease, and still instructed the company's personnel to defraud the victims of money in accordance with the division of labor; Zhang did not have the qualifications to diagnose and treat the disease, but fictitiously identified as a "health expert" or a retired doctor in the hospital, "diagnosed the disease" of the victim, and used the information obtained in advance to falsely publicize the efficacy of the health care products involved in the case to the victims, mislead the victims, and make the victims fall into wrong understanding.
