Bad boy who is not recognized

Liu Sha still remembers the 2015 case, when the parents were notified, like most parents, they were very dazed, thinking that the procuratorate must have made a mistake, until they saw the video, one of the mothers cried on the spot, she really did not know that her child was like this. The video was recorded by the children themselves, in two cars, one of 6 people, one of 4 people, each slapping the mouth of one of the victims, forcing the other party to call Daddy, and pulling to a place to punch and kick, before returning with fun. The victim had seen one of the beaters in the circle of friends and knew that it was the "little big brother" Qian Jin of Mentougou. The two then called the police.

The case was transferred to Liu Sha, a procurator in the Juvenile Case Prosecution Department of the People's Procuratorate of Haidian District, Beijing (hereinafter referred to as "Haidian Uninspected"). The cause of this case was that Qian Jin was pulled to a WeChat group of Haidian children and quarreled with someone in the group. Qian Jin looked for a girl he knew and called out the two people in the group who insulted him, although one of them repeatedly claimed that he did not scold Qian Jin, but he was also brutally "taught" a lesson. The child who made his mother cry was the little brother of Qianjin, and his mother never knew that his son, who was quite well-behaved in his eyes, would also participate in such a thing.

In the end, two of the children who beat people were approved for arrest for "picking quarrels and provoking trouble", including Qian Jin. He had just turned 16 at the time, often drove the family's Audi car, brought people to the car, slapped his mouth, let him call his father, and sometimes beat people in public places like McDonald's, usually recording videos, threatening each other, and if he called the police, he would upload the video to the Internet. In their view, the video is not legal evidence, but a handle of humiliation.

In that case, taking into account many factors, two teenagers who were arrested were conditionally not prosecuted. In accordance with the usual judicial procedure, the matter is closed and the juvenile who does not prosecute is examined and decides whether to prosecute or not. The rest of the people went home easily. However, Haidian did not prosecute one more step, first, during the arrest stage, the beaters and parents were called to the procuratorate, and a reprimand meeting was held, and parents saw the video at the reprimand meeting; second, they urged parents, children and judicial social workers to sign an agreement, so that parents and children could regularly accept the help and education of judicial social workers (hereinafter referred to as "help and education") and observation. It was through judicial social workers that Liu Sha learned that among the two teenagers who were arrested, the conditions for money to enter the family were good, the father remarried, and he had a child with his wife, feeling indebted to money, spoiled from childhood, and gradually developed various bad habits; the other family conditions were more difficult, single parents, his father was a sanitation worker, he could not take care of him, he lived with his grandmother since he was a child, and he just entered adolescence and shook in society every day.

This kind of casual trouble, Liu Sha saw a lot, some are not accustomed to each other on the Internet, scolding and scolding to find someone to come out to fight, some are walking on the road, encountered, noisy can also fight. Previously prosecutors were only concerned with the case itself, where did these children come from, how should their actions be perceived, and were their actions traceable? Is it the environment or genes that shape them, and are they changeable? No one cares about such issues.

In the early years, there were actually more juvenile cases, and Yang Xin'e was the chief procurator of Haidian, who entered the Haidian Procuratorate in 2000 and began to be responsible for juvenile case prosecution work in 2006. She remembers that at that time, the proportion of juveniles involved in criminal offences in Haidian District exceeded 10%, and the work pressure was particularly high. At that time, Yang Xin'e could only handle adult cases, but according to the judicial spirit of China's "Law on the Protection of Minors" and the "Law on the Prevention of Juvenile Delinquency", juvenile judicial work should be guided by the protection of the rights and interests of minors and the prevention of crime. The specific problem yang Xin'e encountered was that she did not know how to deal with juvenile cases, such as the same behavior, when the arrest rate of foreign children was much higher than that of Beijing children, because if they did not approve arrests, the children arrested by the public security department would have to be released, the children in the field were highly mobile, and the arrest department had concerns, afraid that if the children were not arrested, they would run away, affecting the follow-up process, simply unify the arrests and put them in the detention center. For these children, Yang Xin'e has done a lot of non-prosecution treatment, because at their age, many behaviors do not meet the conditions for prosecution, such as fighting, petty theft, but this is easy to make people think of black box operations.

In a cross-disciplinary meeting, Yang Xin'e raised her own confusion, and she wanted to find a way to scientifically understand and evaluate the behavior of these children and justify not prosecuting. Xi Xiaohua, a professor at the Department of Sociology and Social Work (hereinafter referred to as the "Department of Social Work") of the School of Political Science and Law of Capital Normal University (hereinafter referred to as "First Normal University"), also attended the meeting, and "scientific assessment of juvenile delinquency" is one of her professional directions, and she is struggling to find a practice platform. The two hit it off and let the social worker join the uninspected work in Haidian.

