"OHNUT Oule" A plant beverage advertising "low card" involving false publicity Shanghai Hai Meow Food Co., Ltd. was fined 600 yuan

China Net Finance and Economics, December 8 (reporter Ye Jia) a few days ago, the reporter learned from the website of the Shanghai Market Supervision Bureau that Shanghai Hai Meow Food Co., Ltd. was fined 600 yuan for advertising an "OHNUT" brand plant beverage "low card" suspected of false publicity in the online store, and at the same time, the company was fined 500 yuan for the existence of "inaccurate advertising" in another e-commerce store.

According to the relevant penalty decision (Shanghai Municipal Supervision and Treasure Department [2021] No. 132021002370), on September 24, 2021, the Baoshan District Market Supervision received a report from consumers that a "OHNUT Oule" brand plant beverage released by Shanghai Haimeow Food Co., Ltd. on an e-commerce platform called "Ohnut Flagship Store" was suspected of illegal advertising.

The Baoshan District Market Supervision Inspection found that the parties released a pre-packaged food titled "[99 yuan 4L] Oule nut milk pregnant women sugar-free Badan wood drink coffee companion breakfast plant milk" in the e-commerce store, and the above link has a total of three products, of which "Oule sugar-free badan wood drink" is out of stock.

The above link shows "sugar-free" as out of stock at the mobile phone port flavor selection, and it is hidden when the "sugar-free" taste is out of stock on the computer side, and the party does not indicate "sugar-free" as out of stock in the computer-side promotional page, and the party's statement of the sales status of the product is inaccurate.

In addition, on September 25, the parties were also reported for alleged advertising violations in another e-commerce platform store, "OHNUT Flagship Store".

After the Baoshan District market supervision investigation, it was found that the parties published a prepackaged food titled "OHNUT Oule · [New Product • 12 Can Gift Box] Oule Nutrition Fortified High Calcium Sugar-free Low Calorie Almond Milk Breakfast Milk" in the above-mentioned stores, and the parties used "low card" for publicity, which did not meet the requirements of the general rules of the nutrition label of prepackaged food (GB28050-2011) for low energy content (80KJ/100ml liquid), and the promotional content was inconsistent with the actual situation.

Baoshan District Market Supervision held that the above-mentioned acts of the parties constituted "acts of inaccurate advertising" and "acts of publishing false advertisements" respectively, and ordered the parties to stop publishing illegal advertisements in accordance with the law and imposed administrative penalties of a fine of 500 yuan and a fine of 600 yuan.

According to public information, Shanghai Hai meow Food Co., Ltd. is mainly engaged in healthy and environmentally friendly diet products and offline catering store business, ANDNUT is the company's plant nut beverage brand. Tianyan check shows that the company was established in 2019, the registered capital of 6 million yuan, Luo Huiqin is the company's legal representative, concurrently serving as the company's general manager, while holding 95% of the company's shares, the remaining 5% of the shares held by another shareholder Wang Huanan.
