Eligible drivers holding driver's licenses issued by the Shanghai Public Security Traffic Police Department can open the "Traffic Management 12123" App, find the "Learning the Law And SubtractIng Points" business in the business center, and can participate in online learning and examinations, and after the successful examination, they can deduct 1 point, and up to 6 points can be reduced in a year.
In January 2020, the Ministry of Public Security issued the "Work Specification for Receiving Traffic Safety Education and Reducing Traffic Violations and Demerit Points (Trial)", implementing the policy of "deducting points from studying the law", and motor vehicle drivers can reduce points by participating in online learning tests, on-site study tests, and traffic safety public welfare activities. Previously, it has been piloted in some areas such as Hunan, Gansu, Guangdong and Zhejiang. At present, Shanghai has confirmed that it is included in the scope of the pilot.
It is reported that motor vehicle drivers who have a motor vehicle driving license of the People's Republic of China, regardless of the type of driving license, nor whether they are the driver of the operating vehicle, can participate in the study of the law to reduce points, and participate in the corresponding road traffic safety laws, regulations and related knowledge learning, examination or traffic safety public welfare activities in accordance with their highest quasi-driving type.
It is understood that the study course of "learning the law and subtracting points" is set up by the provincial public security traffic management department, covering 12 aspects of safe driving knowledge, emergency risk avoidance common sense, traffic violation judgment and other aspects; the examination question bank is based on the national unified question bank as the main body, supplemented by the theme bank in various places, each examination randomly draws 20 questions, and the answer to 18 questions and above is qualified.
The content of the study test includes: traffic violation judgment and case analysis, traffic accident case warning education, road traffic accident self-negotiation and handling, fast and fast compensation related regulations, common traffic signs, marking lines and traffic police gesture recognition, safe driving knowledge, highway driving knowledge, bad weather and complex road driving knowledge, civilized driving knowledge, defensive driving knowledge, emergency avoidance knowledge, driving mental health knowledge, and other related knowledge.
After receiving traffic safety education, if the driver of a motor vehicle meets the conditions for point reduction or exemption, he or she will be deducted from his existing accumulated point value, and a maximum of 6 points can be accumulated through the "learning method deduction" in each scoring cycle.
It should be noted that there are the following categories of people who cannot apply for the deduction of points for studying the law, including those who have more than two full score records in the current scoring period, or whose cumulative scores have reached twelve points;
In the previous scoring cycle, the driver of the motor vehicle has two or more records of full scores;
In the last three scoring cycles, the driver of a motor vehicle has been punished for fleeing after causing a traffic accident, or driving a motor vehicle after drinking alcohol, or using a forged or altered motor vehicle number plate, driving license, driver's license, school bus sign, or using other motor vehicle number plates or driving licenses, or buying and selling points;
The motor vehicle driver's license is during the internship period, or the motor vehicle driver's license is overdue and has not been examined, or the motor vehicle driver's license is withheld or temporarily withheld;
The driver of the motor vehicle has a record of an unhandled traffic violation in his name;
Motor vehicles whose name the driver of a motor vehicle has exceeded the validity period of safety technical inspections or who have not gone through deregistration in accordance with regulations;
Motor vehicle drivers participate in traffic safety education to reduce or waive points for road traffic safety violations, or there are fraudulent or impersonation situations when the motor vehicle drivers have full scores for illegal points and the examination and inspection education study examinations.