In December 2009, Haidian Cooperated with Social Workers for the first time and piloted three cases, one of which, Yang Xin'e, is still fresh in her memory. At that time, the case of college students in Haidian was also handled by the uninspected department, and the party in that case was named Hu Bo, a "senior" student who came to Beijing for internship in other places, stole a mobile phone from a classmate, and then the case occurred and was detained in the detention center for a period of time. Because the attitude of admitting guilt was good and the victims were forgiven, Hu Bo was not prosecuted.

But social worker Wang Jie found that although there were no serious consequences, Hu Bo had a stress reaction, hiding in the dormitory every day, not daring to go out, not daring to see people, not daring to take off his hat and look up to talk to people, feeling that he could not wash the stains in his life. Later, Wang Jie conducted a detailed social investigation of Hu Bo through himself and his friends, family, colleagues, and classmates, and found that Hu Bo had never stolen anything before, and his character was also very good. Wang Jie found that the reason hu bo stole things was that he graduated from his "senior year" at that time and faced huge employment pressure, because of his personality, there was a special stress response, and the abnormal performance after his arrest was also part of his stress response. Wang Jie later told Yang Xin'e about her findings and judgments, and told her that through channeling, Hu Bo had gradually shaken off the shadows and found a new internship job.

Hu Bo's case is not typical, but Yang Xin'e is still particularly shocking. In her past perception, people who have broken the law belong to the marginalized, they will return to the marginal track, and teenagers do the same, isn't it natural? If you use bad teenagers to summarize these teenagers who have committed malicious acts, then Yang Xin'e once only saw "bad" and bad consequences, and rarely saw "teenagers".

This also reminds me that in the first half of this year, I interviewed in a prefecture-level city in the southwest, and talked with a local teacher who did special education about juvenile delinquency, and he told me that when he was a grassroots policeman, he often encountered homeless teenagers who robbed and stole, the vast majority of whom were 14 to 16 years old, and were only criminally responsible for 8 types of felonies, even under 14 years old, and did not bear any criminal responsibility, so they must be released unconditionally within 24 hours. When he was a policeman, he just hated it so much that he itched his teeth and sometimes he couldn't help but beat him up. He also did not know where these children came from, why they were robbed and stolen, and what impact their future would have on society. In a way, this is a group of teenagers who have been floating for a long time and are not recognized.

As a social work professional, these have always been what Xi Xiaohua wants to know. So far, there is no systematic research on juvenile delinquency in China, and Xi Xiaohua has cooperated with some unmanaged institutions and specialized schools, but they are all project-based, and it is impossible to track these teenagers who have had bad behaviors for a long time, let alone understand them and provide help. After cooperating with Haidian in 2009, in 2012, relying on the First Normal University, Xi Xiaohua officially founded the Beijing Beyond Youth Social Work Center (hereinafter referred to as "Beyond"), and expanded the cooperation from the procuratorial organs to schools, public security, courts, and youth league committees, and began to make social investigation reports on bad teenagers to help judicial organs re-understand these bad teenagers.

Neglect from adults

Unlike the judiciary, parental neglect often comes from the other end, seeing only "juveniles" and not "bad" and bad harm. Yang Xin'e has done an impressive school bullying, more than ten years ago, a group of girls targeted a girl, every day to manage her money, do not give money to scold, continuous bullying for two or three months, the murdered girl stole more than 10,000 yuan from home to the bully. The crime occurred because the girl wrote a diary, and the diary was seen by her father. Only one of the girls who committed the murder was over the age of 16 and the only one to enter the judicial process and be transferred to the procuratorate. The procuratorate invited a psychological counselor to assist in handling the case, and finally found that the reason why the suspect bullied his classmates was that her parents divorced early, and she felt that her father was particularly nestled, and the victim was particularly like her father, which made her feel unpleasant, but she pitied her and even helped her occasionally.

In this matter, the bullied girl never dared to tell the family, because her father's domestic violence was serious, she felt that telling her mother was equivalent to telling her father, and her father knew that she was beaten more severely. When the girl's father found out that the child was being bullied, he was very angry, angry that his daughter was not angry, and actually cowardly to this extent. In that case, with the assistance of a psychological counselor, the murdered girl basically returned to the normal growth track. But the girl was harmed for her boyfriend, and later committed another crime. Looking back now, Yang Xin'e feels that the most incredible thing is that there were many girls who were harmed at that time, but because they did not reach the age of judicial intervention, they did not get any intervention, and all the adults did not feel that there was anything wrong. The schools concerned also took little action. Yang Xin'e remembered that at that time, the school did assist the murdered girls to transfer to another school in the same group, but after the transfer, the girls encountered many problems in the new school, such as no school uniforms and no examination materials, which were properly resolved under the coordination of the procuratorial organs.

