Case Review
At about 11:00 on October 19, 2014, the executor Peng X, driving an uninspected Su LC5607 walking tractor without a license, collided with the three-wheeled battery car driven by Zhao X when turning on the left side of the road, causing two cars to be damaged and Zhao X to be injured. On April 13, 2016, Mr. Zhao was identified as constituting a grade 10 disability. On January 18, 2017, the court ordered defendant Peng xxx to compensate Zhao xxx for various losses of 130,543.26 yuan, and to bear 2,833 yuan in appraisal and other expenses.
On May 5, 2017, because Mr. Peng did not perform his monetary payment obligation according to the judgment, Mr. Zhao applied to the court for compulsory enforcement. Since then, Peng Moumou has played "peek-a-boo" with the court, treating the court's summons as nothing. After the enforcement personnel's online investigation and control, the offline investigation and control did not find that the person subject to enforcement had a property clue available for enforcement, and the applicant for enforcement did not provide valuable property clues. Due to the objective inability of enforcement, the case entered a state of termination of procedures. The emotions of the applicant for execution then became more and more agitated, and even pointed the finger at the court, making many complaints against the enforcement personnel. All this, while silently carrying down grievances and patiently explaining, the enforcement personnel are also like a fish in the throat, trying to find a breakthrough in the enforcement of the case.
Execution is always on the way
The time came to the autumn of 2021, after experiencing many early morning executions without success, a phone call near the end of the work brought a new turning point to the case: "Where are you, hurry to Picheng, now immediately add me WeChat, I have found the executor." After answering the phone, the enforcement team swept away the fatigue, reorganized one by one, rushed to the scene, and successfully brought the executed person to the court executive bureau.
In the summons room, the person subject to enforcement, Peng Moumou, smiled and agreed to negotiate the process, but said that he needed to apply for the executor to make a relatively large concession in the amount, and at the same time needed a longer installment payment period. In the face of the preaching of the executive staff, Peng Moumou always said that he did not have the ability to perform.
