According to Tianyancha app, recently, the second-instance legal documents of the relevant case between Huawei Technologies Co., Ltd. and the State Intellectual Property Office were published, which involved a dispute over the trademark of "River Map" in the scientific instrument category, and the trial court was the Beijing Municipal High People's Court.

According to the document, the State Intellectual Property Office (SIPO) made a decision in December 2020 to reject and re-examine the trademark "River Map" for scientific instruments. In response, Huawei filed an administrative lawsuit with the Beijing Intellectual Property Court. The Beijing Intellectual Property Court held in the first instance that the facts found in the decision to be sued were clear and the law was correct. Huawei appealed against the first-instance judgment.

The Beijing Municipal Higher People's Court held in the second instance that the disputed trademark and the cited trademark were similar in terms of word composition, call, etc., and were used on the same or similar goods at the same time, and the difference was not enough to eliminate the confusion and misidentification of consumers, and Huawei's relevant grounds for appeal could not be established. The final judgment result was that Huawei's appeal was rejected and the original judgment was upheld.