In fact, the vast majority of children who enter the vision of judicial social workers are over the age of 16 and have already had more serious consequences of breaking the law and committing crimes. Xi Xiaohua did a survey in 2014, a sample of 233 juveniles involved in crimes, and the survey showed that these children began to have their first bad behaviors at the age of 12.5 on average, such as fighting, alcoholism, nighttime homelessness, and carrying controlled knives. This effectively means that a large number of adolescents are still being shielded from harm. Pi Yijun, a professor at the China University of Political Science and Law who has long studied juvenile delinquency, reminded me that in March 2015, in the famous case of Chinese students bullying classmates in California, one of the defendants sentenced to 6 years in prison mainly helped hand over scissors and did not actually harm them. Pi Yijun agrees with this sentencing concept, arguing that there are many ways of violence, in addition to direct physical harm, isolation, abuse, and exclusion, including teachers, will cause great harm to the victim, and such injuries are likely to be very widespread in the campus, but they have not received any attention until they are exposed in some extreme form.

When Li Han, a social worker of "Beyond", did social research and contacted the parents of bad teenagers, he often heard their very shocked and panicked tones: "I am dying", "I lost 20 pounds", "My hair is white", "I cry every day". Li Han thought that they really cared about their children's education, but then, whenever they held parent-child activities, they signed up for 10 families, up to 5, work, business, rest, there are always things more important than children. Because of the long-term help and teaching of bad teenagers, occasionally there are friends to find Li Han to help, generally the children in the family began to have bad behavior, parents do not know how to discipline. Li Han was enthusiastic about helping and giving disciplinary advice at the beginning, which requires parents to cooperate highly, such as recording children's behavior, accompanying children more, learning to interact with children, and regularly communicating with social workers and analyzing children's behavior, but Li Han rarely encounters parents who can persist for more than 3 months.

Gu Xuelei, the presiding judge of the Juvenile Court of the Changning Court in Shanghai, tried a case, the most vicious violent case of his career, a teenager who had just turned 14 years old, after stepping on the spot many times, robbed and intensified rape in a shop at Hongqiao Airport. The teenager is a native of Heilongjiang, had children out of wedlock, his father worked in a mine, and he wandered alone to Shanghai. After the incident, the police sent a letter to the father, asking him to confirm, he wrote back to express his gratitude to the police for helping him find the person, he himself looked for it, but did not find it. And then what? No more then. This father did not appear at the scene of the trial, and Xue Gulei could not guess what kind of father this was.

With more contact with the families of bad teenagers, Li Han has become very tolerant of the happiness standards of the parent-child relationship. Once, when she went to a normal school to do activities, a girl complained to Li Han that her mother was too annoyed, she didn't sleep enough in the morning to get up, go out in a hurry, and her mother had to pour a glass of milk and let her drink it before she was allowed to leave. After Listening, Li Han sighed heartily: "You are so happy." She remembered that she had been helping children in a special school to do summer camps one year, and once after the end of the activity, there was a heavy rainstorm, and a junior high school boy with a height of 1.8 meters told Li Han at the window that his mother had never rained to pick him up, and especially wanted to wait for his mother to pick him up once. Li Han communicated with the mother for half a day, but the mother was unwilling to give up the work at hand.

It is under the neglect of adults that children entering puberty will seek their own solutions. Li Han, a veteran judicial social worker at Beyond, remembers doing a social survey and interviewing a 16-year-old boy who was strong. It was a murder case, because of the love affair, a group of boys killed an underage boy, and The strong were also involved. In the interview, Li Han clearly felt that Zhuangzhuang did not approve of the small group he belonged to, and she asked him why he had to be with them, and Zhuangzhuang said that if he did not get the protection of this small group, he would be bullied. Li Han asked him why he didn't tell the teacher and the parents, and he said that telling the teacher would only be criticized, and it was useless to tell the parents. Li Han later found that in the cases she came into contact with, many children had personally experienced or watched the law and the jungle on campus, from victims and bystanders to perpetrators.

But not all victims will become bad teenagers, And Pi Yijun, a professor at the China University of Political Science and Law, has long studied juvenile delinquency, and he calls juveniles deviant of bad behavior and even illegal crimes. He believes that the physiological development of adolescence is no less than a fierce wind and waves, accumulating huge energy, and if children at this stage are frustrated, they will naturally resist and attack. "Truancy is an attack, learning difficulties, discrimination by teachers, no friends, the use of absenteeism, truancy to express resistance, the most extreme of course is personal attacks." He observed that different children attack differently, and those children whose parents have extremely high expectations and are severely disciplined from an early age tend to attack themselves if they are frustrated, and eventually develop depression, self-harm, and even suicide; while those children who are doted on or ignored from an early age are more likely to attack others, such as stealing, robbing, and bullying others.

Troubled teenagers

Xi Xiaohua once came into contact with a 16-year-old girl Dream, her parents have favored sons over daughters since childhood, and have always ignored her, after going to school, because of poor learning, she has never been affirmed by teachers and classmates. Later, she dreamed of working in a restaurant in Beijing, met a chef who praised her every day, and soon fell in love with the chef, and had sex and became pregnant. Lacking common sense, Mengmeng noticed it after several months of pregnancy, when the chef was gone. Because she didn't know how to deal with it at all, in the end, Mengmeng decided that the child would fall to her death after birth, and then when this did not happen.

In Xi Xiaohua's view, the crime itself is a complex tragedy. But it's a good illustration of how many juvenile delinquents are due to, "without good coaching and support, his growth encountered difficulties that were difficult to break through, resulting in his inability to put his behavior aside." According to the definition of the Ministry of Civil Affairs, children in distress refer to those children who are seriously ill and disabled in their lives, but Xi Xiaohua believes that in a sense, bad teenagers are also difficult teenagers.

But not all bad boys' plight is as obvious as a dream. In Li Han's social work career, there was a person who paid the most effort and regretted the most, and his name was Gao Ce. Gao Ce was first imprisoned at the age of 17, because he owed money for gambling, grabbed a mobile phone at the school gate, and was sentenced to picking quarrels and provoking trouble. In fact, before the incident, Li Han especially wanted to know Gao Ce and constantly looked for someone to invite Gao Ce to the social work center to play, but Gao Ce never came. Li Han was interested in Gao Ce for two reasons: first, he was a "big brother" figure among his peers in Haidian; second, at that time, Gao Ce was already caught up in gambling and drugs at the same time, which was rare among his peers.

Gao Ce is a native of Beijing, once attended a good middle school in Haidian, and it is reasonable to say that he will not go so far. After establishing contact with Gao Ce, Li Han learned that Gao Ce's mother was married to Beijing from a foreigner, worked in accounting and sales, was extremely diligent and enterprising, and was the economic pillar of the family, while Gao Ce's father was a Beijing native, working as a security guard in a company, with a low salary and drinking alcohol all year round. Gao Ce grew up almost in the belittling and insulting voices of his mother to his father, a hard-working hostess who gave, expected and complained a lot about the family. Gao Ce is like a mother, good-looking, smart, sweet-mouthed, sensible, and deeply loved by his mother. He had hated his father since childhood.

At the beginning, Gao Ce's academic performance declined, he fell in love, his father began to discipline him severely, and the already opposing father-son relationship became even worse. After convincing the education to be ineffective, Gao Ce's mother turned against her husband in a panic and sided with her husband. Subsequently, not long after studying in ordinary middle schools, Gao Ce went to a special school. There, Li Han's colleagues found that in the boarding school environment, Gao Ce was emotionally stable and performed well, but every time he returned home on the weekend, everything had to start from scratch. After long-term contact with Gao Ce, Li Han found that he was essentially a good boy, smart, moralistic, emotional, and had a basic concept of right and wrong, although drug addiction and gambling, but strictly forbidden to be contaminated with the 3 little brothers he carried. Li Han's judgment at that time was that if he was sentenced to a suspended sentence and let Gao Ce work in a stable observation base for 3 years, Li Han would go to counseling once a week, and he would have great hope of getting back on track. But the probation is not at home, Li Han saw his father's shadow in Gao Ce, and Li Han also had a lot of communication with his mother, and did not have the slightest hope for his family environment. But at that time, the work of "transcendence" was just beginning, and neither the social worker nor the judge could find a suitable base for Gao Ce, in this case, the then 17-year-old Gao Ce was sentenced to 3 years in prison, 20 years old when he was released from the juvenile detention center, and the case was committed again a year later.

After the first release from prison, Gao Ce has refused to add Li Han's WeChat, after a long time, the two finally connected to the video phone, Li Han asked him why, Gao Ce said: "Brother Han, I miss you, we were so good at that time; but I also hate you, we were so good at the time, but you wrote my social investigation report so badly." After listening to it, Li Han felt particularly sorry, she knew that before the first incident, because of gambling and drug-related, Gao Ce once fell into the vortex of usury, and later used his relatively normal income to make up for the hole, but soon fell into it again. He kept trying, but ultimately failed. He couldn't break through his predicament, and she couldn't help. After 10 years as a judicial social worker, the deeper Li Han knows about this group of children, the deeper his sympathy for them, she said: "Growing up is painful, but some people have experienced more pain. ”

Their world

Beyond began doing late-night outreach this year and has already done it twice. It is to go into the place where the teenagers gather at night and persuade them to go home. There is a dedicated team of social workers in Hong Kong who do late-night outreach services and go out into the streets to persuade children to go home. They also have a special building that provides beds, equipped with basketball courts, various online game machines, life teachers and managers are on duty 24 hours a day, placing these teenagers who do not return home at night, and they can even provide jobs for children.

"Beyond" can't do this, they mainly observe and evaluate the existing service recipients, see what they are doing, and meet their friends by the way. There are not many places where children gather in Haidian, there are only three or four in total, all in public spaces that cannot be photographed by cameras, such as the underground of shopping malls. Usually, the relationship is good, and the children are willing to talk to the social worker when they encounter things. During those two late-night outreach, Li Han encountered contradictions with the children.

On one occasion, Li Han met a child named Zhang Lin, who was her helper. Zhang Lin told Li Han that the girls were in conflict, a group of people beat another girl, the girl he liked to be beaten, wanted to fall in love with others, and was protecting it. As a result, when Li Han went, he couldn't fight, and the girl who beat her came to consult with her, saying that the girl owed them money, and how to solve it was better. Li Han had forgotten what he had at that time, but the two sides did stop and left. When he left, Li Han pulled Zhang Lin back alone and asked him, "Where are the girls going?" Zhang Lin said an address, and Li Han asked Zhang Lin: "Are you going?" Zhang Lin said that he would definitely not go. At that time, Zhang Lin did not know that there was also a social worker at that address. After meeting the social worker at the second place, the two sides completely reconciled and later became friends.

Li Han knew that they couldn't do anything good by mixing together, but that "bad thing" did pass, which was the purpose of late-night outreach. In fact, Li Han felt very sorry, if manpower and material resources allowed, she especially hoped that there was a special team that could do late-night outreach and enter the lives of this group of children more deeply. Nowadays, most of the bad teenagers in Haidian, Li Han knows, open the circle of friends, you can see their lives. A group of friends together, every day and night, drinking, smoking, fighting, racing, bundying, clubbing, indeed too happy, attraction is fatal. So Li Han doesn't think they can replace the world, what they have to do is actually expand their world.

When Li Han exchanged in Hong Kong before, he liked a firefighter program in Hong Kong at that time, that is, sponsored by some fund households, supporting firefighters to free up a week, do camps with bad teenagers, eat and live together, complete physical challenges together, understand fire knowledge, and then firefighters can contact the children themselves to help them get on the right track, which is to help children expand their circle of friends. Li Han has always hoped that in addition to social workers, institutions can attract more adults to interact with this group of teenagers, but the enthusiasm is often high for some middle-aged and elderly people, and unfortunately, they do not recruit children to like, because their way likes preaching. In essence, preaching is the hope of replacing the child's original world, which simply does not work.

But the "beyond" event itself is popular. At present, there are two categories of "transcendent" gangs and teachers: one is one-on-one gang teaching in detention centers and juvenile detention centers, mainly talking; the other is to sign a 3 to 6 months of gang and education agreements, and then carry out group help and education. Because the help and education itself is not legally mandatory, many migrant teenagers from other places do not come after signing the agreement, and Li Han has no way. But as soon as the children come once, they will come again. Because the activities of the social work center are well designed to be fun, you can have friends and smoke freely.

One of Li Han's children, Daewoo, 17, was arrested for stealing a motorcycle. Daewoo's mother died early, and his father didn't care much about him, so although he was quite tall and mental, he dressed sloppily and sloppily, and no one took care of him at first glance. Daewoo is not good at school, but he likes motorcycles, is proficient in car repair, and has a good relationship with a group of children who play motorcycles, and others will call him when they steal cars. He was scared every time he stole a car, but he couldn't refuse, not because someone forced him, but because everyone adored him and stole the car. After being arrested, Daewoo finally signed a six-month help and education agreement with "Beyond" on conditionality, and as a result, after half a year, he also came to participate in activities and came every week, especially positively. Li Han feels that this is because, as a marginal group, he is too lonely and needs to be recognized.

In a series of studies, Xi Xiaohua did find that the self-efficacy of bad teenagers is very low, that is, their confidence in completing their tasks is very low.
